WI v. Theodore Edgecomb Trial Day 6 - Prosecution Closing Argument by Grant Huebner

  • Theodore Malcolm Edgecomb, 31. Black. Charged with first-degree reckless homicide, with a modifier of use of a dangerous weapon. He also charged with felony bail jumping, and misdemeanor bail jumping.
    victim: Jason Cleereman, 54. Milwaukee immigration attorney and activist. White. Shot in the left eyebrow.
    According to victim Jason Cleereman’s wife, she was driving her husband westbound in Milwaukee on Sept 22, 2020, Edgecomb rode his bike eastbound in her lane (wrong direction), and she had to swerve out of the way to miss him. The victim then yelled “what the heck!” out the window. Edgecomb then pulled over at a red light next to the victim’s window and asked if he was talking to him and he said yes. Edgecomb then punched Cleereman causing him to bleed and fled. The punch from Edgecomb is captured on video, this has not been released to the public yet, but the judge ruled it will come into trial.
    The couple then drove after Edgecomb, Jason Cleereman exited the car at an intersection and approached Edgecomb, his wife says she yelled to him about Edgecomb having a gun, but he didn’t react and Edgecomb shot him, and then looked like he would shoot her too, but fled with his bicycle. The victim died of his injuries and was found lying facedown on a staircase. This was also captured on CCTV footage (we have the footage).
    His attorneys say Cleereman’s car almost hit him on his bike, that Jason rolled down his window (passenger side) and yelled a racial slur at him, they claim Cleereman was drunk. They say his toxicology level indicated he was legally drunk. (We do not have the autopsy report). The defense then says the Cleermans followed Egdecomb on his bike with their car (on video), Jason got out and went toward Edgecomb. They say he shot in self-defense. There is mention of Cleereman having a folded pocket knife in his pocket but no mention of if Edgecomb saw/knew this. Defense announced after seeing self-defense expert, John Black, testified on behalf of KYLE RITTENHOUSE, they will call him as a witness in this trial, “Theodore Edgecomb deserves the same right that Kyle Rittenhouse got.

    I think the wife was scrutinized totally unfairly. I react so strange in shock and I know from personal experience I would not be instantly hysterical. I don't know. I listened with an open mind. I cannot buy the defense.

      Totally agree. They were together over 30 years, NOBODY knows what they'd do looking at their spouses corpse.
      My grandmom made the bed with my grandpop still in it, dead. My ex wanted to prove the person who ran over his mom was a criminal, so he slept in his car outside the guys house & followed him for 2 days. A girl from my school screamed that her sister moved in the casket, right in the middle of the funeral.
      But we're supposed to think taking the wallet would qualify her for a psychiatric hospital...

    Have not kept up with this trial but handguns do not go off without you pulling the trigger.
    You do not pull a handgun on another person unless you intend to kill if you do otherwise you should never own a gun.

      Exactly. And that is his claim of self-defense. Mr. Edgecomb initially said he shot Mr. Cleereman because he was in fear for his life and that he knows that it was no accident, that they were deliberately hunting him down. According to the video it should be not guilty.

      😂😂IKR~We need to send them to prison for 5 yrs each time because they get a fine while legit owners like myself are hit with changing laws. My state became a 2A sanctuary a couple of yrs ago and for those who do break the few gun laws the sentences are harsh.💙👮‍♂👨‍⚖⚖💪🐎🤠

      Agreed,prosecutor is so nice to listen to, so organized and tells the facts, no vague statements or inspirational quotes like the defense attorney.
      He is just as good as the prosecutor in the Chandler Halderdon trial , he did a great job also, and both jury’s barely needed to deliberate after seeing the great presentation of evidence

    Edgecomb was the worst person to ever put on the stand. After his performance, I can't see how they would ever find him not guilty. His lawyers should have strongly suggested that he not take the stand. It was hard to watch him.

      I was thinking 5 hours. They may struggle to know exactly what fits best. I kept an open mind for the entire case but I would find him guilty of the top charge. I found his own testimony to be very damaging and didn’t find him credible at all.

      @@jnnlis Based on the video it should be not guilty. A prosecutor cannot entrap a defendant into the response they want due to the defendant's inexperience. Mr. Edgecomb was pursued by the Cleereman's.

I'm not some young pup here talking out my a&&....I was married 25 years, divorced 10, 5 married kids, 14 grandkids, and a lot of life experience under my belt. Way outside of that though, I read the discovery, watched every minute of the trial, heard every objection and ruling, and studied the law on this case. He was found guilty of First Degree Reckless Homicide (covered in Section 940.02 of the Wisconsin Statutes) which carries a penalty of 60 years in prison. Mitigating circumstances could have reduced the penalty to 40 years in prison, but there are no mitigating factors. Add the bail jumping and weapons charges to consider as well.
      All that to say…I wasn't wrong.

      Everyone agrees he did not want to kill him at the lights. He's not accused of that. The accusation is he shot him knowing the shot would kill him. But he did intend to kill him when he pointed the gun at his head and pull the trigger. It was not an accident, because guns cannot fire unless you pull the trigger. Unless you agree with the Alec Baldwin defense.👈🤣🤣🤣🤣

      The defense lawyer is terrible. His case was a disaster and the judge was ticked off because of it. The motions out of the sight of the jury were amateur at best. They were so bad that he may have a shot at appeal to be honest. IMO he's guilty as charged. We shall see...

      @Christina Rosser the fact that he even has a chance to appeal, gives the defendant a chance. A defense attorney's job is to create doubt.. he created doubt In an open close case he had little to nothing to work with an put up a fight. The pressure of being a defense attorney when the judge is unprofessional and constantly sighing and complaining about everything sustaining every approach you take is highly skillful

      Kayla: Yep! The prosecutor does such a good job of presenting (overwhelming) evidence that he doesn’t need technology at all, it’s unnecessary. We already saw the videos and heard the “great” testimony of the defendant

    The prosecutor has annunciation problems and screams at the defendant and cut him off when he tried to answer. You cannot entrap someone into the response you want especially when their life is on the line, which is what he did. In this case, and because the state has the burden, it was not proven beyond a reasonable doubt. Either Not Guilty or Mistrial. The video does support the self-defense claim.

      It's a hostile witness, you get to cut them off and require y/n answers. Do you know nothing about court? Only 1 of them had deadly force and the one with the gun initiated the fight. Good luck with reasonable doubt.
