- Hello guys and gals, it's me Mutahar again! This time we take a look at a situation where 20 years worth of modding is at risk if it's anywhere near Nintendo related due to a new campaign by the legal team at Nintendo of America. Garry's Mod is a gaming icon and the modding community runs deep in relation to it and currently a mass takedown of mods are occuring if they feature any Nintendo made asset. Thanks for watching!

Seems like a very fun time to remind everyone that it’s very easy to mod your 3DS, Wii, and Wii U, and that homebrew emulators and USB Loaders are the best way to experience Nintendo’s library of classic games all the way up to the Wii (along with a select few DS games that aren’t too resource intensive)

Copyright laws really need to be reformed. I’m sick of corporations using it to basically bully their consumers just because they show their appreciation. Typical Nintendo having an absolute fit over having even a single hair strand of Luigi’s mustache on another game.
I think the laws and the legal system itself need to be reformed. A lot of the Gary's Mod Mario content that's user-created/(not asset rips) and doesn't imitate real Nintendo games feels like "fair use" under DMCA to me - clearly parodies (especially when use for videos like machinima). But Nintendo has enough money for litigation that they can intimidate almost anyone into takedowns whether they're warranted or not.
Corporations and lawyers make too much money to allow change. They'll bribe lawmakers to back down. Nothing new.

They use japan's copyright laws which has literally no concept of "Fair Use" as it exists in America. They don't care.

Only Nintendo would strike down free advertising and word of mouth for their franchises.
It perfectly fits Nintendo’s controlling attitude to expect even free advertising to behave like an advertising agency, subservient to their will and only producing clean, finely polished content entirely in line with their dictates. Hence why they’ve gone out against actual free advertising like content creators, eSports initiatives and other fan works in the past.

For those people who don't know, Japan doesn't have free use laws so majority of Japanese companies are notorious for sending copywrite strikes on the Internet for using their contents, even just a snippet of it. It's not an issue with US or other countries, Japan is just very outdated to things from the digital world.
Fair use is much older than the world wide web. It was and is to this day an issue with analogue copyright too.
I mean nintendo still sends their fans fax... that's not me trying to spell facts all cool... that's the outdated email-like thing... fax machines... nintendo still uses those.
@@Infinite3Fold888 That applies to any Japanese companies. Even in the place I work, some prefer to send documents via fax due to privacy and security purposes, though, it rarely happens nowadays. Japan likes to keep it old school sometimes, whether it's good, bad or stupid.

There's literally no encryption on the phone line as standard so if it's not relayed as fax over IP (huge doubt that an organisation would bother to do this if they are still using fax at all, the endpoint where the inbound fax entered IP on your network had to be unencrypted on the other side too for the standard to work...) then it's literally your private info in plaintext which any amateur can pull out of the line during transmission. There is also no sender verification, it's impossible, so a spoofed fax could make it in and pretend to be from anyone and it's impossible to disprove because no DKIM or SPF etc. like we have with email.

I just think its crazy G-Mod has been huge for at least the last 15 years but now Nintendo has a problem with it.
They got a problem with it bc they're competing with the steam deck and other handheld PCs with the switch. I think they're trying to go after these sorts of things like Gary's Mod and Yuzu because of that, where they don't want a Mario or Zelda game on PC or some shit. I feel like the sort of copyright situation we have now is really dumb, both because intellectual property is an inherently flawed concept (the idea of private property only makes sense when applied to actual physical property, not the image of something or a digital copy of it) and because intellectual property copyright laws like this always result in frivolous unnecessary garbage like this happening
Though it does make sense in the long run from a business perspective. If I wanted to make a series of movies I would have to compete with other people over something I created. Big corporations will go in and steal properties left, right and center. Indie would no longer exist. At least right now when they get caught stealing you can take em to court and you'll most likely get a settlement and they buy it off of you.
It feels like Nintendo are riding the high of the Yuzu case and striking while while the iron is hot. Further proof that it is your moral OBLIGATION to emulate their games

The only reason I even started playing the legend of zelda was because of a Kakariko Villiage map for TTT. My friend told me it was from zelda, so I checked it out. Now I have pretty much played every game in the series. These mods help Nintendo more than they harm them. I can't believe how Nintendo is handling this.

I have a similar story for how I got into stardew valley, I found the minecraft modpack farming valley and was quickly hooked, now I have stardew on steam, switch and series s, had it not been for them turning a blind eye to a pretty odvious ripoff then I would probably have never bought stardew.

as a 2000s kid who grew up playing Little Big Planet instead, which was basically all user generated content, so much of what i grew up to learn about regarding gaming was through levels dedicated to other IPs, kind of like Garry's Mod did.
Of course in LBP you couldn't straight up rip models out of other games to use them there, but representation of your IP in user generated content driven game is so, so, so underrated by big companies

@epicjonny155 when you upload mods to the steam worlshop you dont get paid for them, and when you sub to a mod you dont pay anything. These are not mods you find on patreon or behind a paywall, theyre mods integrated into a steam workshop. Some of these mods have been up for over a decade, nintendo is taking rhem down because they are ultra petty.

@epicjonny155 steam workshops have ratings and awards but there is no profit from awards. Nexus has endorsements but this isnt about external mods, its workshop mods they are striking.

You know, say what you want about SEGA making mostly mid games, but at least they actually have a lot of respect for their fans. As a former Sonic fan, I can attest that one of the main reasons there’s such a massive modding and fan project community is because SEGA lets it get away with just about anything. And would you’ve guessed, even if they aren’t usually particularly good, their games still consistently sell well. When will Nintendo learn that they gain nothing from being so cutthroat when it comes to their IP’s? Microsoft, EA, and Activision Blizzard are all laughing at how slimy they’ve gotten at this point.

I would have expected this to happen when the models were actually in high use and highly present in the public eye, like when the Vanoss Crew was using the Mario models for their character skins.
Their time period of high video publishing for Gary’s Mod videos, Scary Maps, Death Run, Etc., should have flagged Nintendo to act if this was something that Nintendo wanted to act on.
