When I divorced my husband who refused to work while i worked hard, he said "You keep the house" (it was a rental and I was paying the rent) and he followed with, "and I'll take the car". I was using the car to get to work and making the payments myself. Obviously he got neither one and I got rid of him. 🥳🥳

this happens all the time the other way, my ex tried that crap with me and I told her "o.k. fine but were taking my name of everything for the car" So all her bills went up because she lost the 35% discounted military insurance rate on it and she had to refinance it and find another co-signer for it, I borrowed my parents 2nd car and after the divorce I called up a buddy who is a Classic car dealer and bought a fixer-up 75 Malibu for $2500 bucks and got back into the car scene which she wanted no part of.

He probably didn't know that letting the car go into repo would put him on the hook for the balance after the bank resold the car. I know someone who was contemplating doing the exact same thing recently, because she overpaid for the car in the first place and wants out of the high car note. I explained to her that sticking it out is really her only choice, because she is going to end up paying for that car no matter what.

im being garnished for a defaulted car loan and luckily ive been able to pay it.... 25% of my checks.... so monthly, theyre taking between 750-1000 due to how much i make. i have a few hundred dollars more to pay and i will have paid off $9800 dollars. thank you god for providing me this descent enough job to take care of my responsibilities.
Was there another option other than letting the car go into repo? Were you aware of the consequences in advance? You seem to have a pretty good attitude about it, but I would be pressed about having to pay up to grand a month for a car I no longer have.
I didn't think they could do that. I know for school loans, child support they can but didn't think they could for a commercial car loan,just repossession

He probably didn't know that in advance. I have a friend who overpaid for a car and then was considering letting it go to repo to get out from under the payments. I had to explain that she would be on the hook for the balance after the car was resold after the repo.
The ruling in this case was absolutely brutal on Judge Judy's part. His whole purpose in going on the show was to get $5k knocked off the balance.

I like the outcome. It's not a money award, but a finding that squarely puts the responsibility for the loan on the defendant.
I get a bad feeling the lenders are going to end up being stiffed, or it will take a long time to get their money. They'll probably only get pennies in garnishments.
I thought this outcome screwed the plaintiff, because even if the defendant is garnished, collections won't be getting much, and the plaintiff will still be on the hook as a cosigner.
It would have been much better if Judge Judy had awarded $5k to the plaintiff, which would have been paid by the show, and then did the other stuff to make sure he would be on the hook for the balance. Thinking a little further about it, I have to wonder if that is exactly what Judge Judy did even if it wasn't shown.

I agree but also disagree. When you co-sign a loan, it becomes a joint responsibility. She might not like that he stopped paying, but they terms of the loan are what dictates what happens. If the primary person defaults, the secondary person becomes liable. She shouldn't have signed for it OR she should have had her name taken off the loan when they separated. I'm sure this guy will not pay for this car regardless of the order.
