      He shocked because it was a poor decision without really examining the facts. The devil is in the details when you realize the homeowners were being impossible as a tactic and used a medical excuse to justify denying all alternate install dates. When asked about being yelled at the mother was very general, confusing the company's frustration on not being able to get an install date as being yelled at. "No Mam, we can not come Sunday at 3pm our crews are off that day." That is not yelling. As rule, Companies in business that long dont do it by mistreating their customers. Besides, even if true poor customer service does not equal ,"free" goods and services. So, the claim that install company associate was rude just to be rude doe s not hold water. Also, You could tell the homeowner was playing games from the beginning, knowingly okay with everything and having the Install company move forward with custom window production without a signed contract that he knew he could rely on later to win in court. That right there shows you intent by each party. Install Company was trusting, Homeonwer was being devious. (That was slick) Sadly, this is typical in the industry, people will try anything to get something for nothing. The company owner did a bad job of demonstrating the customers uncooperativeness. He could have shown the dates they tried to set and each excuse that was given to prove his point and show the home owners were insincere about completing the job all along. Here the Company had to eat its time, labor and material costs.

      It must be a different interpretation of a 'contract' in the US. Here in the UK, there is no actual need for it to be written or signed. Here, once 'consideration' has been made, namely the initial payment made by the homeowner, and then accepted by the contractor, then a contract would be in effect. This would then be about whether the contractor is in breach of that contract!

      it was very likely her in the background. I completely believe the plaintiff's account of the details, and this Teressa person likely did act very unprofessional, and didn't wish to be subject to cross examination regarding it, which is why this Gaynor person came "out of retirement" to represent the company. Likely there of a family connection there, and he believed he got away with similar complaints in the past, and was over confident he would again.

      The judge could have called for her to testify demanded all documentation about her supposed stroke which i believe was a lie and got her on the stand, a mention that the mother being seriously ill was able to attend but his little witch was not would i am sure have sufficed.

      Yup, he should have had standard terms of business that were published on his website and cited the payment of the deposit as a clear intent on the part of the Plaintiff to form a contract.
      A signature is only one way to demonstrate that clear intent. It's easy to argue that payment of a deposit also demonstrates that clear intent.

It does not matter what they have on their website, unless the order was placed through the website and during that process the terms were agreed to with the equivalent of a digital signature.
      You have it backwards. The payment of a deposit was with the intent to have windows installed. They never were. The receipt of the deposit was the same, an obligation to install windows. It didn't happen so even if you want to claim there was an implied contract, there is still a matter of reasonable due diligence to fulfill that contract. If the contractor had supplied evidence of attempts to do so, that would be a different matter. Failing any of that, all the evidence shows is their agreement was to install windows and they didn't.

      Well, he's not completely wrong in actuality. That's how that works actually. MOST distributors stopped selling standard stocked windows during Covid. Window distributors don't really keep standard stocked windows around. Only very recently has that changed back and standard windows are back in stock. But it's still hit and miss. There's also always the possibility the "standard" sizes aren't in stock and thus, you have to order them custom. That's another rule that all my distributors changed. You can't just wait for the stocked product to come in (well you could, but you don't get a timeline with that) so you have to end up custom ordering a "standard" window. But most thing are back to normal now, albeit distributors have kept quite a few covid rules that benefit them. He wasn't actually lying there though as a contractor. You'd have to go to a box store to buy them and pay a huge mark up. And hope they have the standard size in. Because there's a dozen "standard" sizes.

If it was the fault of the distributor then the contractor should have asked for a refund. However, I think the contractor would have mentioned that in this case, but he didn't.

      I've got some roofers trying to sue my mother for work done on her home but the agreement for the work was done by a family friend who has absolutely no say or permission to tell them to begin the work.. the roofers have told me on many occasions and on a recorded phone call that my mother never verbally or by writing agreed or told them to do anything it was the family friend so I'm anxious for this to go to court

Same with doors, cabients, bathroom vanities, shower pans, bathroom fixtures, etc. this house could have had custom built windows, but to say that there are no standard size windows as a defense to explain why you had to order custom windows is a blatant lie. The accurate statement would have been “standard sized windows wouldnt fit in their house because the dimensions dont allow for it”. To be a contractor and only order custom made windows is an absolute sham. Waste of money.

    Very simple case. No signed contract. Plaintiff gave evidence of the delay of window installation. Reasonable time period passed. Defendant didn't provide any evidence that there was a contract or testimony of attempts to install them. Defendant essentially put up no defense other than general statements because he wasn't present in the conversations. I'm glad the plaintiff was mostly made whole.

    I had my whole house done by a company well known in Michigan. I paid a little too much but I agreed to that price. They had to make every window custom as my house was built in 1952. The crew that came out to install them did so in less than six hours. I have a problem with ANY company that says the can't install windows on schedule. So he has been doing this for 40 years? Why didn't he install them on the day he promised?
