  • During the NEET-UG hearing at the Supreme Court, Advocate Mathews Nedumpara engaged in a tense exchange with Chief Justice of India DY Chandrachud. The confrontation unfolded while Senior Advocate Narendra Hooda was presenting arguments on behalf of another group of petitioner students. Nedumpara's attempts to voice concerns were met with strong response from the CJI. Click to know more

I saw the entire 2 days full arguments advocate nedumpara never jumped in from morning but he exactly jumped when CJI said we can't tell that leak is in large scale without any solid proof...even though CBI hasn't confirmed we have found all beneficiaries and punished. Mathews understood from his experience this is absolute nonsense where the judgement is going to be. He immediately stood up but CJI stopped him. Even when he came back at last he knew the verdict gonna be... He said hold government responsible but no responsibility or punishment given to NTA or education ministry for the mishap and question paper leak.... Which means question paper leak is legal in India from 23 July 2024 - supreme court of India

Advocate Mathew Nedupara made a fair point that the court could treat the exam as a preliminary test and conduct a main exam for the qualified students. This is the easiest way to segregate those who qualified through unfair means.

As for the merit of the matter... if there was a leak then the right solution would be to conduct a retest as in this digital era, no one would ever be able to assess the impact of the leak as to how many students actually benefitted illegally from this leak across the country.

The case was dragged to make it appear that justice will be rendered but unfortunately sanctified paper leak as localised though there is no concrete proof that the paper leak was not widespread. Mr Mathews Nedumbara was correct in seeking permission to speak when it matters but the judges denied him while allowing others to supersede. The honourable court should not taken so much time to have delivered a prejudged judgement.

The CJI could have been a bit considerate instead of directly talking about calling the security and throwing the advocate out. It was a big insult to the senior advocate. The CJI seems to be in a bad mood. The advocate just sought permission to speak, the CJI could have politely told him to wait instead of insilting before the whole court room. It was very surprising to see this avatar of our CJI who is normally very cool and composed.

Why does the SC permit such atrocious behaviour by Mr mathews? He should be debarred from practise for 1 year for contempt of Court and 1 more year for wasting public time.

A judge is a judge. A lawyer is only a lawyer like a Minister is a minister and an MP/MLA. All of them have their own powers, responsibilities and duties as per our constitution.

What does the CJ thinks of himself? It is the court of justice; not his father in law's property. If he warns that he would throw an advocate from the court, what shall the citizens of India do to him who, to quote Fali S Nariman, had passed a judgement "that is errenous on multiple grounds and bad in Law" in his decision on the Article 370 case? Why didn't the Bar protest when the CJ was behaving like a dictator?

But this fool of a lawyer was hell bent on undoing everything they set up. Like, agar mahol and flow sahi chalta hai to impact padta hai ek point ko aage rakhne par. Ambedkar who drafted the constitution hampered or tied down democratic rights and freedom of speech in the area called contempt of court. India is a semi democratic country not fully democratic. The court can rubbish any one after they are heard not before that. I cannot say I will set the NEET exams question paper and my wife will correct the answer paper and my brother in-law will sit in the selection committee if my son or daughter is appearing for the NEET exam. Contempt of court should be proved and punished by a body no way connected by the judicial system but unfortunately our constitution doesnt say so but allows the court itself to take up the issue and punish. For example if your sibbling does a mistake or offense you cannot say I will sit on the judgement seat , thats not the way. Ambedkar who was against arbitrariness was himself arbitrary. Equality should be exercised in all aspects of life not only in caste creed and religion.
