Canva License Terms for Digital Downloads - It's not as simple as you think

    I am not a lawyer, not legal advice, but i have sold digital assets for the last 15 years and have an understanding of all the terminology.
    They are trying to provide clarity between paid / pro content and free. The Pro license is VERY similar to other stock graphics and image sites. It has been industry standard for YEARS. Free content has VERY little restriction because canva has likey purchased the copyright or it was created by contract employees of the company instead of licensed. Anyone can use the free content for almost anything, including templates and printables, but it must be actually "locked down" within the design, not provided as a movable or transparent file that can easily be extracted from. Yes, you are right in that even free elements shouldn't be used for clipart or svgs, especially since most svg and clipart is sold with a commercial license and that is a no-no anyway, for free or pro since it is third-party selling.
    Canva has become a stock marketplace. They work with asset sellers that are in the business of selling the assets, they don't own those pro assets, those creators get paid per license, in addition to selling higher priced licensing for extended uses across other platforms geared to pros and companies. Otherwise, there would be no profit in selling digital assets. :)
    When you are using the pro elements in designs, Ultimately something that is transformative from the original elements needs to be created with a specific use purpose. Yes, the pro graphic assets can still be used for POD, but must not be used in a stand-alone fashion. This means, it is essential to combine several elements with text or content, overlapping, adding shadows, modding the colours, elements under or over. If your end-product (the design) was created in 10 minutes, from ideation to design, it likely isn't good enough to be considered transformative.
    Pro licenses are ALWAYS for a single-user, not 3rd party redistribution unless you are working for a single CLIENT, creating a specific design for them. (and in that case, you would follow the client clause) selling a single design to multiple clients (image transfers, sub designs, printables) was never allowed wit the pro elements. What will keep someone on the up and up using pro elements is if they ask themselves this question about what they are about to design: Is this design for a single user, or will someone be using what i make to resell and make a profit from the item I make?
    Your end-product / design, if created using pro design elements must not be intended for a secondary user to purchase from you, to make money by selling it to their customers,(because they don't hold the license for the pro assets.) the general intent for all things labeled pro or paid must be to sell a product or finished / customized design to a single person who will get enjoyment or purpose through purchasing the item, not profit.
    You are doing a good thing, helping people protect their businesses. If you use these items on POD and a content seller does a reverse image search and the design being sold isn't transformative enough, they could get a take-down. After so many, poof, that store is gone.

    Just want to offer some clarity at the 24:37 mark. It states that you CAN use their content in marketing or social media and can sell merchandise with your design on it. You stated that it says a person CANNOT and just didnt want anyone to get confused by that. :) :) Great breakdown!

    Thank you soooo much for doing this video!!! I was just getting ready to dig into what the commercial use license terms are & thought I would search first. You are very correct when you state that other YT channels are telling you to create your digital products (planners & stickers especially) and don’t even mention commercial use. Now, I have to say that I was fully aware enough to look into this myself and I still will. Just wanted to say Thank you!
    SIDE NOTE: I have read the terms of use on Creative Fabrica and it states that you have the commercial use license as long as YOU ARE CARRYING A MEMBERSHIP!! This is something else that not one single person has talked about when referencing Creative Fabrica. If I’m wrong, I’m sure someone will say something but I looked about a month ago & haven’t purchased anything because of that reason.

    First of well done in doing your best to explain this - it’s not easy at all and like you say if anyone has any questions or not sure, they are best to contact Canva directly, although they may simply get an automated response which pretty much just reiterates what’s in the policy….I read through the terms conditions & licensing stuff prior to watching your video so have some idea about it & your right, other creators aren’t touching on this at all in most cases, they just show how to create a design and there you go, ready to upload…excluding one creator on TH-cam thst I follow, she is great and always references to making sure you have licensing authority on the elements you use, but aside from her & yourself, no one else talks about this….it’s pretty much from how I understand you change a graphic / photo enough to a point where it is no longer seen to be the original design & add or incorporate other elements to the design therefore overall that design you have created is seen as being original, then all is fine in the world - there is no way the Canva will be able to claim you have breached any of their licensing terms because multiple elements have been used, those elements have been highly modified and when combined together, the final result is original - Canva do have a video specific to the Licensing side of things on their TH-cam channel and cover this but what they need to do, is actually do a video that drills down and shows what the difference is with just grabbing a graphic or photo & slapping it down in a design and calling it your own vs taking a graphic / photo and modifying it so that it becomes your own design…that visual I think would really help people physically see & clearly illustrate what they are trying to address in writing, within their licensing terms 🤔
    Otherwise like you say, learn to design your own stuff or use other programs such as Inkscape (one I’ll be looking into) this is all fun and games until someone makes the mistake of not understanding the conditions & it all ends in tears and I think people looking to try and make a fast buck or two and go full throttle into digital downloads etc, need to really think about if this is something they want to pursue because if they’re not willing to understand the complexities of it all, then they best stay clear…🤷‍♀️

    I created a collage book in kdp, so basically it is a 60 pages book with multiple elements and images from canva, i wonder if that will be affected as well. This is so confusing. It was sold in paperback, not digital download

    I still don't understand.
    I want to open an online store on Etsy.
    I already have an account in Canva and I paid for Canva Pro.
    If I want to make files like PNG,SVG,JPG do I have to use only free elements?
    If I choose a design that already exists in Canva, but I add other elements and choose to write something next to it, but these are part of the category of Pro elements, does that mean that I broke the rules?
    It's all very hard to understand. I'm very confused.
    From what I understand, you can sell a design created in Canva, but I don’t understand if I can use any element and I don’t understand how much I should modify an already existing design.
    If I use a puppy design, for example, and just add something written next to it, can I sell on Etsy? Or does that mean I broke the rule?

      If you're selling templates none of this applies as far as I understand. However in templates you need to use the Free items as customers who buy your templates that do not have Pro will have those items watermarked.
      If you are creating digital downloads to sell by creating them on Canva you have to transform the graphics in some way. Slapping an image of a dog from Canva and then adding some text next to it is not enough.

    Hi.. I am a pro user. I use my own artwork but they're fonts. If I create an editable template for sale, if the person using it has only free access, will the customer get a watermark showing?

      If you're uploading your own artwork they will not have a watermark

    I still don't understand if I am doing the right thing. I make these teacher digital task cards called Boom Cards. They are created on a website and sold through that website. I make the cards on Canva (and then move them over to the Boom Card website). I use some pro elements in my designs. I am not just using pro elements solely on any one card. My own elements as well as paid clipart from another site are used on them as well. Am I allowed to be doing this? Thanks

    as contributor, if i upload some elements on canva (png/svg/gif), can i upload the same files to another website (redbubble/printful etc)? is canva exclusive?

    Thank you for your videos! They have been so helpful. I am in the beginning stages of starting a business in which I wanted to include digital downloads( daily planners;etc). I initially thought I would use Canva and Etsy but was concerned with the legalities of use. Can you please help me with whom would be a better choice to use? Thank you in advance!

    I just opened an etsy shop and it got permanently suspended. My listing were svg files I created in canva. I checked their house rules and I'm sure I haven't crossed any line. However, this makes me wonder if the shut down was caused by the designs themselves even though I made sure to never use one asset but combine a bunch and alter things a little but by adding text ect...now my question is can the designs be thr reason of the shutdown and what can I do to unsuspended my shop since m not sure what got it suspended in the first place? Could it be just an error? I'm genuinely confused!

      I would find it extremely hard to believe. I just got one of my shops suspended and it was an error. There has been an abundance of this lately. If it's a permanent suspension file an appeal. I'm doing a video on this soon

      I think that may be an error. When I first opened my shop it was suspended, but after contacting Etsy they removed the suspension from my shop.

      Jet templates. Adobe Express is awesome. Design Bundles does not allow templates from Canva from what I understand but I could be wrong.

    Sounds like Canva is ok as a design tool, just don't go near any of their "free" or pro assets

      Depending on what you're trying to achieve it's not back for designing but I prefer programs like Inkscape or Affinity Designer. Kittl is good too if you are in the POD niche and there will be more to come on that.

    Thank you for doing this video. I cringe every time I see someone recommending Canva for creating POD or digital products. I love Canva's system, because it's ease of use, so I'll upload my own graphics to quickly put something together, but using their graphics is a whole other ballgame. I've been a customer of Canva for a long time and have seen them update their TOS multiple times. Their changes are usually reasonable, but as a creator, you can't expect to keep 100% of your rights to use the elements unless you pay for a full POD license with concrete proof you paid for it i.e. not a blanket subscription.

      ok so I was only going to use Canva for creating Mockup Posters and pictures. I get free mockup frames from Pixabay and use my own photos and graphics I create on my personal pc or camera. IF I am understanding what I just read here and the video that will be fine to use Canva for. Although why pay for any membership.

      If you are just using graphics for mockups, not products to sell, you don't have to worry as much. If you're creating images to put on products that people will buy, you need to worry about having the correct commercial license. A Canva membership is good for accessing advanced tools and creating graphics for social media, including video sites like TH-cam. The only thing with using free graphics, like those on Pixabay, is that you are never 100% sure that the person posting them for use is the owner. So, be prepared if someone contacts you in the future and says a mockup frame was used without permission.

    Hey! Do you have an Instagram or something I could contact you on? I am trying to size my digital art with Canva to sell on Etsy but I am having issues as to what sizing options I should offer based on the natural dimensions of my digital art. Most sizes leave a ton of white border surrounding my art but I hate the look of that.
