You are being detained until you answer our questions. Is that clear? Okay, you've got cameras on. You have to use the bathroom? You can use the bathroom.

    To those saying was it really worth all that time! Are you serious? The rights our soldiers die for? You are asking if that's worth waiting that Long just remember that! He was protecting his 4th and 5th amendment! That's the problem with this country sorry but if you don't want to stand up for your rights maybe you should just go to a country with less then maybe you will see why we risk being arrested by that one just willing to do it! Maybe you should think of the bigger picture! We have lost too many good men to just think it's not worth it! People who say that are selfish and in my mind don't deserve to call themselves American! We are American freedom is what we are known for if we allow this to happen what's next?

    Holding him there for 2 hours is a clear violation of the 4th Amendment. Refusal to cooperate, alone, is not justification for further detention. It was an illegal seizure of the person and his property. They know who the guy is. They only reason they're doing this is because he was videotaping them LEGALLY, by the way. The maximum they can make him wait for the k9 is 10 minutes. It was completely unlawful. THey didn't defend anyone from this man. They actually made it more dangerous. See the shooter in SF. They didn't catch him. Now a 32 year old woman is dead because they harass citizens like this.

      He should expect some waiting. If he does not cooperate. I think its highly unrespectful to do stuff like this. They couldnt tell what country he was from and they had to figure it out. I thinks this is just wrong. What is he hiding if he has nothing to hide?

      Miha Gričar They knew what country he was from the moment he spoke. Don't be stupid. This is within 100 miles of the Mexican border, not some English speaking country. If he has to wait at all if they refer him to secondary, then it becomes a seizure WITHOUT ANY REASONABLE CAUSE which is required by Supreme Court decisions. The Border Patrol is out of control. They are not serving the purpose that the agency was created for.
      However, the bigger issue with these checkpoints is that aren't really reasonable, and they aren't solving the problem with the lack of enforcement of immigration law. They are an excuse of the idiots called progressives so they don't have to build a wall because they already sold their souls to oppress as many minorities as they can.

    Your rights don't need "exercising," there is no point in "exercising" those rights unless you are actually using them for something other than wasting your and boarder partoll's time.

      It helps to practice for more realistic situations and also helps reveal the deceptive maneuvering Law Enforcement uses in trapping people with seemingly trivial and unsuspected information gathering strategies.
      It's spelled "Border" and I'm guessing you know that.

      Robert Trudell This would work most anywhere. In the commonwealth where there is the right to silence when detained(arrested) exercise that right (all rights) or the police can claim acquiescence, and you will have no protection.
      On another recording when you went to secondary I gather they smashed the window, as you had consented, and so made contract. By going to secondary you have provided them jurisdiction. Have you read up on Cestui Que Vie(Trust)?

    You're not running out to WalMart. You're crossing an international border. See the difference? You can expect to answer a few questions. Most nations do this.
    They should have torn apart your car 'looking for drugs', said "have a nice day", and let you and your ripped up car through FOR WASTING THEIR TIME.

      There's no Border in the area and yes, I travel through this Checkpoint to get to a Walmart, a Drive-Thru Restaurant or a Movie Theater.
      This Stop is 63 miles north of the U.S. - Mexican Border and it is the 3rd Immigration stop on the same Highway heading north. It's 25 miles north of Ajo and 18 miles south of Gila Bend, Arizona.
      The U.S. Supreme Court banned suspicionless Drug Checkpoints. The dog smelled for concealed people.
      I plan on hiding in the vehicle while my Nephew drives me through an Interior Checkpoint like this and walk back through after transitioning if I go undiscovered.

      Most Agents will quickly wave me through while doing the same thing.
      This Agent decided to ignore reality. He had no reason to suspect I was in the Country illegally and confirmed his familiarity with my car to another Agent early on.

    I dont blame you one bit for not saying a word. The problem I have is WITH THE SHEPHERD SNIFFING YOUR CAR. If this is a BORDER CHECKPOINT to identify US citizens, what in the world are they doing searching your vehicle for drugs or illegal fruit? That was an unlawful, non-consensual search of your vehicle without ANY suspicion or probable cause to suggest you were either committing or were about to commit a crime involving anything a dog can sniff out. Once again, these checkpoints prove beyond any doubt that they have nothing to do with identifying US citizens and are about performing pre-crime enforcement ala Minority Report. Just do encompassing sweeps of everyone and hope you find one criminal out of 10,000, while inconveniencing and trampling on everyone's rights.
    I applaud you for wasting their time because they are wasting our taxpayer's dollars. You tied up all kinds of resources which meant they had less manpower to pull these ridiculous stunts on other cars passing through. That dog sniffing your car is just so out of bounds from where Im sitting (in Ohio - not sure on laws in your state) that it makes me want to hit every one of those border patrol officers over the head with a 150lb US Constitution written on tree stumps. That was just a fallback move. "We can't determine citizenship, so lets see if he's trafficking weed with 15 GoPros on his car." As if drug runners film themselves doing business.

      the first mistake was that he should have informed them that he was going to exercise his right to remain silent. second, they asked (not ordered) him to pull over and he complied. once he informed them of his silence; they would have most likely let him go. it seems he had a lot of time to kill.

    Man I have alot of respect for you for defending the costitution. Unfortunately I couldn't do the same today when they violated my rights today at a Texas checkpoint. These guys frisked me more than once and treated me like a criminal. Their dog scratched my brand new car; I was very pissed off when I left the checkpoint.

    What I find funny about all the people who complain about what you did, they don't see the irony in all of this. "These checkpoints are for your protection" "All you had to do was say yes I am a U.S. citizen". How can it be for safety when all you have to do is say you are a U.S. citizen. How can they let you drive through by you only saying yes I am a U.S. citizen.
    It is ridiculous. All you have to do is say one word to drive through, how is that actually stopping people from getting in illegally, not to mention it just shows the power trip they are on. "If you answer yes, you can go. If you refuse to answer we will throw a fit and make you sit for 2 hours because we have to feed our egos and pretend we are doing the U.S. a service".

    Just in case you want to jump to conclusions, just remember this was an experiment by someone who is happy to invest his time into documenting real life situations at check points, thus the reason he went through with the entire scenario. You can't conduct a specific experiment without going through the process, regardless of the time it takes and the appearance it may give.
    I used to think this guy was an idiot, but once I started to understand what he was doing and why, I began to appreciate that there are documented accounts of this shady area of rights and freedom which come into question when you blur the lines with the use of check points.
    The truth is if you want to screen all the people that just happen to be living close to a border, then you also have to admit that you do NOT live in a free country. Otherwise, you must, by the rights granted to you and the freedom that you celebrate, be able to travel unimpeded by check stations if you choose not to cooperate with the intended goals of the check stations. It may sound selfish on those people's parts, but you simply can't have your cake and eat it to. You either submit to the sacrificing of your rights and freedoms, which is what the Government prefers you to do and thus make it as painful as possible if you refuse to cooperate, or you embrace the freedoms that have been granted upon you to the detriment of the goals pursued by these check stations.
    Freedom or accountability, your choice. You can't have both. One will cancel out the other.

    You know you technically have to state that you are invoking your 5th amendment right to remain silent; otherwise it can be construed as obstruction or resisting. Under the law silence is consent not protest. Just say it and keep saying it, they will eventually let you go. Probably in just a few minutes and not hours. The supervisors know they have no real authority other than what you give them. So, don't give them any authority over you.

    to the guy that made this video and was sitting at the border patrol for like 5 hours,was it really worth it to stay there for half of a day for refusing to answer them or would it have been better for you if you answered a stupid question and went on about your day...Just curious.I am in agreement with you 100% for standing up for our rights,but for some stupid border patrols,it's not worth the hassle seeing is how you had to stay there for 5 hours..peace out...

    i drove right through this check point and i didn't even stop for the agent he kept trying to wave me down, i had to use the boys room and i don't like enclose small spaces like the porter potty so i drove to a public restroom amazingly they did't chase me...

      Lying to Agents is a crime and its easy to do accidentally anytime a person opens their mouth or through misinterpretation. When anything you say can an will be used against you it's obviously biased law enforcement.

    the Supreme Court just ruled a month ago that you do not have to answer a single question (per 5th amendment). In previous cases they also ruled that an immigration checkpoint may not force a citizen to pull off the road unless the officer has probable cause (evidence of a crime). In this case no probable cause exists.

      mensa517 your obviously not a part of mensa nor have you ever been, the people there don't start off an intelligent argument with profanity and insults, it shows your ignorance, and removes all credibility to your argument SKOAL I understand your argument, and for the most part I agree with you, however if you haven't been in the position of law enforcement i would expect you to understand the difficulty of being responsible to 300,000,000 americans expecting that you will keep them safe... and having to do this with only a 15 second talk with the driver... the officer asked a simple question, if he had at the very least said "I am exercising my 5th amendment right" he would have at least looked or seemed a little less suspicious, but refusing to say anything at all definitely triggers suspicion alarms and the officer has every right to follow his gut when facing suspicious activity, people who dont understand their own rights or understand how or when to use them is exactly the type of people who make an already difficult job harder, if you think you know what everything is about I challenge you to take the officers job and show us all how its done.

    First time I went to the states I almost got detained at the airport upon boarding the plane back home (after 2 security checks) just because I went to the 2nd row where Officers were checking the boarding passes and passports. It was a misunderstanding on my end, I did not see the Office was actually telling the other person behind me to switch to the other row.

    I don't understand the point of these checkpoints. They ask if you are a US citizen, you say "Yes", and they allow you to leave. I feel so much more secure now, knowing that people don't lie.

      This is the 3rd Immigration Inspection and Stop of all traffic heading north on this same highway.

      +Robert Trudell Yea, what was the outcome? And if I'm not mistaken, I saw Border Patrol agents smashing your window and arresting you. That caught my attention because (a) DPS was present and would be the more proper entity to do such a thing (if it were legal and probable cause present of course), (b) BP had no reason probable cause to attack you since you posed no threat and their MAIN JOB AT THE SECONDAY CHECKPOINT was still to determine your citizenship status and with reasonable PC to search for illegal drugs and/or people hiding in your car. Nevertheless, because you had chosen to obey the order of Border Patrol agents to move to their secondary checkpoint, you had given them probable cause (a flimsy one, I admit) to conduct an investigation that could get pretty intrusive since you essentially gave them the small hole of "we don't know if he's an American citizen or not" and the slide down the slippery slope begins, touching on things like "well, if there's a chance he's not a citizen, then he's probably here illegally, which makes him a criminal AND a criminal loves to commit crimes...like fraud, forgery ( let's look through his wallet and other documents in the car), drug smuggling, human trafficking, bombs, and money laundering (let's tear up the car/search his body thoroughly, especially if he could be a terrorist). When you get upset and protest, they could claim you have something to hide, if not on you or in the car, that they need to investigate further so they might want to lock you up longer and check into your travel, financial records, phone/computer data, people you know or communicate/associate with, your political and religious views and practices, etc.
      I believe most states have relaxed or even ignored the outdated wiretapping statutes, with most considering that it only takes one party to consent/have knowledge of it taking place. Clearly it's not illegal when recording in public areas, involving public officials performing their taxpayer funded duties, and with equipment that are openly visible for people around to see/realize that there is video and audio recording. Interestingly enough, law enforcement was using the outdated wiretapping laws to lock people up when video cameras became readily available and people began taping abusive conduct by bad cops (see Rodney King, 1992). After camera phones became common, and used frequently to record dirty cops for abuses and as evidence to expose outright lies by cops and their thin blue line, the law enforcement community fought tooth and nail for a few years to prevent laws and court decisions that would reject the wiretapping laws as a legal wall preventing the people from recording law enforcement performing their duties which have significant impact on the rights, freedom, safety, and even lives of civilian citizens when interacting with heavily armed law enforcement officials. TH-cam and news reports of police corruption and brutality explain why they fought so hard to prevent this right to citizens. Even after the law changed, except in Illinois, Maryland, and Massachusetts, enforcement officials are still caught lying about the to intimidate and stop people from recording.

      When it comes to our precious 1st, 4th, and 5th amendment liberties there can be no compromise. It's bad enough that the ignorant and cowardly won't stand up for the constitution. It's even worse when they trash brave individuals who are willing to risk inconvenience and even bodily harm to defend the constitution. God bless the modern-day patriots.
