    On 31 May 2013 without Probable Cause or a Warrant, Agent B. Blanchard broke into Robert Trudell's sealed driver's door window. A plain clothed Agent along with Agent A. Magana searched the Trunk which Agent Blanchard pushed to close while asking if they had a Warrant. Agent Magana confirmed no Warrant or Probable Cause existed saying they were conducting a Weapons Search. Police Officer D. Miesen photographed an "ein Berliner 9" documentary movie prop badge from the trunk to submit to the Terrorism Liaison Unit. Agent A. Corpuz searched the passenger compartment and glovebox where U.S. Customs & Border Protection removed a powered down GM Business Phone assigned to Robert Trudell. Asset Forfeiture Office Paralegal, Jim Elam, refused requests to return General Motor's property which interfered with business communications. Agent B. Blanchard failed to clearly provide Orders to Robert Trudell and his subordinates resulting in an Illegal Search & Seizure by him and those in his command.
    U.S. Customs and Border Protection along with the Terrorism Liaison Unit conspired to Willfully violate Robert Trudell's Copyrights to further the Identity of contracted partners including the Astroturfing CBP Agent Michael Flanders, CopBlock.org's Pete Eyre and CheckpointUSA.org's Terry Bressi. Their efforts create a false front encouraging criminal behavior and trapping those they lure into their net, manufacturing characters the public loathes and spreading widespread fear and myths to manipulate public behavior. Agent Flanders and Terry Bressi both directed Trudell to an Intern Lawyer, Mitra Ebadolahi with the ACLU while he remained under CBP arrest. Mitra Ebadolahi passed fake Whistleblowing Agent information onto Trudell furthering Flanders' false identity.
    Seizure of his Property without a Warrant or Probable Cause left him fearful Agents would Seize his Property again while retrieving the originally Seized Equipment.

    I think I've made myself misunderstood.
    The "Get out of the Vehicle." came 1/2 hour after this event began after I was waved into the Secondary Inspection Area and after the window was broken.
    The "Let me see your hands." came after the bang, bang, bang on my window while I was reaching for another goPro mount behind the passenger's seat.
    The group was congregated in an area that wasn't being filmed, so I was trying to set up a camera in that direction.

    It is an Internal Border Patrol Inspection Station. The Federal Agents are allowed to stop people and make a quick determination if they think people are in the country illegally.
    I was practicing my Right to Remain Silent along with not Consenting to a Search.
    I didn't break any laws or hurt anyone.
    There are no charges against me that I know of.

      @@michaelchamp3093 I purchased the window 2 months earlier and had full glass coverage which paid the $75 for Safelite's install.
      Insurance would have covered the glass cost as well but I tried getting U.S. Border Patrol to pay it's $127 cost which they denied fault.
      Instead I received an implied job offer.

    I was detained 10 hours, handcuffed for 6. After 8 hours I was read a charge dealing with not complying with an Order. I haven't seen any charges in writing.
    All I had was confiscated and I was set in foot in El Cajon, California at 10:30 that evening.
    I found my impounded car the following Sunday and my computers, cameras and phone was held for 21 days while they tried to get a Search Warrant.
    The ACLU contacted me and are providing legal assistance in this incident.

      The ACLU Lawyer said there were murmurs from many Agents talking with her that they'd make me an offer and to run it by her before taking it.
      I had one guy call me over to the American Citizens Social Club, tell me he was U.S. Border Patrol's former Commander at the Lukeville Port of Entry and Chief of the Boston Police. He asked if I had any cameras on me or in the bar, then patted me down. He suggested I could earn $200,000 per year working with law enforcement along with having any type of woman and cuisine each night of the week, then he followed by asking what types of food I liked and women. He called one woman over and squeezed her tits and say's "See", like it's that easy.
      He asked if I had any questions and I asked about the ACLU Lawyer working with the DHS & Terrorism Liaison Office and he advised I didn't bring that up.
      Later when I got home, Morgan Spurlock's producer contacted me and interviewed me for the Warrior Poet's project.
      My Best Man, former coworker an current manager of the GM Innovation Center in Chandler, Arizona, then called and said U.S. Border Patrol flew him over this area in their helicopter. He drove down to Ajo and tried meeting with me earlier and said I could work at the Innovation Center doing what I liked earning $100,000 per year.
      I decided to stick with the current GM retirement plan I have that forbids working for money and hoped to get reimbursed for actual financial losses that Border Patrol originally said they'd pay.
      I spent 6 months on the phone and didn't find a single lawyer willing to take the case for the Federally mandated 10% of winnings and when I went to file in Federal Court on my own on the deadline date, I was thrown in an insane asylum for 72 hours of observation as the time expired.

    After 8 hours in detention I was read a Charge of not complying with and Order.
    I'm not sure what the order was, but I'd guess it had something to do with no rolling the window down.
    I was never given anything in writing and when they released my cameras, computers and GM Business phone 21 days later, the Border Patrol Paralegal said there were no charges.

    Surprisingly Geico offered to pay for both window and install. I bought a window 1 1/2 month prior so I wouldn't have to wait for it's delivery if I broke the window open for them first.
    I'd offered on a previous trip.
    So my full glass coverage did cover the window break, but I let them use my previously paid for window to avoid driving around without.

    The first thing I would sue for is 1st Amendment Rights violation. They confiscated all my camera equipment that I planned on using for filming.
    They delayed the timeliness of this news. They reduced the value of it at the same time.
    I was given a SF95 Tort Claim Form by them to file for damages.

      @@freedomunderattack1704 I filed the Tort Claim that Plain Clothed Agents placed in the bag of Asset Forfeiture Receipts and shoelaces when they dropped me off at the El Cajon Bus Station.

      I contacted 20 Federal Lawyers and none were interest in taking the case for the Federally limited 10% of winnings they'd earn.

    My position is I'm a Photojounalist.
    My equipment and media was confiscated for 21 days for no reason.
    It prevented me from covering several events as well as showing this 1 in a timely fashion.

    I agree, the only right you really have are the ones where you draw a line and say, "if you cross that line I will kill you or die trying."
    That said, hitting them in the wallet with a big law suit can get tremendous results. In my city they were forced to change a couple of ordinances because of litigation I was involved in with them.

    DHS said the fifth amendment does not apply to them and detained us for over five hours before setting us free, while intimidating us with guns and dogs. Why do we US citizens have to go through this traveling down the road? Further they need more lessons in communication in English language, as they kept screaming and threatening us... our family is very happy to make it out of there without injuries..

    They gave me a SF95 Tort Claim Form and instructions on how to fill it out in the bag with my shoelaces, ID and Credit Cards when I was set on foot in El Cajon 10 hours after the incident.
    I took a Taxi 93 miles to the Event I was trying to get to.

      They did falsify the police report repeatedly claiming they directed the vehicle to Secondary when they did the opposite by placing a Spike Strip in front of the tire and ordered the vehicle remain where it was.

    Yes it was.
    I got to a point when I was chained to a bench and it hurt if let my arms down and I was to tired to hold them up.
    They came into the interrogation that I was chained in and offered to uncuff me if I signed an Asset Forfeiture Receipt for my cameras, computers and phone. I couldn't read what they were asking me to sign because they took my reading glasses away. I just shrugged my shoulders (since I was remaining silent) and they left me in the handcuffs.

      I didn't obstruct traffic. The Agent placed a Stop Stick in front of my tire and told me not to move. As soon as he removed it and I was told to go to Secondary, I did.
      I exited the vehicle the moment I was ordered to.

    Traffic stops and checkpoint stops are initially considered non-custodial detentions. If however the initial detention is significantly extended, you are handcuffed or you are removed from the place where you were initially stopped then the non-custodial detention becomes a custodial detention which is just another name for an arrest.
    In this case, you were most definitely arrested and since they didn't charged you with a crime, they clearly had no reasonable basis for arresting you.

    Robert Trudell, I salute you. I have to deal with these kinds of checkpoints on a weekly basis and even though they have only pulled me over a couple times it pisses me off that they are even allowed to be there. My dad is a lawyer in Arizona and he won't tolerate their shit either.

    I was detained, fingerprinted, photographed and background checked. They kept me in handcuffs for nearly 6 of the total 10 hrs held.
    After 8 hours I was read my Miranda Warning and a Charge dealing with not complying with and Order.
    2 plain cloths Agents dropped me off on foot in El Cajon, California. They placed Asset Forfeiture receipts in my brown paper bag with shoelaces, ID and credit cards along with a SF95 Tort Claim Form.
    I was encouraged to file for damages with it.

    Internalal refers to the fact they are inside the US. Go look it up on Google. Border Patrol has been authorized to maintain checkpoints within 100 miles of the actual border for the purpose of conducting "immigration inspections".
    He mentions being released in El Cajon, but hasn't pinpointed exactly where the checkpoint location was.

    I couldn't agree more. I do not believe for a second that a single one of those trained goons actually thought that this person had any sort of illegal contraband on him or in the vehicle. They wanted him the "respect my authoritiee" like Eric Cartman in South Park.

    I haven't submitted the SF-95 Tort Claim Form yet.
    Geico offered to pay for it, but I used a window I ordered 2 months earlier so I wouldn't have to wait so long. The install was covered.
    The Agent damaged a $2000 camera lens in the same motion as breaking the window and other charges like the $666.83 tow and impound fee, 93 mile Taxi ride, hotels, gas, 6 replacement goPro cameras and memory cards, lack of event film coverage income, financial damages diminish the $125 window cost.

    The US Border Patrol Paralegal Officer said there were no Charges when he said I could come pick up my Forfeited Assets after 21 days detainment.
    They tried to get a Search Warrant to view the videos. It appeared they were in the same sealed bags from the Pine Valley Checkpoint Station.

    I remained silent and wouldn't consent to a sniff search by leaving my windows up.
    A dog was called out and detected nothing on my vehicle, but did on a car a few vehicles back.
    A Sheriff was called and asked to talk with me. I didn't and he left.
    I was sent to this Secondary inspection area and then they broke in, did a warrantless search, found nothing, detained me 10 hours, handcuffed for 6 hours and then seized all I had and set me on foot.
    I know of no charges against me.

    The diamond tip of the Agent's spring loaded Automatic Center Punch pitted the lens in the same stroke when the windows was smashed.
    The strike causes the camera to hit me in the nose.

    I don't know why they broke the window. I'm speculating when I looked behind the seat for a camera mount, they saw that as an opportunity to do a weapons search of the vehicle.
    I went to the Secondary because they directed me there. I'd been hoping to go there for months.
    The vehicle was towed, impounded and hidden from me for 3 days. I got it back after paying a $666 fee.
    Nutty.

    I'm not an expert on the language they use but I see a difference between, "Would you step out of the vehicle?" and "Get out of the Vehicle." with the 1st being a request and the 2nd being an Order.

      The safety glasses are also bifocal so he can read the instrument cluster.

    This guy may have a case. I wasn't there and his "raw" video was 12 minutes of him taking photos after he had stopped. Had no audible conversation of him and the border patrol, so we still don't have full context of what happened. And, what is illegal? Checkpoints? The point of checkpoints is to verify someone has a right to enter the country legally; this may entail answering questions and showing ID. Same as getting on a commercial airline. As to "where does it stop"? The courts.

    You have to show ID at immigration checkpoints even if they are 100 miles from the border. They will only stop you for a few seconds. when you aproach an immgration checkpoint, take out your ID, roll down your window and show your ID, when asked "are you an American Citizen?" say "yes". Your stop will be less than a minute. It's part of national securty. They are there to protect all Americans.

    I don't know what order they talked about and was never given anything in writing. I thing he just said that for purposes of the 10 second interview.
    I didn't respond and the interview ended. I was brought back to my personal cell in the permanent detention facility.
    The only thing I said was "Hmm?" when the Agent told me to "Get out of the Vehicle." to understand his order.

    The Interrogator read some charge dealing with not complying with an order. I'm not exactly sure what he said and never received anything in writing other than Asset Forfeiture Receipts for everything I had.
    The ACLU is providing advice, guidance and assistance regarding this incident.

    I don't think so. They held my stuff for 21 days. The Property guy said he was waiting for them to file some Charges and to try to get a Search Warrant to look at my Videos (They had my Laptop, Phone and iPod also till today.)

      The ACLU suggested they'd make an out of court offer and the former Lukeville Port of Entry Commander had my girlfriend call me over to the American Citizens Social Club one night.
      He patted me down for cameras and asked if I had placed any in the bar.
      He began asking what type of women and cuisine I liked and mentioned I could have any of those favorites each night of the week along with $200,000 per year to work with law enforcement.
      For his demonstration he calls one lady over and squeezes her tits, sends her away and proclaims, "see".
      Asking if I had any questions, I asked about the ACLU lawyer that the Terrorism Liaison Office directed me to and he recommended I not mention that.
      That same evening CBP flew my Best Man over the house in their helicopter and he called to offer me a job working at the GM Innovation Center in Chandler, doing what I'd like and earning $100,000 per year .
      Matt Testa also called that evening to interview me for a Warrior Poets Project movie he was producing with Matt Spurlock.
      A spare window was purchased 2 months ahead of time in hopes CBP would smash it open or let me smash it open for them. I never asked them to pay for it.
      I did ask them to pay for lost income from seizing General Motors business phone that was assigned to me and sitting powered down in the glovebox.

    I commend you on your willingness and ability to hold a logical conversation reguarding your stance instead or resorting to childish behavior like so many when thier position or view is challanged.
    Since you didn't say anything at all I would think that would be the essance of Salinas V Texas where SCOTUS ruled that mearly not speaking was Not in fact invoking your right to remain silent.

      I've got an SF-95 PDF version on my computer pulled up for the last few days. I filled in my name, address and birthday. I went looking for the version they gave me to get the correct address and got distracted.
      I plan to write a narrative explaining the reasoning for my claims and copy my assembled receipts.

      +Jay Karki The CBP offered to pay my actual damages and then reneged when I sent them the bill.
      I think they wanted a deal where I didn't reveal the ACLU Lawyer, Mitra, that the Terrorism Liaison Office's fake Whistleblowing Agent Michael Flanders and law enforcement's Astroturfing CheckpointUSA.org's Terry Bressi directed me to for further interrogation and manipulation.
      Two years later I received a suggestion I could work with law enforcement making videos for them earning $200,000 per year with the recommendation I keep quiet about Mitra. Sounded like a bribe to shut up.

    About 30 minutes in Primary. They walked over to Secondary and I was there for only a minute or 2 for the full gang to arrive.

      Fine. U.S. Border Patrol's seizure of my GM Business Phone at this stop initiated my GM Total and Permanent Disability Retirement which leaves me with 60% pay till I reach Social Security age.
      Law Enforcement suggested I could work with them earning $200,000 per year and the manager from the GM Innovation Center offered a position in Chandler for $100,000 a year too. I stuck with a $42,000 Retirement sure thing.
      This happened 5 years ago.

    We communicated with hand gestures.
    I indicated I'd like to drive down the I-8 to the Agent and the Sheriff
    I also followed orders like showing my hands and acknowledging their direction to Secondary
    I did not crack the window as part of not consenting to a sniff search. It's better to roll the window all the way down over cracking it. Cracking the window concentrates the fumes they smell with their noses, electronic devices and dogs.
    I remained silent so I wouldn't reveal an accent.

    I'm not certain. I was detained for 10 hours and in handcuffs for 6.
    After about 8 hours the Interrogator read me my Miranda Warning and a charge having to do with not complying with an Order
    It might have been under arrest then. I don't think there are any charges against me and I've never seen any charges in writing.
    My car was towed, impounded and I didn't find it till the following Sunday.
    I ended up taking a Taxi 100 miles to the Ping Pong Tournament I wanted to film and play in

    I heard him say "Get out of the vehicle" after he broke the window. I confirmed what he said with a "Hmm?, and I got out of the vehicle.

    One hour after 2 plain cloths Agents came by and said "We're getting you out of here."
    They dropped me off on foot in El Cajon, California with a bag containing my shoelaces, ID, credit cards and Asset Forfeiture Receipts for my Cameras, Computers, Car & Phone along with a SF95 Tort Claim Form to file for damages.

      I learned these Agents falsified the Police Report and the ACLU cooperated with the Terrorism Liaison Office, DHS and CBP in a Terrorism case launched by a police officer that discovered a movie prop badge in the trunk at this stop.

    I think the only thing I heard an Agent say before "Get out the Vehicle." was "Let me see your hands." and "Both hands." where I followed by showing him my hands and keeping them in plain sight.

    I was hoping the window would be broken open. I bought a spare ahead of time.
    Afterward everything I had was confiscated other than ID and Credit Cards. They held my Computers, Cameras, Phone for 21 days with no sight of when I'd get it back.
    I was handcuffed for 6 hours of my 9 hours in Detention. I wasn't offered a toilet for most of that time.
    I was set on the streets of El Cajon at 10:30pm on foot 200 miles from home and 100 miles from my destination.
    I was denied covering events.

    It wasn't Unconstitutional until they did a suspicionless, warrantless Search and Seizure, then tortured me in handcuffs for 6 hours without reason and violated my 1st Amendment Rights by holding my cameras and media for 21 days.
    They violated the 1st, 4th and 8th Amendments to the U.S. Constitution.
    Today, I heard the Government Bailout to GM cost came down from $50 Billion to $10 Billion. It wasn't a loan I wanted or requested.

I will put this in, as a thought: After the Nazi American broke your window, and you placed your camera into the passenger side front seat, it could have easily be construed as reaching for something. I am not your "armchair quarterback" and I do similar videos. This is just one Patriot to another, watch that reaching. You are the front line, man. This was just a tactical analysis, and nothing more.
