      Not really well it is in our opinion, but the Supreme Court does allow it, but the Supreme Court also said that citizens have a fifth amendment right not to answer any questions either so basically it’s pointless to have an immigration checkpoint if you don’t have to answer questions. If people stand up to this than it will go away, but people don’t and that’s why it continues

      Cher65p4 K ok but that doesn’t answer my question. How is it legal? In Paul v. Virginia, the Supreme Court found that, “right of free ingress into other States, and egress from them” is a liberty.
      Having done more research I have found that,
      “Regardless of the constitutionality of laws passed post-9/11 with respect to freedom of movement being a privilege, all U.S. citizens have the right to travel or move within and between the 50 states without the requirement of submitting to a search of one's person or property prior to travel or movement.”
      So how are these searches legal?

      @@TheMrdesertman24 BP will quote United States v. Martinez-Fuerte, 428 U.S. 543 (1976) as their right to stop people, but the decision does NOT include any obligation to answer questions, but that is covered by 5th amendment.

      What I would like to know is why would people like to give the border patrol a hard time, instead of simply just acknowledge that you are a U.S. citizen. If you tell them that you don't answer questions, you're just making yourself look guilty of having done something wrong. I never felt inconvenienced or felt that my rights were being violated when I had my truck and trailer searched or X-rayed, because I knew that they were doing their job.

    I grew up in the Middle East and this reminds me of checkpoints we had there. But the officers were very rude and you could get beaten up for not talking.

      They have tortured me by keeping me handcuffed for most of 10 hours, stolen my car and forced me to walk 30 miles on arthritic knees, and sabotaged my career so I'm no longer allowed to work for money -- costing me $1,000,000 in financial losses.
      Beaten up? Sounds easier.
      My Polish Refugee friend, they held in a windowless jail cell for 2 years longer than the Supreme Court allows. The funny thing is when they finally let him out we spent 1/2 hour at this same Checkpoint listening to an Agent argue the reasons why they refuse to accept a valid Arizona Drivers License and Social Security Card as an indication of a person's Right to remain in the U.S. U.S. Border Patrol nearly made him late for his first monthly check in appointment with Immigration.

      U.S. Border Patrol told my Polish friend they don't accept ID at this Checkpoint. Valid Arizona Drivers Licenses and Social Security Cards ruled invalid by the Immigration Enforcers.

    THE TRUST IS COLLAPSED....in other words, your company is no longer granting them any more credit.
    If a policeman is not lawfully investigating the crime on behalf of the male/female victim and is entering YOUR company jurisdiction without you summonsing them, then would it not be advisable to be politely placing YOUR public-servants/trustees under your notification that your company is charging $707 per hour/part-there-of for YOUR company time and also $717 for YOUR company performance?....and that any further communicating (verbal) and/ or corresponding (written) with your company, is with them accepting the terms & conditions of the commercial contract IN THE PRIVATE (the cop and their CHIEF and their POLICE UNION is now with PERSONAL liability.... because Notice-to-Agent-is-Notice-to-Principal....and also through JOINDER)

      They're introducing an Arizona Travel ID: azdot.gov/motor-vehicles/driver-services/arizona-travel-id
      International Passports often indicate citizenship and Tribal ID Cards.
      Gloria's tribe lives in both the U.S. and Mexico and members of her Nation are allowed to cross the Border at non-Ports of Entry.

      Here I spent 30 minutes listening to a Border Patrol Agent and my Polish Refugee friend argue about why DHS refuses to accept a valid Arizona Drivers License and Social Security Card while he nearly made us late for the Refugee's first monthly Immigration Check-In appointment in Phoenix after holding him in a windowless jail cell for 2 years longer than the law allows.
      That's why I found this Agents request to see Gloria's ID, hilarious.

    Agents here can only detain for 'brief questioning of the vehicle's occupants" and "any further detention or search must be based on [the greater showing of] consent or probable cause." Once a driver indicates that he will not answer questions or consent to extend the detention or a search, then the only real option available to the agents is to quickly check for evidence of crime, such as contraband in plain view, and let him go if no evidence of crime is found.       At least the Agent that refused to accept my Polish Refugee friend's valid Arizona Drivers License and Social Security Card from 1983 had enough sense to direct the vehicle to the Secondary Inspection Area before arguing with him about it for 1/2 hour and nearly making him late for his first monthly Immigration Check-in after holding him in a windowless jail for 2 1/2 years longer than the U.S. Supreme Court allows. Thankfully for that.
      That's what the Secondary Inspection Area is for -- to get he car out of the way of traffic. There are about 4 or 5 stalls available and this Agent chose to use none of them.

    That scotus Fuentes decision, which is usually the one they cite as the justification for these highway dragnets, only authorizes "brief" stops solely for the purpose of determining citizenship, with no searches of people or vehicles authorized. That is explicitly stated in the decision. In issuing that decision the scotus nullified the plain English common sense wording in the bill of rights in allowing any kind of stop and questioning without reason to believe anyone has committed a crime. The court did NOT allow these random kinds of searches for other crimes and the decision mandated the stop must be "brief". That dog is searching for what, illegal immigrants? These questions they commonly ask about guns (2nd amdt) and where you're going, where you were born (many BP asking these questions were not born here and know of illegal immigrant relatives living in the united states). All of this is strictly prohibited in the scotus decision they cite to justify these stops and searches.

      CBP claims the dog searches for live hidden humans. Maybe they'll arrest the people trapped in the collapsed Florida Condo for hiding if their dog finds someone. Often the line of questioning includes verifying the number of passengers and lying about it during an investigation is a crime.
      None on the questions need to be answered though legal immigrants generally agree to provide proof of their current Right to remain in the U.S. when asked by official Federal Agents as part of staying.
      The lawyer arguing against these Stops in the Martienz-Fuerte case stipulated almost anything CBP brings up in questioning could be pertinent in establishing Citizenship.

      @@yuma310 those are amazing dogs to be able to determine if someone is here legally or not by smelling them from outside a car. if i was a skeptic i might suspect they are using the stop as an excuse to search for other crimes they can charge for, which the scotus ruling explicitly disallows these stops to be used for. at some point, the court in fuentes had to acknowledge that fishing expeditions are why we have the right against unreasonable searches. many people have the attitude that they have nothing to hide and therefore have no problem being searched for anything anytime, but just about everyone can be charged with something these days without knowing they did anything wrong. knowing that i have done nothing wrong, the fact that someone wants to search me makes me suspect their motives. many cops over the years have been caught planting evidence. there are many examples of it here on youtube. only someone with disregard for me and my rights would search me without probable cause. i have had many licenses that required background checks, jobs requiring random urinalysis, and there is no reason for some random LEO to search me justified by public safety than for me to randomly subject them to proctology exams in the name of public health. my search would be more justifiable, statistically.

      If Elon Musk drives through the Checkpoint with a Russian Nuclear Missile, the U.S. Supreme Court isn't forcing them to look the other way, just because it's an Inland Immigration Checkpoint.
      I agree the primary mission of these stops deviates widely from it's limited authorized scope.

      @@yuma310 i would be interested to see the data on how many russian nuclear missiles they intercept in these inland immigration checkpoints, or just the data on how many illegal immigrants they arrest, relative to the number of people they stop and question without reason to believe they have done anything wrong. would they catch illegals at a lower rate by questioning everyone in the local churches on sunday before they are allowed to leave, or everyone laying out at the beach, or questioning college or elementary students? i would bet it would be 1000x more efficient looking for illegals who are enrolled in schools and receiving non-emergency care in hospitals, or just by making e-verify mandatory for all employers. according to these scotus decisions and federal policies, the very people who wrote and ratified the constitution and 4th amdt, etc, intended for the federal government to be able to nullify it and search all of them without probable cause every day. i doubt that.

    People need to know, you do not have to show your driver license to border patrol. They are not P.O.S.T. certified officers. The A.R.S. spells out exactly who you do, and do not have to give your i.d. to.

      He didn't ask for ID. Many Foreigners agree to provide Proof of their Right to Remain in the Country as condition of their entry, no one else does. ID doesn't demonstrate what the Agent is looking for.

You are wasting your time, the officer’s time and the 10 or so drivers behind you have their time wasted too when you do stupid stuff like this. Your rights are given once you declare you are a u.s. citizen. How would they know otherwise? This is foolishness

    They just allowed a Mexican who looks white to cross into our country illegally. Gloria taught her son well. All he had to do was show the “I do not consent to search sign” now all of her family members in Mexico can do the same. All they need is a drivers license. Thanks for showing us the way in guys!!!! Viva Mexico. I’m bringing in my Uncle Nacho the Narco in as well. Much as gracias

      @@harveywallbanger1738 I can get my family across the border, they all have a "limited visa" to shop in San Ysidro. That's where they get picked up for the rest of the trip into this beautiful country. We used to worry about the checkpoint after the border. That was our only worry. Not no more!       You Tontos are fighting against your own interests here. But only a few gringos can grasp this fact. They are too busy trying to fight for their rights. They overlook the entire purpose of the thing. Everyone needs to cooperate at these checkpoints to make it clear that they are not illegal. Exercise your rights as an American Citizen by claiming them. This is not rocket science
