    If You implement his ideas then all countries refugees come to India. But there are no single Muslim country who ready to take these refugees to their country. I am surprised that Gaza people are living in horrible environment without food. But Egypt refused to take Gaza people to their countries.

    If partition was on the basis of religion, all the subsiquent policies regarding partion should be on the basis of religion. Secondly, if we are talking about minorities in Pakistan, and should not associate religion with it, then why is minority status associated with religion in India.

    The first wave of hindus and sikhs coming from west pakistan were "displaced" because they were living in west pakistan and modern day islamabad. The muslims who came back from west pakistan in the second wave were evacuee's because they chose to leave india(a new democracy) and move to a muslim majority west pakistan and then return back to india because it was not to there liking. Its a shame he cant tell the difference between these 2 groups of people and why constitutionally required 2 separate terms, because 1 group didnt have a choice while the other one did. Also the displaced properties of Hindus in west pakistan was given to muslims arriving and the displaced properties of muslims in india were handed out to WAQF board, along with other superior rights which exists to this date. The same WAQF board which claimed a 2000year old Hindu temple to be muslim land when islam itself is 1300 years old. This man clearly forgot the partition was on the basis of religion... so if religion was the core reason of the problem, then why cant religion be part of the solution?

    What Nonsense.... He is looking at partition migrations through the lens of Constitution and laws. Being invaded for so long was wrong. Then the whole idea of splitting a land at the hands of invaders on the basis of religion was flawed. All the Communal violence that happened bcoz of partition was unconstitutional and flawed and a dark chapter in our history. So how can he expect complete constitutional fairness when it came to migrations....
    Im a Sikh. We migrated from Rawalpindi to Jammu, and now working in Bangalore. Our Properties in Rawalpindi were immediately given to Muslims and were considered Enemy Properties. At least India gave it a better term called 'Evacuee Property'...
    Secondly, Muslims partitioned India, and then They happily migrated to Pakistan, and then some of them realized in 1948 that India was better and decided to go back?? What Nonsense. Then why was Pakistan formed. Why did an overwhelming majority of them support this partition movement?? Ideally none should have been accepted back after the chaos they supported...
    CAA is for those non-Muslims who were stopped from entering India during partition owing to permit system and Nehru-Liaqat Pact. It simply fast tracts their citizenship process. Still if a Muslim wishes to come here, he/she can come under the old existing process which takes slightly longer. There are over 100k Afghani/Rohingya/North African Muslims living in Delhi NCR alone. Many have Indian Citizenship
    Muslims like Owaisi's family who supported Pakistan were not only given equal a chance to stay in India but also equal rights in India and a also chance to enter Indian politics...
    The fact that India gives equal rights to Muslims and Hindus despite being 80% Hindu is something to be appreciated. In Pak and Bangladesh, they are 2nd class citizens in terms of rights and priviliges

      He actually articulated it really well. Expecting a person to tell the positives of CAA with this clarity to get a better clarity.
      As of now caa is an unwanted clog at the time. Tightening your border security should most probably do it

    CAA is not about secularism/unsecularism/democracy/dectatorship etc. It is about an unfinished business of partition which was done on the basis of religion. Pakistan was for muslims and for the muslims who voted to form Pakistan. Overnight, non-muslims families who could not leave Pakistan due to confusion or lack of means, found themselves in an hostile land and were punished for their religious identity. So, CAA is only for those INDIANS who could not come to India during partion and whose religion did not match with the religion of the land. That explains why other contries/religion etc have not been included.

      ​@@firyalazeera5396Bharat was not partitioned to make Burma. India was partitioned with bloodshed, for the demand of Indian Muslims, to have a separate Muslim nation for Muslims. Millions of non-Muslims were killed to push ahead the demand for Pakistan.
      Non-Muslims of Pakistan, didn't get a chance to put their demands or have consultation with India, for their rehabilitation or evacuation or any other rights.
      CAA atleast seeks to fast track the citizenship of those non-Muslims, who were wronged in 1947.

    He is deliberately confusing the issue with a clear agenda in mind. No law is 100% correct, that's why amendments are made over a period of time to make the law as realistic & practical as possible.

This could easily be implemented by an amendment in the future when the govt is ready but this guy wants to include every possible scenario into this act from day1 just for the sake of making arguments.

    To people misinterpreting him (including the video title), he is not saying CAA is wrong simply because it mentions religion or dares to have religious grounds, he points out how the constitution itself had religious basis in its origin and seemingly 'secular' articles. This should be obvious to any Indian who knows what partition really was. His objection is more about the problematic definitions and edge cases than its philosophy.

    He really needs to brush up his logical reasoning. As Harish Salve says and rightly says (paraphrasing) " A state can extend it''s ambit of humanitarian actions to any community and this in no way implies a discrimination against others." If I give alms to poor in my locality, its a fallacy to call me discriminatory against poor from streets in Baghdad. By this logic, any generosity and charity until and unless covers everyone on this planet runs the risk of being labelled unconstitutional. HIs confidence in his reasoning and that too on a public forum is a concern. If these guys are top lawyers and future judges, God bless us!

    The partition happened because there was mistrust between Hindus snd Muslims. Leaders of parties with religious ideology couldn't agree to a single country.
    There was not one leader who said you British just go, leave this matter to us. Because truly no Indian then had the confidence to administer all these conflicters, so the British could have their way. Indians then and even today have not learned to be inclusive. The British managed to rule all over the sub continent because they had skills needed. We still have some going to do.

      Check your facts. Only 3% of Muslim people (mostly rich ones) actually cast the vote for the partition, as there were severe restrictions on who was allowed to vote. Most of the people who migrated back had nothing to do with it.

The number of atheists who have fled Pakistan due to religious persecution and have sought asylum in India is estimated at ZERO.
    Those who decry the CAA are promoting Islamofascism in the name of promoting secularism.

    Everyone is going on about how he's with an "agenda", but i honestly wanna know the ans to the examples he gave at the end, cause that is really puzzling to me as well. And why shouldn't the refugees who are atheists, agnostics etc. be included in CAA?

      What I understand is, CAA is an incomplete Act, wherein you identify with any one of the given religions and seek refuge in india. It doesnt matter what you believe in. There are so many different ways a Refugee related Act can be made, but gov planned to make CAA which is purely mainstream religion based. Well there's that..
      And I also think it is necessary for a conservative country like india to take care of mainstream religious needs. Many countries used to do that, for example the arab countries. It keeps the harmony within the country without very serious cultural/religious clashes. Even developed countries like us or uk have trouble with unaccounted refugees, when their security system fail. Our country's not having even half the security or police force when it comes to such clashes, so religious selection do sound more harmoniuos in my opinion
