Quick Tip: Pt 2 - How To Get an SBR

  • In Part 1 of this two-part episode on SBRs or "short-barreled rifles," Caleb explained what an SBR is and how it's covered by the National Firearms Act of 1934 or "NFA." Now, he's going to walk us through the process of registering an SBR with the ATF. As with any process involving the Bureau of Alcohol, Tobacco, Firearms & Explosives, you'll have to fill out a form. If you're buying an existing, factory-built SBR, you have to submit ATF Form 4. If you're converting an existing rifle or AR-15 pistol or similar gun with a pistol brace into an SBR, fill out ATF Form 1. Shorthand: Making it yourself = Form 1. Buying an existing SBR = Form 4.
    You can register your SBR to yourself as an individual OR to a trust of which you are a trustee. If you register as an individual, you are the ONLY person who can be in possession of that SBR. You can't lend it to somebody. Wherever it goes, you have to go with it. If it's registered to a trust, you can include other people among the TRUSTEES, each of whom can legally have the SBR in their possession. Setting up the trust is more expensive, but it gives you a lot more flexibility. Registering as an individual involves less paperwork and costs less because you just spend the $200 for the tax stamp and whatever it costs to have a passport photo made and your fingerprints taken.
    You can fill out old-fashioned paper forms and mail them to the ATF. But the turnaround time will be much faster if you use the e-forms on the ATF's website. There's even a process for uploading a copy of your fingerprint card, so if you want to register another NFA item in the future, your fingerprints are already in the ATF database.
    If you're submitting a Form 1, for "building" the SBR yourself, your (1) name or your trust's name and (2) city and state will have to be engraved on the receiver of the gun (lower receiver, if it's an AR-15). You can register your SBR under multiple calibers, rather than specifying only one. This means you can change the SBR's caliber by swapping on a different upper receiver assembly without having to re-register the gun. You do have to list specific calibers - you can't just register it as "Multi-Caliber."
    When you die, your heirs can inherit your SBR. They'll have to register it with the ATF, but they DO NOT have to pay the $200 tax again. The tax is a one-time deal that applies to the life of the gun. Transferring ownership of an NFA item does require you (or your heir) to fill out and submit an ATF Form 5.

      As sworn law enforcement officers, special agents are authorized to carry weapons and make arrests for federal offenses against the United States. ATF is one of the few federal agencies where special agents get to oversee their cases throughout the entire criminal investigation process, from the crime scene to the courtroom. Special agents travel extensively and must be ready to accept reassignment to any U.S. state or territory relational to ATF’s operational needs.

      My Form 1 took 27 days from day one (application) until the approval email with the stamp…another 5 days to get the lower back from the engraver. It was both easier and quicker than I expected…the main reason I chose to take the SBR route when I did was to maybe get a jump on a possible rush that could be coming if and when the ATF puts rule changes on pistol braced lowers in the coming months 🙁🙁🙁

    It is important to note that if you break any of these NFA rules it is not like a parking ticket-it's a damn felony with significant fines. For example, if I had a suppressor on my home defense weapon and my wife used it to defend herself while I wasn't home, one or both of us would get slapped with a felony unless I setup a trust and had her on it. Likely the perp that broke into the home would face lesser charges-if he survived. The $200 tax stamp is bad, but the risk of a felony for something harmless should be the biggest consideration before someone gets into NFA items.

    Excellent information Caleb…E-Forms are the way to go…my latest E-Form 1 took 27 days from initial application to receiving my email from the ATF with my tax stamp…another 5 days added from dropping off my SBR lower for engraving until I picked it up.

      You are known as a "maker" when you register a pistol style firearm as a SBR when you do a Form 1 as an "Individual." When you get approved to make your pistol into a SBR, you'll also have to engrave (stamp) your SBR with your name you listed on the Form 1, including the city and state. The engraving must be at least .003 inches deep and cannot be less than 1/16 inches in size.
      I got my pistol into SBR approved eForm 1 back in 33 days...I think doing the Eforms (ATF eForms website) is simpler and faster, since I got mine back in 33 days and I also paid $30 at a local FFL to get my fingerprints in a digital electronic format that I was able to upload into the eForm, like you did with a photo of yourself and photos of all the manufacturer's markings...rather than sending/mailing your fingerprints with your control copy to ATF...thus, doing everything electronically on eForm website expedites the process, seems like to me. So, if you do another eForm you can use your smae digital fingerprints again and again to upload into eForm applications. Due to ATF's Amnesty program I didn't have to pay the $200 tax stamp and once approved they checked "tax exempt" on my approved eForm 1. Good luck! (Sidenote, there's guys who are still waiting for their approved eForms, looks like I got lucky.)

      Took less than 48hrs to get my SBR Form 1 approved using eForms. Had my electronic fingerprints ready, trust done, passport photo ready. Once you have all your stuff, everything is done through eForms. I was the "maker" and filed as a trust. After approval, got the engraving done, then built out my SBR (can't build until approved).

      @@natescott174 I don't know where you reside but I did a Google search for firearm engravings and I found places near where I reside...or if there is a local FFL, ask them for a referral or a place they recommend...some FFL's do engravings.

    Great video you got me thinking. My scenario is I already have a terminal diagnosis,and, want an SBR. I now get to decide how my gun trust gets written, and, whether I include my wife (who bought me most of my guns) and/or my son. Only kidding guys,. My wife will be on the trust too.

    The digital fingerprints are EFT files and as of Nov 8 2022 eForms allows the EFT file upload for form 1s. Form 1s are now running 90 days on eForms, form 4 eForms is 180+.

    Step 2: Wait for a long time
    Step 3: Get a paper telling you are allowed to own the thing that you already own.

    Took 11months, but I finally got my supressor tax stamp in. Man that was a wait. Not sure I'd go through the trouble of the sbr route as it seems like a lot of work compared to going pistol. Darned issue all around.

    I was told to do it in a single caliber. After you get your😊 stamp send atf a letter adding all of the other calibers. No fee or permit needed. It’s just a notification letter.

    Thx Caleb. Id have several SBRs and suppressor's if there was no ATF. I don't feel like risking $200, and needing permission to move while i wait upwards of a year for approval and agree to be tyrannized.

      Risking $200? If they prove you are a shit bag and deny you they refund your money. Permission to move? It takes 10 minutes to fill out two 5320.20s and mail them in. To me it sounds like you are either lazy or can’t pass an FBI background check. The more people that own NFA items is good. We can use the case of them being common place items to get the NFA abolished.

    I have 6 stamps. You cannot list multiple calibers. Your form 1 will get kicked back. You can swap different caliber uppers onto a registered lower all day long provided the gun is returned to its registered configuration. Eform is the way to go. My longest form 1 took 3 months. The shortest was 3 weeks.

      Should I do the paperwork before I purchase the parts or should I purchase the parts then do the paperwork? Obviously in either case I am not going to assemble the rifle before I get the stamp. I have a stripped lower so far.

    "E-Forms is faster" - HA! I haven't seen any improvement in wait time. Did my first form 4 using e-forms on April 4. It is now November 16 and I am still waiting.

    Great info Caleb! Been loving the E-File system for Form 1s as of late. Wait times have went up bit...over a month for approvals. Still waiting on an E-File form 4 for a suppressor that was certified back in May.

    Great video. I went the NFA Trust route and have multiple family members listed. I've Paper Form 1 and E Form 1 SBRs. E Form comes back faster, but I like the actual stamp that is placed on a Paper Form.
    My Pro Tip- be careful who you have doing your engraving. Its permanent and can really affect the look of your gun if done wrong.

    My question is about the timing. If you have to get a new tax stamp for each item, so you can't just get a tax stamp and then go shopping for an SBR, how do you buy an SBR without a tax stamp? You buy the SBR, then apply for the tax stamp, but you can't use the item? Can you possess the item while you're waiting? You just can't use it?

      You pretty much nailed it. You buy the item and the store keeps it till Uncle Sam approves. If it's a suppressor you can purchase it at some ranges that will give you visitation rights until you can take it home.

    My local shop got a SilencerShop kiosk.
    When I bought my first suppressor, I also set up a trust. Took almost a year to get it finished. Now I want to build a SBR, & add it to my trust. Can I do this on the eForm 1?
    When I set up my trust and everything, the shop owner allowed me to use the SilencerShop kiosk for my/wife’s fingerprints & such. Not sure how the process works, trying to do it online. They complicate the process so much; for average law abiding citizens it’s hard to stay in compliance even when trying 100%.

      @@gifthorse3675 one question that hangs me up on the paperwork. “What is the overall length of the SBR?” Like well, I wouldn’t know because assembling it would be illegal unless you use a pistol lower? So if you don’t have a pistol lower to throw the upper on & get a measurement, how would you know without breaking the law? & if they really wanted to get you, wouldn’t that be enough? Just answering that question. Makes no sense.

    Did the eForm 4, waited nine months and was not approved because the photo which was passport size came out to small on ATF side. Now have to start the process all over again. Time invested so far 18 months. Like a prison sentence for following the law.

    I bought a complete rifle lower, thinking I would be getting a 14.5” pin and weld setup. Now I’m seriously thinking about just turning that lower into an SBR. I HAVE NOT BOUGHT AN UPPER OF ANY KIND. I don’t see any way this can be a problem, as long as I wait for my tax stamp before buying an upper. Any knowledgeable advice would be greatly appreciated.

    What if you bought a stripped lower during a great sale with the intention of building your first AR, had it sent to the FFL, did the background check and transfer and all that, and then later decided on building it up as an SBR? What then? Can you RE-register your previously registered and serialized lower as an SBR? How does that work?

    A trust will help you if you have a family I would think. If you only have yourself on the form then if your family has to use it in an emergency or just if they could handle it from your safe then they might be facing federal charges. The time and money spent to set up that trust could save you a lot of lawyers fees, fines, and maybe jail time. Just my thought.

      Completely legal to swap different uppers as long as the gun is returned to its register configuration.

      If you sbr something your never selling it unless it's a factory sbr that's desirable like a mk18 or something. Basically once you sbr it that shits yours until you die. So value doesn't even play into it.

    ATF cannot come to your home and request to see any gun unless they have a warrant, or you give them your consent. Well,they can come. This includes any fully automatic weapons you legally own. If there asking you for consent, then they obviously don't have a warrant. However, the ATF can visit any FFL licensee once a year to check there records. Should the ATF come to your home and ask to to check your guns, ask the if they have a warrant. If they say NO, then STFU, and close your door. Never volunteer ANY information, Just STFU.

The ATF requires a warrant to search any property, and any Good Judge will never issue one to the ATF unless there is probable cause of committing a crime. Listing guns for sale and buying stocks for firearms is not probable cause, and a Good Judge will throw away the petition because he fears God and Truth more than men who have attempted to kill, steal, and destroy through the ATF and other unconstitutional federal cults. _Sinners, you have been warned._

      Considering the e-form 4 was just released this year, and people have gotten their stamp backs already, it's faster. I don't know a single person who got their paper stamp back in less than a year.

      Incorrect. Eform form 4 has been around since 2021. Current wait times for efile form 4 is 300 days. I efiled for a can January 7th and got approved April. I got lucky and filed before the rush.

    What if you go the route of purchasing parts to build a SBR from a company like AeroPrecision? Say you buy a complete upper that’s 14.5” or purchase the barrel separate from the upper receiver which requires you to assemble?

      @Cheese Balls…only thing is…if you happen to have it in your possession at the wrong time or situation (traffic stop, using it in self defense situation or a Range Karen “reports you to the manager”)…you will be in possession of an illegal NFA firearm (an unregistered SBR) which is a felony…To me wasn’t worth the ongoing risk.
