Very helpful video!!! For those not building an SBR... which form to fill out? The updated ATF eForm 1 questions are as if one is building and not an already purchased/owned SBR. It would be awful to get all the way though and find it was the wrong form. e Form 4 doesn't work as that's apparently intended for SBR/silencer purchase with prior ATF approval - that doesn't work for those who legally own pistol brace guns prior to Jan 31 new ruling.

@@richardc.caudill3033 ATF Form 1 (or the eForm 1) its the only one where you can make it a SBR (adding a stock/brace to a pistol or shortening a rifle), since the Form 1 pretty much stands of "You get scammed by the government to build a firearm" (The ATF defines a firearm for the NFA as a Suppressor, SBS, SBR, or Machine Gun). So you just need to Form 1 it and wait bout 3 weeks to 3 months, but if you're SBR it you may as well get a stock (once approved) for it.
Can you still fill out the tax exempt form for a firearm that was purchased after January 31st? Or is this tax exempt form only for firearms that were purchased prior to January 31st? I’m thinking of buying a pistol and SBRing it but don’t want to have to engrave the new firearm and pay a $200 tax stamp.

You are in charge of sending the CLEO copies of your application to the CLEO when you apply for a tax stamp. The ATF won't send your CLEO paperwork for you.

Yes you are registering your lower. It will ask you questions about the current upper you have on it now like caliber and barrel length but my understanding is that the lower is the part that is registered.
If you are applying using the ATF's eForm site, you would only need to send the CLEO copies of your applicaiton to the CLEO. The ATF receives your application when you apply on the ATF's eForm site.
I know you mentioned the 80% information but I am still confused. Who would I put for manufacture for an 80% Lower and would I have to get it engraved with a serial number before I start the process?

You would need to send the CLEO copies of your application to the CLEO you named within he application when you are applying for a tax stamp. You can typically use your county Sheriff as your CLEO.
I have a question regarding the manufacturer line item. I want to build a semi-automatic British STEN MKIII, from demilled original parts, and a semi-auto conversion kit offered by Indiana Ordinance. Since everything is basically parts with no serialized receiver (up until I weld the magazine well with stamped serial number to the new receiver tube) wouldn't this make me the manufacturer, and entered as such?
I decided to withdraw my Form 1 and not get the ATF's "blessing" for a SBR. Screw them. I do not need the hassle and restrictions that come with their "blessing." I'll just build an AR Pistol.
For the application, you will upload a photo of the original manufacturers engravings. Before you can make the SBR, your name, city and state would also need to be engraved on the firearm.

This is happening because you are using the incorrect application. You are using the ATF 2021R08F application and not the ATF eForm 1tax paid application.

Ok so I’m doing an ACR I have 3 different caliber barrels I plan on using as it’s a quick change system. It says Multi on the receiver so how do I go about listing all e calibers, the main setup will be a 12.5” 5.56 but I will also have a 10.5” 300blk and 12.5” 7.62x39 barrel and might get more in the future
You can only name one caliber on the application. Multi isn't allowed anymore. Yes you can still use your login. Yes you would need to send the ATF your fingerprint cards and passport again with your new application. Yes for your ATF Form 1, you would still need to send the CLEO copies of your application to your CLEO when you apply for the tax stamp.
For the Cleo page, for mailing purposes, my home address is of the city address but I do not actually live in the city, i live in the township which would be two different agencies (city police vs state police) does that part matter or will either one suffice?

Are there any limits to how many uppers you can register to one sbr lower. I'm looking to do my first one. But I have multiple uppers I'd like to attach.
To be more clear, you don't need to register any upper receiver. You only need to register the lower receiver, and you can use any number of upper receivers on the registered SBR lower receiver.
So with the additional uppers, would I be required to inform ATF abd document them about the additional uppers in each caliber. If so is there an additional form for that process.
Hey guys, I submitted my paperwork for a couple Pistols I registered under 2021R, I used your digital fingerprint service (was awesome and easy). At about 4 weeks I just got them back but both say "APPROVED WITH CONDITIONS - SEE CONDITIONS ON THE LAST PAGE OF PDF" On the last page it just says in red "Pursuant to ATF Final Rule 2021R-08F" What does that even mean? On my other non 2021R's they all have the stamp over the tax paid/tax exempt on the top right. This one doesnt have the stamp on it. it simply just says the above.
Your tax stamp is approved with the Final Rule 2021R-08F rules. The last 2 for some reason are just sitting, meanwhile, they were the 3rd and 5th submission. Haven't budged and its been 8 weeks on both of them. I'm wondering if the ATF is just waiting for SB1240 "WA States Assault Rifle Ban" to be signed so they can just turn them down. I cant think of any other reason as to why they are just sitting in submitted status when ones I submitted after have already been approved.

You would want to have your fingerprint cards completed before you apply, because you will have only 10 business days to get your completed cards to the ATF. After you apply the ATF will send you a cover sheet to your email address. You will need to print out that cover sheet and mail the cover sheet and fingerprint cards to the address indicated on the cover sheet.
So if I have a brace on my pistol but fill out form 1 technically converting it to a “sbr” does that mean that I can just get rid of the pistol brace and put a stock and vertical fore grip?
I want to say thank you for your video! I followed step by step and was approved in a matter of 3 days from the ATF receiving my form. The first time I did it, I submitted the wrong photo which was my fault, but the next application was smooth as butter!

I have a C&R which is required for an SBR in my state. I'm trying to input it in My Profile but it looks like I need to request an EIN to pull it up in my Form 1. Right now it says request pending. I don't know if I'm doing the right thing. Anybody have any insight to share on this?
@@jakesdad21 Sorry, I just saw your question. I thought I was requesting an EIN but apparently that wasn't the case. Ended up, they put my C&R info in so it was in a drop box so I could just pick it on a list (of one) instead of typing it in over and over. The window has closed on the pistol brace Form 1's so hopefully you figured it out and got them in in time.

As an individual you won't need to upload anything unless your state requires you to have a state or local permit to own the gun.

So I’m wanting to build an SBR and all I’m needing is to register the lower as SBR or how does that work that’s the only part I’m stuck on.
Yes you are registering your lower. It will ask you questions about the current upper you have on it now like caliber and barrel length but my understanding is that the lower is the part that is registered.
The lower is all that is registered. Despite what they ask all they need is the serial number. Hope that helps.
Update: 3rd and final approval was on September 18, 2023, just wish I submitted them under my trust instead!

If you are applying using the ATF's eForm site, you would only need to send the CLEO copies of your applicaiton to the CLEO. The ATF receives your application when you apply on the

Screw this I used a Kiosk machine and didn't have to mail finger print cards. It was done automatically.

You would need to send the CLEO copies of your application to the CLEO you named within he application when you are applying for a tax stamp. You can typically use your county Sheriff as your CLEO.

I have a question regarding the manufacturer line item. I want to build a semi-automatic British STEN MKIII, from demilled original parts, and a semi-auto conversion kit offered by Indiana Ordinance. Since everything is basically parts with no serialized receiver (up until I weld the magazine well with stamped serial number to the new receiver tube) wouldn't this make me the manufacturer, and entered as such?
I decided to withdraw my Form 1 and not get the ATF's "blessing" for a SBR. Screw them. I do not need the hassle and restrictions that come with their "blessing." I'll just build an AR Pistol.

For the application, you will upload a photo of the original manufacturers engravings. Before you can make the SBR, your name, city and state would also need to be engraved on the firearm.

What do you have to show LE officers if you don't actually get a stamp? Is it an electronic file you can access from your phone? Do I even need to show LE a stamp or is it incumbent upon them to "investigate" and find the proof of the document? Or is it recommended to get the stamp printed so that you have a physical stamp?

You would be the maker. The manufacturer is the original manufacturer of the firearm.

This is happening because you are using the incorrect application. You are using the ATF 2021R08F application and not the ATF eForm 1tax paid application.

Ok so I’m doing an ACR I have 3 different caliber barrels I plan on using as it’s a quick change system. It says Multi on the receiver so how do I go about listing all e calibers, the main setup will be a 12.5” 5.56 but I will also have a 10.5” 300blk and 12.5” 7.62x39 barrel and might get more in the future
You can only name one caliber on the application. Multi isn't allowed anymore. Yes you can still use your login. Yes you would need to send the ATF your fingerprint cards and passport again with your new application. Yes for your ATF Form 1, you would still need to send the CLEO copies of your application to your CLEO when you apply for the tax stamp.

No there isn't.
To be more clear, you don't need to register any upper receiver. You only need to register the lower receiver, and you can use any number of upper receivers on the registered SBR lower receiver.

Hey guys, I submitted my paperwork for a couple Pistols I registered under 2021R, I used your digital fingerprint service (was awesome and easy). At about 4 weeks I just got them back but both say "APPROVED WITH CONDITIONS - SEE CONDITIONS ON THE LAST PAGE OF PDF" On the last page it just says in red "Pursuant to ATF Final Rule 2021R-08F"
What does that even mean? On my other non 2021R's they all have the stamp over the tax paid/tax exempt on the top right. This one doesnt have the stamp on it. it simply just says the above.
Your tax stamp is approved with the Final Rule 2021R-08F rules. @@WalnutZen I submitted 7 of them all back to back in the same hour, I received 5 of them back, both approved and disapproved @ 4 weeks. The last 2 for some reason are just sitting, meanwhile, they were the 3rd and 5th submission. Haven't budged and its been 8 weeks on both of them. I'm wondering if the ATF is just waiting for SB1240 "WA States Assault Rifle Ban" to be signed so they can just turn them down. I cant think of any other reason as to why they are just sitting in submitted status when ones I submitted after have already been approved.

So I am getting finger printed tomorrow by my Cleo. I have everything required filled out and ready to submit. Should I wait to get finger printed then upload the documents on here or should I submit and send the finger prints by mail to the atf? Also what is the address of the atf I send my finger prints to?
You would want to have your fingerprint cards completed before you apply, because you will have only 10 business days to get your completed cards to the ATF. After you apply the ATF will send you a cover sheet to your email address. You will need to print out that cover sheet and mail the cover sheet and fingerprint cards to the address indicated on the cover sheet.

Paid 65$ bucks to local company for ATF compliant EFTs and passport quality photo. Kinda weird to file an eform then to send fingerprints vis snail mail.

I have a C&R which is required for an SBR in my state. I'm trying to input it in My Profile but it looks like I need to request an EIN to pull it up in my Form 1. Right now it says request pending. I don't know if I'm doing the right thing. Anybody have any insight to share on this?

@@jakesdad21 Sorry, I just saw your question. I thought I was requesting an EIN but apparently that wasn't the case. Ended up, they put my C&R info in so it was in a drop box so I could just pick it on a list (of one) instead of typing it in over and over. The window has closed on the pistol brace Form 1's so hopefully you figured it out and got them in in time.
