    Hi Oscar, my EB2 NIW Consular process was delivered at USCIS on April 2, 2023. I had to provide RFE additional information and resubmitted on Oct 2, 2023. Does my Priority Date change?

      Not sure what the question is, are you talking about adjusting your status from a J visa to a green card? Yes, you can, as long as you are current in the visa bulletin

    If any petitioner's case is transferred to relevant embassy for visa processing and still interview date has not been assigned then in such case, do retrogression can cause in increasing interview wait time?

      Yes, if retrogression makes you not being current anymore, yes

    Hi Oscar, thanks for always providing great info to us. You said 15 - 20 months of waiting period to get the GC (depending on the scenario). Shall we calculate it from the PD or DQ?

      that is based on today's visa bulletin situation, which will continue to evolve. It's from PD but it does not include any backlog in the consulate or embassy. That could add a few months depending on where your are (and unfortunately there is no public official data on consulate backlogs for green cards)

    Hi Oscar, I am on TN visa and my employer is about to file for i140 but with the current backlog do you think it is a good timing since my TN has 17 months remaining and I’m not allowed to renew TN while on GC process

      Thanks! Not really because unfortunately the processing times in Embassies/Consulates are not public. So after you are DQ you can *estimate* how long until becoming current, but there's the wait time until getting an appointment based on the consulate's backlog, and we have no (official) way to know that. I hope one day they will publish that, like they do for nonimmigrant visas

    Hi Oscar, If I-140 gets approved, but the priority date is nowhere near to continue with the final process of green card application, can a person apply for work permit and travel authorization before applying for the status of adjustment?

      No, like I said in the video one of the benefits of being able to file I-485 is that you can also file for those two interim benefits (EAD and travel). Unfortunately you can't apply to those until you file AOS

      ​@AnPTsRoom7 if you have a valid visa stamp that allows you to travel it should be no problem . And yes, I hope they decouple these processes from I-485 so people can get EADs

    Don't worry about comments, just ignore them. Btw, when there is no difference between EB2NIW and EB2, then how is EB2NIW is faster than EB2?

      Thanks. NIW is not faster in the visa bulletin but NIW saves you one step compared to regular EB2 because you won't need a labor certification or PERM (the usual process that goes before I-140 )

      Yes, birth place is all they care. If your spouse is born elsewhere it will help.

    Hi oscar, thanks for the video. My petition was approved in dec and im waiting for the consular process, however i need to attend a conference in the us in Aug. Will my status affect my chance of getting a non immigrants visa.

      Congrats on the approval. Yes, it could affect the approval. You should still try and provide the necessary explanations but do keep in mind that there's a good chance you'll be denied

    Oscar, thanks for everything you do. I enjoy your videos. They are very Informative. Please can someone with a Bachelors degree in Molecular Biology, no work experience in this field. However, i have over 15 years of progressive experience working in Cybersecurity /IT with tons of professional security certifications apply for EB2 NIW ie file a i140 petition or must my Bachelors be in Computer Science or Engineering field?. Note I am working on some projects/endeavors that are of national importance 😊

    Hey so I’m doing the EB1A adjustment from O1.
    So I filed the I-140 premium process. And filed the I-131, I-765 and I-485 all concurrently.
    I haven’t heard anything from the 140 premium processing but received and did my biometrics May 8th.
    Filed March 29th straight the National Benefits Service. Biometrics receipt April 19th.
    Have you had this experience ?
    I payed premium but nothing.

      If they charged you for Premium, you should get your I-140 processed within 15 days for EB-1. If that did not happen (and they charged you), you should contact them to request they adjudicate your case or refund you.

    Hi Oscar, the wait time for I-140 appears to be 8-10 months. But I hear people saying that they got their I-140 approved in 3-4 months. What’s the trend like in the wait time for a response on I-140?

      It really depends, I have seen 3 or 4 months recently but others are waiting twice as long.
