I've seen smooth-brains in the comments here claim that Open Hands' incompetence is proof that they are not scamming people. They were simply burdened with too much "choice-paralysis" to make an informed decision. They haven't found the right organization yet? Bullshit. Open Hands defenders' mental gymnastics are impressive, but bootlickers gonna bootlick.
If your entire existence as an organization is to be a charity middleman, you kinda need to know that sort of thing in advance. Otherwise you shouldn't even have the confidence to exist as a full-fledged charity at all.

    • @orangejjay
      @orangejjay 7 หลายเดือนก่อน +44

What I don't understand is why they're holding on to the money. It doesn't make any sense.
Is the $11k in "expenses" really worth a fraud conviction?
Sounds like the money they were "raising" before 2014 was going right into their pockets and only after public pressure to become a 501(c)(3) did they truly become a charity.
It should be noted that to become a charity you have to first register as a for-profit business and after some time, you can ask the IRS to switch you. Doesn't mean it's necessarily hard to make that switch or that you have to give your money away since "raising awareness" counts as a charitable cause and you can have employees that do this work for the "charity."

    • @MichaelJM
      @MichaelJM 7 หลายเดือนก่อน +23

@@orangejjay Yeah holding onto the money doesn't make any sense. I really hope it's true for the sake of everyone involved. But if I had to bet, I'd expect this story will have a few more twists and turns. It's just a number on a form right now with nothing else backing it up yet.
The thing is, if there was something more nefarious going on, filing these forms with the IRS the way they have seems like the worst way to go about covering something up. It makes no sense any way you slice it.

The Curse of JonTron is real.
EDIT: There have been several requests to elaborate. For those of you who have access to the "Inter-net" (also known as the World Wide Web), you can look up the history of JonTron and NormalBoots shunning him instead of standing by theur co-worker.
For those of you without Internet access, I'll summarize:
Jon Jaffari went on a podcast and related an example of something he had heard to make him second guess the modern narrative. For daring to only ask a question--nor state his actual beliefs--his other collaborators at NormalBoots dud not respond with empathy and discussion. Instead, they immediately decided that he was Super Demolition Hitler and all but chased him away with torches and pitchforks, declaring they would never want anything to do with him ever again.
When he was at a public controversy, his so-called trusted friends abandoned him. Jirard for years has attempted to place himself in a holier-than-thou position between that incident and virtue signaling--and now we see the prideful facing a mighty fall.

Jirard's main focus is on his own public image, just hearing him say "even if I donate the money now, it'll just look like I'm trying to cover it up" tells enough. At this point there is no graceful way out of this, and if he did just donate the money, at least he's finally doing what he promised us. The solution being so simple, yet still not happening, makes me feel like they're lying, and have spent more of the charitable funds than they're documenting. This all feels very greasy.

    • @moonlitxangel5771
      @moonlitxangel5771 7 หลายเดือนก่อน

I agree. Like dude your public image is hurt either way. This isn't gonna go away and it's just gonna get bigger and bigger until it gets publicly addressed. He could easily get back in MOST people's good graces by donating the money now and putting forth an action plan to make sure this doesn't happen again. Instead, Open Hand or someone affiliated with them tried to falsely get this video pulled down.
And it's even worse, because Jirard said he knew since 2021 (dunno why he kept saying 2022 in the video even though he clearly states 2021 in the call clip) so for TWO YEARS he did nothing about it and kept acting like the money was going directly to specific charities when it wasn't. Honestly that amount, while huge to most of us, would be a drop in the bucket for Dementia research, it's likely not had an effect in those terms.
However where it would have an immediate a material effect is in supporting and helping families with a loved one suffering from dementia. Everything from helping make homes more accessible for people with dementia, general care costs, nursing costs, even every day costs like food become incredibly difficult if you're caring full time for a loved one. It's absolutely awful given how many people this could have helped, people who were watching their loved ones dissappear into their illness more and more, day by day while struggling to make ends meet and meanwhile they have money that could have made a world of difference to those individual lives just goddamn sitting there.
The immediate and material good this could have done is just absolutely heartbreaking.

This would explain the "historical donations" they used to justify putting UCSF on their web page, and also why they have a quote from the dean at that time on their web page. But whatever that interaction was 20 years ago, it has nothing to do with the last 10 years of soliciting public donations.

I have always thought Jirard was a good guy, I still am leaning towards him being a good guy who's botched his charity but intends to still send that money to researching Alzheimer. But that still won't ever excuse the, at the very least, manipulating he's done and the lies he's said to get people to donate. There's just no damn way he didn't know the finances were never sent to charity and if he found out in 2022 and it wasn't immediately dealt with he should have started legal proceedings to cover himself if his brother was embezzling the donations. He has done nothing of the sort and has not been honest even since learning all the money has sat, and hopefully still sits, in an account and has helped nobody with research.
There are lies he's said at this point. He's either doing these things to cover someone involved in the charity, with his brother being the most likely culprit. That said, I know nothing of his brother and am not accusing him of anything. Or he's okay with lying to his audience who he always seemed so endeared toward. I never expected him to be caught lying about his charity at all, let alone find out none of the donations have ever gone to research. I'm a bit torn because I genuinely think highly of the man.

I had lived with my grandma for 24 years. During the last few, she had alzheimer's, but because of the treatments she was getting, she wasn't really affected by it until the last 4 months of her life. I was the only one who could get her to eat anything, and even then, she didn't seem like she knew she was hungry. She also laid in bed all day, doing nothing but sleeping. Seeing her spiral into what she became made me very sad and pitiful for her. She went from the closest person in my life to what could only describe as a tormented person trapped in whatever hell she was in. I cried when I last saw her, she looked like she was in so much pain and discomfort lying in that bed. With how personal alzheimer's and dementia is to me, I despise someone like this who willingly held money for seemingly no reason for this cause. I am not saying we could have it cured with this money, but I would believe we would have a bit further progress on understanding and possibly curing it.

    - Edit - please see my reply to this message. BIG Issue.
I would like to clear a few point in this video as I work as an auditor for non profit orgs (NFP).
    1. When a CPA firm e-files a 990 tax form on behalf of their client, the form is almost never signed, and instead you see the paid preparer filled by Hansen and Franklin with the Firms EIN number attached.
    2. Some NFP organizations will collected money and raise cash reserves without spending any for a few periods, however you will have for NFP tax status revoked if the IRS was watching you do this.
    3. See a $700 fee from the Accounting firm, I'm guessing the firm is just prepping these the same as last year and moving on.
    4. it appears the board may not meet, and therefore the directors may never know how thing's are going for the organization.
Unfortunately, due to their size, I believe there will never be an audit. and the tax firm prepping these returns is just rubber stamping them every year without question. If there is a big enough public out cry, the IRS may start to look into this and into Hansen and Franklin. ~Will update if I learn more.~

SO NEW UPDATE!!! after review of the last 7 tax returns, here are some updates to my first post.
      1) This is a 990-PF for a 501c3 private foundation. They are not required to meet as a board or required to do anything to support their mission. so in that they are playing by the rules.
      2) As a Private foundation, they are required to make minimum distribution which are typically 5% of prior year assets. So for the 2022 return, I would expect to see about 27,466 as a distribution. This would appear on page 10 on the 2022 return in part XII, or even on page 17 under the 4 column. I'll explain what this means below.
      3) for a 990-PF, a CPA firm would typically charge between $2k and $4K. Our firm with only works with Non-profits would charge $3,500 for a first year return, and $2,400 for each year after. It appears either the first year expense is either not listed on the tax return, or it was only $500 in 2015 and now is $700 in 2022. THIS means the FIRM is putting about 2 hours of a low level associates time on the return and about 1/2 hour of time for the Firm's partner Tamera Hansen to review the associates work and file the return for Open Hands. Alternatively Hansen may just be completing the return on their own with no reviews.
Now for the big part, I have calculated the impact if they were to be audited by the IRS. They would owe the required minimum distribution for the past 5 years to be made as a charitable distributions or grant, and would have to pay an IRS penalty of 100% the minimum distributions they owe. based on the past 5 years, they would owe more then $82,401 to charity and pay a penalty of $82,401 totaling $164,801.
So, they both suck for not distributing funds raised for charity and they will owe a minimum of $82K of donated funds to cover the IRS penalty.
Last, personally believe that Jirard was probably unaware of the funds sitting in a bank account, and was trusting both Charles (the one managing the books) and the CPA Firm of Hansen & Franklin to either tell the board if there was an issues (of which he is apart of) or to be running perfectly without him. I think best case is to stop donating to this foundation, inform others about where they can donate directly, and inform others what the foundation is doing so they will either have to stop fundraising or do something with the funds they have raised. Happy to discuss more if requested.

A thought occurred to me, perhaps the money was sitting in some kind of interest account. Even at 1.5% or something, few hundred grand would get you an extra paycheck now and then. This would explain the motivation to keep the money in one location for so long. According to google, a 501c(3) can set up a savings account which earns interest. If they are ever caught, they could say "See, the money is still there! We haven't touched it." Which happens to be what Jirard says on the phone call, more than once. BUT that's just a theory. I can understand it, especially if it wasn't sorted yet.
Jirard actively making steps to fix this doesn't mean hes putting all his effort in. It probably means him being a boss and saying "I need you to sort this and report back". I suspect he's done that for this last year. Should it take that long? Maybe not but also doesn't seem unrealistic to me.
Why did he not get out in front of it? Again, I can see why you wouldn't want to until it had a resolution. I can also see that making a public video because in many ways your brother may have fucked up is also something that takes a more delicate hand. Is it right? No, but is it reasonable...
With all of this I think Jirard's response will be telling. I suspect "humans doing the best they can" might be all this is and it will depend on if people think that response is genuine or fake.

As a neuroscientist with some experience in Alzheimer's research, I have a lot of questions about how they propose to evaluate who to donate the money to. If they want to honor their promise that it all goes to research and none of it goes to administrative costs, that rules out a straight donation to organizations like the Alzheimer's Association.
If on the other hand they want to award grants directly to researchers, how are they going about soliciting and evaluating grant proposals to ensure the money is used for legitimate, well-justified research that has a chance of yielding real benefits? How are they putting together a review panel to evaluate the proposals? I assume that they aren't going to dip into the donations to reimburse any experts for their time to review such proposals as they say all of the money is going to research, so are they paying the administrative costs themselves out of pocket?
Based on the filings you showed, it seems like they are pulling administrative costs from the money that was donated, which already contradicts the statements I hear Jirard Khalil making in the video.
Based on all these revelations, I would have serious reservations about participating in any kind of review panel for this organization, and likewise I don't think I'd waste my time writing a grant tailored for any request for proposals from this organization if I saw it. Sadly, the best we can probably hope for is a straight donation of all the funds raised to a more legitimate organization like the Alzheimer's Association and just accept the fact that 25% of the remaining funds will be chewed up by administrative costs. Sadder still, I have very little hope that we'll see the best probable outcome in this case...

    So lets boil it down.
In the last 10 years he has raised $780,915 for charity.
He said every cent would go to a specific charity.
Now only $655,520 of it is left. Over $125K has went to expenses, and $0 to charity.
Open hand doesn't pay employees, and has people donate equipment and space for events.
This was a selling point at events by Jirard so he could promise all the money goes to charity.
They should not have expenses, each year should have been like 2014 with no expenses declared.
What is the source for this information?
1: Taxes filed by Open Hand.
2: Jirard literally saying it happened while on a call.
Possible discrepancy can be the tax forms, leading to 3 scenarios.
1: The tax forms were correct, making this look terrible.
2: They lied on the tax forms to make themselves look bad.
3: They lied on the tax forms and this is much worse than it actually is.

It would be so easy to fix something like this if the true cause was gross negligence, but I think it’s more insidious than that. I think they collected the money, shrugged their shoulders and said “well, *we’re* a family that’s been affected by dementia….” And then just prayed no one ever looked at their financial records. Still waiting to see Jirard’s response to all of this but I’m not holding my breath.

I've been saying this for years. The Greg split was weird and everyone took Jirard's side when Greg was completely reasonable. Greg was only vocal because Jirard painted it as an amicable split when behind the scenes it wasn't.
As soon as Greg left, I just found Jirard's content extremely boring. Then Jirard deleted the 100+ videos that Greg was featured in.
Jirard has always been sketchy. I'm surprised no one called him out sooner.

It is deeply ironic that somebody named The Completionist who is known for completing 100% of things, failed to donate funds for almost 10 years now that he collected for a charity that is supposedly near and dear to his heart.

it is a common technique to try and get ppl on your side, is to invite them to give advice. everyone loves to give advice right? unluckily for jirard tho, this normally easy manipulation tactic to pull off seems so out of place because of the circumstances. his normal bag of fuckery just wont work anymore. every bit of outrage in the group call seemed forced. every bit of sincerity seemed forced. his normal manipulation tactics are breaking down now.

I think an interesting dilemma is presented with the fact that even if they donate this money now, that is almost 10 years of donations toward research that could’ve occurred. I’m not saying that a cure would’ve been magically found, but that could have been scientific progress that ultimately just wasn’t.
