    I was assaulted, then arrested. When court came around, it was mentioned within the first minute that thru their investigation, they found that the other person was the aggressor and the case was dropped. My problem is, why were we both not arrested, and why did they take me away without talking to the three witnesses, who called the cops, not 50 feet away? Not only did I have to pay an attorney, but now I have an assault arrest on my record that I now need to pay an attorney to have it removed. Something doesn't seem right. Do I have a case in there somewhere?

Sure, there's your don't kill, don't steal, etc. But then there's such random shit as not being able to wear cowboy boots unless you own two or more cows (Blythe, Cali), or _it being illegal to have more than one kid if you're not married_ (Mississippi. Yes, I know it's unenforceable and very likely unconstitutional, but it passed and afaik nobody's challenged yet...)

    FYI "As long as you didn't get into that wide turn space." That's what most ppl don't get. Give trucks a wide birth always. Don't tailgate and don't jump in the open space they've made between them and the car in front. 80,000 lbs can't stop on a dime.

      Defensive driving school teaches something like a minimum of 3 seconds between vehicles. I've definitely done worse, and have never been in an accident where it mattered, but it's sound advice. Your reaction time might only be a little better than 2 seconds and while your car has a crumple zone, along with most other cars on the road, those 18 wheeled trucks most assuredly do not. It's just straight frame from bumper to bumper and from one end of a trailer to another. Their airbrakes are good, but inertia is a difficult thing to overcome.

      ​@nathanielcowan3971 the defensive driving class in my trucking schooling taught 2 seconds PLUS 1 second for each metric ton of vehicle you're piloting, at 60mph. For small cars that's about 3 seconds, but even a light duty pickup truck+loaded trailer can push 10 seconds with that math.

      I'm with you, as long as truckers agree not to drive in the fast lane and never drive aggressively. Then I'll respect their space. As long as you're driving an 18-wheeler in the fast lane going under the speed limit, I don't care what stickers you have on your truck.

    A big one is the big trucks with rocks and it says ( don’t drive to close not responsible for window damages) …… they are indeed responsible don’t matter how close you are

      Incorrect. If the rock falls out of the truck and hits the ground first and then hits you, you MAY have a case, as long as you can prove it. If the rock falls from the truck and hits you before it hits the ground, you are most likely going to be charged with following too close, be found at fault, and your insurance company may not pay for the damages.

      @@lookileftpooponyourpage5604 I think you have that backwards. If the rock flies off the truck and hits you, they're directly responsible for damaging your car. If the rock falls off the truck and hits the ground it becomes "road debris" which is your own responsibility to avoid.

    I guess I should jump in on this too.
    My dad died last year, and I’m named after him. I was somehow reported dead instead of him with all three major credit bureaus. I read that I can hire a lawyer to sue them pro-bono without my presence required in court. Do I have a case?

      You probably have a case, but you'll need to have a thorough documentation of your (financial) injuries. Getting denied for a car loan probably won't be considered an injury. Losing your job because they run regular credit checks would be. Losing social security benefits would be.

    A hospital wrapped my wounds without cleaning them (which i didnt know at first because i was loopy from the accident that caused the wounds) then they released me far too early for the wounds i had sustained. My family pushed me to go to another hospital as nobody felt like i should be out of the hospital and in that hospital is where i learned that my wounds still had rocks and dirt in them which had to be very painfully cleaned out. That hospital also determined that i should not have been released and sent me back to the original hospital with a note saying i needed to be readmitted snd the hospital agreed that they messed up. I filed a complaint with the hospital and they were just like "sorry our wound care team was off the night you came in" and ignored all the other complaints. I tried to call a lawyer about it, they sent me to another lawyer and that lawyer ignored my attempts to contact them entirely.

    For the "get sick after eating in restaurant" case: Unless it's salmonella, a lot of enteric diseases take several DAYS for the bacteria or parasite to build up in your system before symptoms appear. So the last place you ate is probably not the source of your illness, but from a few days ago. Even salmonella takes about 6 hours before you become symptomatic.

      There have been cases of parts of machinery or drugs etc ending up in food that was served which is a legitimate case. As an aside I stopped eating Taco Bell because I came to associate it with next-day-shits but then I realized that when I went out drinking I always ended up eating Taco Bell (the only time I would order it) and it probably wasn't their fault lol.

    I got hurt at work moving containers was put on workers comp which is a joke in itself. I felt I was treated differently when I returned to normal duties afterwards. Do I have case?

    The wide turn sign is for trucks making a right turn. Technically, we're supposed to maneuver the vehicle so that we take up all the space we need before taking the turn, making it impossible for someone to get into that space. But make no mistake: if a semi turning right fails to do this and you try to slip around him on his right, you are taking your life in your hands.

      The trucking schools will claim you need to take all the space so they can’t squeeze around you, but legally speaking as long as any part of the vehicle is occupying the lane then the lane is considered legally occupied and the other vehicle is breaking the law by squeezing around you. They can’t sue you for those damages they obtained while actively breaking the law

    I have allstate and my car was stolen. Allstate doesn’t want to pay out because they said i didnt have the car theft package/insurance.

    When I was in high school I left a store to find my normal route blocked. As soon as I saw the accident I knew what happened because I’d seen it almost happen half a dozen times. This intersection was a narrow street going onto a 4 lane road with a median that was high enough a truck couldn’t bump onto it. There were a couple of businesses on this narrow road that needed semi truck deliveries. The experienced drivers knew that you could go out the other end of this street, around a bend, to a near identical arterial, but had a wide signalized intersection. The less experienced ones would try the visible, but tight corner. To make it they would have to line up in the center of the street, wait for an opening in both of the lanes and take a wide turn, narrowly missing the light pole on the corner to the right. But occasionally, you would get a driver who would get impatient waiting for a truck driver to get their opening and they would try to go to the truck’s right. This is how you crush a lime green VW bug between the side of a semi and a light pole. The light pole was replaced after that with a breakaway model.

    My wife and I got food poisoning from some spinach quesadillas at a Gloria's resteraunt back in 2012. Classic food poisoning symptoms, both ends, we were down for about 30 hours the both of us.
    It never even occurred to us to sue the place, its wild that so many folks seem to think that way. We figured it was a bad batch of spinach. Could have got the same from a grocery store and cooked it at home. They probably ran through it that same night, so the next batch was probably fine. Some harm, but no foul.

We shared the chips and salsa - along with queso and I think guacamole - with 3 other people, and those people ordered entrees, including quesadillas, just without any spinach. My wife and I were the only ones who had spinach,. and we were the only ones who got sick.

      It's food poisoning and it's caused by bad, unsanitary practices in the kitchen. Not necessarily something obvious to an outsider but food safety is very strict with times and temperatures and for good reason. You should have sued because everybody who goes and dine here is at risk if they don't change their protocoles.

      It’s important that restaurants are held accountable because- while you were ultimately fine- a lot of people die from the same thing each year. BUT, while the restaurant is responsible, it’s really hard to prove that they directly caused the illness unless you have some bigger agency come in and like test their food and stuff within a short interval. That’s the real problem.

    A entry door to the post office had a broken shock. The door slammed on my hand. My hand has a huge knot and hurts constantly. The post office refuses to call me back. The post office chained the doors shut, this violates the fire code. I have videos.

      You could always complain to the local fire marshall. You wouldn't get any money, but they would do an inspection and force the post office to keep the door open, plus whatever else they found.

    You got in a car accident where the other person admits to fault. You don't go to the hospital because you're a little shaken up and just want to go lay down and you tell responding officers "yah, I think so" when they question if you're alright.
    Now, pains creep up later, but with other possible causes, like work(land scaping, I including tree removal)or even a roller coaster as in the example given in this video. Months or even years later(delayed as "elective" durring the pandemic even though it prevented strenuous work for more than a few hours a day), you go in for surgery with insurance but also a $1,700 deductible. It it at any point worth making any sort of claim with the car insurance of the person at fault in the collision?
    Btw, I was a passenger and we were T-boned in my side of a short cab pickup truck by a very sweet old lady who looked to her right after coming to a complete stop before turning onto the highway, but failed to look left because she had been planning to cut across a couple lanes to drive left. I saw her head clearly and nothing seemed amiss before she accelerated forward into us.

      I was in a very similar accident and even though I felt ok immediately after the accident, I ended up with a terrible degenerative back injury and I'm now in my forties and have to use a wheelchair for the rest of my life. It's important to go see a doctor and consult an attorney after a serious accident.

    When I worked as a server at a pub, a group of ladies came to drink. They ordered one of the house cocktails, and 3 rounds later, my boss (the owner)told me that they would need to order food, or they couldn't have any more alcohol. They Did Not Like That. I had to explain that we have a legal obligation to not over serve, and we could not take their word that they'd eaten already.
    The cocktail in question had the most alcohol allowed by law in its recipe. We weren't allowed to sell them as Doubles. That's how much booze these ladies had had in under 30 minutes.

    When I worked at a liquor store, we had this man who was an alcoholic. He would come in and get multiple pints of vodka per day. I wouldn't serve him after 8 pm. Because when he was walking what if something happened, and it got pinned on me? He would have people come in and try to get it for him, and I knew it. I wouldn't let them purchase it. I had a young child to support, I couldn't afford to be sued. He would get so mad at me, but I wouldn't cave. He would complain to corporate about it, and the owner herself had my back.

      That's one thing I've actually really liked about liquor store bosses vs other retail places, the bosses are USUALLY way more on your side than the customers side, because they know how some customers can get.
      I have FULL discretion to not serve anyone and tell them to leave, I can't straight up ban someone without talking to the boss first but what the employees say has genuine weight to it with him.

      @@kempolar9768worked at an airport bar for a decade. Had only a handful of people I had to cut off individually. But I had one flight one night that was delayed like 5 hours past our usual closing time. Was the only time I ever closed the bar down outright. Because like 15 of the 20 or so passengers were getting completely sloshed. And most of them were being absolute arse hats to my coworkers and to the various other airport staff like the gate agents that had no control over their flight being screwed up.
      Just called up my boss and told her that I was shutting it down. She had worked there almost 20 years herself and never seen it closed. So of course was super confused as to how it could get that bad. But once I explained how the customers were acting. Well. She was more than happy to back me up if the owner got called. Definitely had some pissed off customers. But the TSA agents and airline staff I actually worked with on a daily basis were super happy that I was making them cool off.
      Still one of the craziest nights I ever had at that job. The other one was when the police had to be called(right in the middle of the BLM movement. So fun times). Because people were actively screaming at and even throwing stuff at the airline staff in the baggage claim area because their flight got cancelled. Like so bad my coworker working the snack counter out there closed and locked up early because she didn’t feel safe working with those jerks getting so loud and rowdy. Thankfully nothing actually happened. But man was I worried that an all out brawl was about to start.

    I was working at a doctors office that had significant mold growth, including black mold. Mold specialist said we needed to wear N95 masks and patients needed to wear them during their appointment. Company told us to keep working and thst the mold specialist was exaggerating despite the evidence he and us had like phitographs and mold readings. One coworker was referred to a pulmonlogist and another has to get a lung biopsy.

    Would you do an episode about how trucking companies try to convince drivers they’re not liable for stuff falling off their vehicles & hitting your car by posting those carefully worded “Not responsible for objects coming from roadway” signs? They are if the object originated from their truck. Would you find one of those cases and sue them out of spite for placing those signs on their trucks? Who would have thought you could escape all liability because you put up a sign that says you’re not liable?
    “If I got a sign that says I’m not responsible then I’m not responsible.”

    My back was messed up in 2013 when they was preparing me for a C section and they put the needle in my back and hit a nerve and then I jumped a little and I was yelled at, and I I was told that I could paralyze myself because I jumped but I told them that I did not do it on purpose. They hit a nerve in my back and it hurt really bad and I felt something weird and it made my body jump. Ever since I can’t walk too far, sit too long, or lay down too long.

    I had a friend who was an alcoholic who didn't like being told no. He got belligerent in the bar of a restaurant so they "ran out" of his beer. He then insisted we move to a booth with a different server. He then ordered a beer for each of us but waved me off when I said I didn't want one.

    I've seen trucks turn from the straight lane instead of the right turn lane and bully people out of the left turn lane when they're Turing left...drives me CRAZY
    I've also seen a truck with a sticker stating that they weren't liable for broken windshields which made me laugh

      They aren't liable for windshields. As long as it wasn't cargo that fell off the truck, and they have mudflaps. If they have both those things, then you were following too close.

      A standard semi truck is 70 feet long. You need that lane to make the turn and not take out pedestrian on the sidewalk.

    Here's one for you. I got a large static shock and hat was so great that my arm was throw back violently tearing a tendon in the shoulder. The static has been an ongoing issue in the store for over a year and reported on by many people. Was hurt the same way in same store 6months earlier and got a bruise.

    If you have the shits for a couple hours or a couple days because of a meal at a famous franchise restaurant, do they have a case against you for defamation if you publicly accuse them on social media. Evidence of a timeline and results exist. Blood was present. An emergency room visit was never made because I was poor and didn't have insurance. Because of my experience with school nurses, i didn't think they'd do anything besides tell me to drink some water and lay down anyway.

    If you get sick right after eating at a restaurant, chances are that your case, if any, is with whoever prepared your lunch or breakfast. Food poisoning typically takes a much longer time to manifest than most people realize. Unless someone put some poisonous substance like arsenic in the food, it often doesn’t show up for 8 hours.

    I was driving on the interstate and 4 cars in front of me (car length between each car, so about 8 car lengths) was a truck full of rocks with no tarp. Somehow, my car got rained on by these rocks over the 3 vehicles in front of me, and cracked my windshield. I’ve always wondered if there was anything I could do about that. Especially if I couldn’t get their tag or anything. I’m basically just screwed

    The rollercoaster back pain I think can be a case. But is it a healthy adult? What where the safety precautions? How bad is the back pain? If someone landed to hard because the seat belts were to lose? I Mean...

      I recall back in the '90s seeing warnings on The Big Bad Wolf at Bushe Gardens Williamsburg that people with back and neck issues should NOT ride. Since I have neck issues, I stayed off it.

    I was in a plane crash a year ago in a Central American country. I ended up jumping down from the door about 10 feet, as part of the evacuation. A week later, when I returned to the airport, we wrote in the book of reclamation for the airline (a complaint book) that my back was hurting after the evacuation. I had Xrays afterwards, but nothing came of it. Now, a year later, my back was hurting after a rafting trip and an MRI showed back injury. Do I have a case?

    I always laugh at the dump trucks that have a small sticker that says “stay back 200 feet. Not liable for damages.” They’re all over down here in south TX and almost every truck that hauls gravel, sand, dirt, etc has the sticker. The funniest part is that the sticker is so small that you can’t read it unless you’re right on their ass. I did some research and found that apparently that sticker does nothing in terms of releasing them from liability if someone is hurt or suffers property damage from crap flying out of their truck.

    In terms of being overserved at a restaurant. The restaurant is responsible to prevent you from driving (sometimes police have to get involved), or being served to the point of life threatening intoxication. The restaurant is supposed to cut you off before this point, and prevent you from taking alcohol with you.

      It's not just restaurants, retail employees at most businesses are also told to watch for signs of intoxication when selling alcohol and to refuse sale to anyone they deem too far gone.
      Though that distinction mostly comes down to your own judgment.

    The simplest way to put traffic incidents - if you enter their space, you're at fault; if they enter your space, they're at fault. A bit overly simplistic, but good as a general rule.

    The truck thing is the same thing for rocks in your windshield. Only problem is you have to proove you were not within the range of the sign. However a warning is not a contract if you can't read or can't see the sign because it's covered in dirt you definitely have a case as you were not warned

    My friend is allergic to gluten (highly allergic) and despite telling the restaurant this servel times they serve her something with Gluten. Does she have a case?
    Edit: Forgot to say the bread was at the bottom of the plate, under the rest of the ingredients. So at first she didn't see it, only after a bit she noticed the bread.

    I would think that the roller coaster could have a negligence case and that the problem lays in how much work it takes to prove.

      If the roller coaster performed as it was supposed to, and you hurt your back because you chose to go on a roller coaster, there’s nothing to prove. I think common sense says that’s not the amusement park’s fault.
      Now, if the roller coaster malfunctions and does not operate as it supposed to, that’s a different story. We actually had a six flags roller coaster case. It’s similar to an elevator case in terms of proof.

    Do I have a case, Mike? My employer hired me knowing I'm disabled. When I asked for accommodations that even non-disabled people get, my manager blocked them, causing my condition to get worse and resulting in me needing to work from home, then go on short-term disability. My manager's manager did not act to support me like he said he would during the several meetings I had with him to discuss the difficulties with my manager. I am now completely housebound and mostly bed bound, unemployable and unable to work.
    I filed an EEOC complaint, and my company offered me $12,000 to get me to go away. I declined. Have not had the energy to follow up, however.
    So, do I have a case?

    I got served raw chicken from cookout once and got salmonella. I really want to sue for that I had witnesses and they just gave me a free meal. Since I was in college, I thought I’d be okay…. I wasn’t 😅

    The side swipe is interesting. I've seen a lot of truckers do wide turns and be real assholes about it. Not all of them are like this but many act like bullies and get pissed off that people don't leave room for them even if no one saw them coming. I've hsd situations where they barely give you time to back up and communicate to the 5 cars behind you that they need to back up. I've genuinely wondered how that would be handled if they hit someone.

    Yep I had a dump truck back into me I was 20 ft away it said stay back 10ft…why it decided to back up??? Because it was a couple feet into the T bone intersection … and we won our case!!!
    Apparently they didn’t design the mirrors on the dump truck to see 20ft behind them :/ and it was a known problem. Are they going to fix it? Simply have to spray pain or put up a new sigh on the trucks…but no, it’s cheaper to pray out

    Its likely with the restaurant case they could turn around and say, no it was the distributors fault. I can imagine situations where this is a valid defense, for instance sushi. Assuming they stored everything properly and didnt act negligantly. Its likely they could turn around and say, hey, they were responsible cause they sold us contaminated product. Its their duty to make sure that doesnt happen.

    The food one i remember this,it was a Chinese restaurant we told them large plate of fries and two chop suey well they bring the fries and this guy covers them in a white powder i told my mom don't worry is that msg salt they use,yes it was and that fcking thing was contaminated my mom puke so much body water and food she needes 3 bags on Serum(suero) to get fcking salt and water in her body i enter a fcking intoxication state so bad i needed to be pumped...the fcking place disappear after the law suit was made and this happen 7 years ago, the police never find the owners but did find the waiter who was an immigrant so he didn't know it was contaminated poor guy he was crying when they found him and the police brought him to court

    If the food gives me the shits, the absolute most I will ever go for is a refund, and that's if I'm willing to bet it was, in fact, that food, and it wasn't a level of shitting normal to me after eating that food.
    Suing a business because my tummy can't handle spice or a large mocha would be... shitty.
