This is really annoying for other dev, including myself, I am a solo dev, about to release a trailer for my dream game(not aiming kickstarter - just early access on steam), before that I had experience in game industry for the past 10+ years in AAA companies... now I use some art assets from store, I am a game designer not a modeler/texture artist (so i slowly replace them or modify them but it's taking ages and some of the model just work fine and fit my overall visual style, I spend 80% of my time on the coding and game design). And I m super concerned to release the trailer. So just to mention here, not all dev using marketplace assets are bad dev! (But Fntastic is... don't give them money, they got their chance multiple time and screwed it up).

honestly it's very likely is just a scam but those assets were just normal, there is nothing that develops the game for them there. It's almost unavoidable for indie devs to use assets because there are things we just don't know how to do, cannot learn easily and we don't have infinite time. Even AAA companies use assets, i've seen videos about tree assets used in red dead redemption 2 and building assets used in elden ring, so of course games made just with assets are bad but the use of assets it self shoud not be criminalized in this way

No, you're not a scammer. These assets are there for people to use in games and other projects. If nobody used them, the asset creators wouldn't make any money. Plenty of indie games use bought assets without anyone complaining. Where it becomes a scam though, is if you go out there claiming these are your own assets that you worked on and/or if you just put random bought assets together and then release a broken game.
People these days just go "WAH WAH" at any "they used assets" Asset flip used to actually mean you take a wholesale game from the Asset store (e.g. there's that Roblox/Unturned-esque zombie game) and just release it as a game. When it's just meant to - show you how to put together a game - demonstrate the other assets in the pack - build upon to make it into your own game But instead of doing any of that they shoved it out as a finished game, with well, very little to actually do cause it wasn't meant to be a fully fleshed out game.

Apple and other companies even offer free UI Kits to help with app development designs. Have you never used a template for a document, excel file or a presentation? Regarding the point about refunds: 1: They never got paid from Steam in the first place, Steam only pays Devs the following month after the game was sold. 2: While the whole thing about Steam taking a cut is correct in general we do not know how Valve handled it in this specific case, because Valve suspended their regular refund rules for this one game and approved all refund requests for it unconditionally.
But from YT content creators point of view it could be beneficial for them to continue to produce something/anything - it is additional source of so many potential videos on a subject :D Lets face it - we will never get Golem 2 or Rise of Kong 2 but these guys are still trying not to die as a company for some reason. Asset-flips in of themselves aren't bad, indie devs, who probably don't have a lot of money to hire artists, really benefit from being able to use ready made assets. So that isn't the main issue nor should it be imo, the main issue is that they don't use those assets to make a good compelling game for the price they're charging.

In a very simple way your 30% explanation is true but it goes a bit beyond that is very specific cases.... not that any of those cases would affect asset flip "devs"
