Great question. If the wreck was 100% the 18 wheeler's fault, there is a good chance that there is at least $750k-$1M of liability insurance available (possibly more if umbrella or excess policies are involved). With two surgeries, 6 epidurals, and extended PT/pain management, a reasonable settlement value should be well into the six figures. Of course, you have to consider things like (1) whether you had any pre-existing conditions (e.g. arthritis, degeneration, etc.), (2) the amount of property damage to the vehicles (does it look like a wreck that would hurt someone), (3) the location where your case may be tried (i.e. would the jury likely be conservative, progressive, or somewhere in between), (4) did the 18 wheeler driver and or his/her company violate any Federal Motor Carrier Administration regulations that could give you additional bargaining power, and (5) will your medical providers testify that the injury is permanent. We have handled neck and back surgery cases that resulted in million dollar+ settlements and verdicts but in most of those cases there were one or more doctors that testified that our client's injuries were permanent (at least to some degree).
