      I don't know what difference that ammo would've made...no matter WHERE the ammo came from, alec still pointed a gun at a human being and she died. I dont buy he didn't pull the trigger. I've shot firearms in target shooting that surprised me how easily they went off.

    I worked on film sets for almost 30 years on many action movies and tv shows with a lot of shooting of prop guns. It is the responsibility of the armorer and First Assistant director to check and clear all guns before they are given to an actor. And as a cameraman, I had empty or "cold" guns pointed toward me for a particular shot. It was not Baldwin's fault, and he never should have been charged.

      There’s also a lot of justice. This is an example of both. The rule of law prevailed here, but at the expense of many, because a prosecutor made the decision to pursue winning over truth.

      A good judge would not dismiss this with prejudice because the issue was not favorable to the defendant. The source of live ammo on swt does not in any way vontribute to recklessness or lack thereof of Baldwin's handling of the firearm.

      ​@lorihutchins8897 You're missing the point as well. Brady evidence, by definition provided by the judge herself, must be "Favorable as exculpatory or impeachment evidence" for the defendant. The issue of the live ammo getting onto the set has no relevance towards the question of recklesness of Baldwin's handling of the firearm. It is not in any way potentially exculpatory and is only potentially relevant as impeachment evidence when it comes to the live ammo making it onto the set, which is, again, irrelevant towards Baldwin's recklessness or lack thereof in handling of the firearm.

      @@Igor-ug1uo As the other person mentioned, it's not really about how relevant the evidence is, necessarily (it only needs to be *potentially* exculpatory, or could *potentially* have altered the defense's approach to the case - it doesn't need to be *literally* exculpatory). Either way, it's not the police's (nor the prosecution's) place to decide how relevant a piece of evidence actually is; it has to be turned over to the Defense regardless so the Defense can examine it themselves (and can then argue for its relevance), and if you don't allow that to happen until the middle of trial (and try to hide it altogether until the Defense forces your hand), then it's a Brady violation, and Brady violations are a serious issue. The Defense needs to be able to see *all* of the state's evidence so they can make their own determinations - so they can examine the evidence, so they can argue about why they think the evidence *is* relevant, so they can call certain witnesses to testify about that evidence, etc.
      Imagine if the police had instead found the exact bullet that caused the death but then hid that bullet from the defense - that would be a huge deal. In the case of this ammo, you could argue that it's less important because it's not directly tied to the set (as far as we know, anyway), but you'd still have to hand it over to the Defense regardless so they can make their own determination about how important *they* think the evidence is. How are they supposed to know that it's not relevant if they don't even know it exists, because the prosecution hid it from them altogether?
      Though IMO, I kinda think the state/police may have actually believed it *was* relevant, because why else try to hide it and never mention it? If it was truly irrelevant and didn't hurt your case in the slightest, it would've been *trivial* to let the Defense know about it. Why put it in a separate file altogether? I think the Defense attorney was trying to hint that perhaps Seth Kenny himself is the one who brought the live ammo to the set, and perhaps he even *purposely* made sure that the live ammo was mixed in with the dummy rounds, perhaps because he had something against Gutierrez-Reed (or maybe against Baldwin himself?). Obviously that doesn't change Baldwin's involvement with the incident, but I think it *could* have a pretty big impact on how the Defense argues their case. Therefore, Brady violation - therefore, dismissal. Though I also think the Judge was already pretty frustrated with the prosecutor for various other things prior to this, and this was just the nail in the coffin. The Defense attorney brought up the numerous other issues when he questioned Morrisey himself, and I think the Judge agreed with him on those other issues as well.
      The Judge also brought up another issue: some of these live rounds looked basically identical to some of the dummy rounds, so even if Baldwin *had* checked the rounds himself, it's quite possible that he could be looking at a live round but easily mistake it for a dummy round, so it wouldn't even have mattered if he had checked the gun - especially when he already had both the *expert* and the AD tell him it's a "cold gun." The guy who makes the "reloads" (was it Kenny himself? I forget) was apparently known to mix the primers between what would normally be the live rounds and what would normally be the dummy rounds, so now the dummies and live rounds look 100% *identical* unless you shake them, and I don't think anyone would've expected Baldwin to actually take out each individual round and shake it, so even if he had checked the gun himself, this death still could've occurred anyway. And that could be a *huge* point for the Defense to focus on, but they can't do that if they don't know about this evidence in the first place.

    This prosecutor lacks self awareness. She had to sacrifice her case cause her Ego is too big. Nobody asked her to testify, she wanted to stick it to the judge ends up backfiring on her. Obviously her Proctor spirit had to be exposed 😁

      @@chrisvincent8226 well, no where did I mention this defendant in particular. I empathize with every defendant that had to experience this. Prosecutorial misconduct happens often but that does not make it normal nor acceptable. Erlinda Johnson is a great example of what a prosecutor should be. Watch her interview, she explains the reason she quit mid trial. She realized at that point she cannot be prosecuting while breaking the law at the same time. Morrissey on the other hand had no shame taking the stand and gaslighting everyone in the courtroom, that to me sounds like a fame hungry prosecutor.

      Not to the NM law and the guidelines for actors. Both make no exception for actors handling firearms. Both require actors and anyone else to follow basic rules of firearm safety.

    I’m glad it got dismissed. I never thought it should have been tried. Based on how they were supposed to judge him it just didn’t seem right. And then as the trial went on it just seemed messed up.

    Alec B was just an actor that was given a hot gun that accidentally went off. The only wrongdoings that was prosecutable was the armorer not keeping the movie set safe.

    I agree. The dismissal does not prove or disprove that Mr. Baldwin is guilty. The dismissal is a punishment of the prosecutors for not playing by the rules. You have to play by the rules. If not, you lose. Justifiably so….

      In my mind this shows more than likely Seth Kenney provided the round as a dummy. Hannah failed to catch it. The assistant AD and Alec got screwed over as they were trying to make a movie thinking they were operating safely. Oh and Sarah Zachary should be in jail too for destruction of evidence. Everyone conspired to go after Alec as a scape goat. This whole thing was nuts and they could only fool some of the people for so long.

    The judge was key… the problem was the live ammo Teske turned over looked just like the dummy ammo used on Rust. Seth Kenny was the supplier of ammo and he drug ammo all the way to Texas , New Mexico, and Arizona. And it could have gotten mixed in with the ammo to Rust. The prosecutor and the sheriffs officers agreed to file this evidence in a different case # than the case # for rust. They buried it. Didn’t tell the defense and didn’t show it as evidence. Absolutely incredible. They should all be fired! In the middle of all this, the other prosecutor resigned and left the courtroom. She said she was not aware of this and was not going down for it.

      The prosecutor and the officer(s) should be charged for their misconduct. The Gutierrez conviction might get overturned for this as well. I wonder how many other times that officer "misfiled" evidence that could have saved someone from jail?

      ​@@tqlla I think it was obvious in the Gutierrez trial that the cops were sloppy, lazy and incompetent, and overlooked evidence. One big one is they failed to collect all the possible evidence from the scene of Rust because they couldn't get their heads around the fact that live rounds could have brass primers and not just nickel ones.
      It was obvious to me, and I was hoping it was obvious to the jury too. Evidently it wasn't obvious to them as they convicted her.
      I'm sure her lawyers will file a motion to vacate the conviction, but I am not convinced it will happen. I'd like to see it though.

    I don't think the actor should have been charged in the first place. How would he know whether there was live ammunition put in the gun? It's not his responsibility to determine that. That is why they have professionals on scene to take care of that for him. Whom ever gave him.the gun with the live ammo should be responsible. I think the prosecutor charged him because he was a high-profile actor. I don't think he would have been found guilty regardless.

      You are wrong. Sorry. It’s a basic gun safety rule. Always treat a gun as though it’s loaded. I hope if someone handed you a gun and said it wasn’t loaded that you would be smart enough to double check before pointing it at someone.

      @@crystal6767 She is 100% correct, film sets follow a specific protocol. While I agree with you, in normal/ everyday life one should always assume a gun is loaded, however on a movie set an actor has no reasonable expectation that 1) a gun said to be “cold” is indeed loaded and 2) loaded with live ammo. He never should have been charged as an actor imo.

      @@crystal6767 - How would an actor know whether dummy rounds, blanks, or live ammo was loaded in a gun? They wouldn't. That isn't an actor's job to know or determine that. They hire people to make sure everything is safe when handling guns. That's their only & entire job. Anyone handing an actor a gun should have checked them before they ever got into the actors hands.This is why live ammo should never be on any movie sets. It was a freak accident & not the responsibility of the actor's to know the difference.
      As for anyone handing me a gun, well that's irrelevant. It has nothing to do with actors on set playing a role that requires a gun. If I was the actor being handed a gun, I would assume the people hired to make sure it's safe did THEIR job & checked the guns.

      It is union protocol for the actor to check the gun with the armorer and verbally confirm aloud after inspection that it is clear during the hand off. He broke protocol and didn't check the barrel. He also broke mandatory safety protocol pointing it at people. Actors have rules they have to abide by written in stone by their union. Had he done his job she'd still be alive. He's the last stop in the safety sequence, others failed as well to abide by the protocol for their roles. They are guilty as well.

    Concealment of potential exculpatory evidence is absolutely a justifiable cause for dismissal. Had things been the other way around and the defense had deliberately concealed inculpatory evidence or suborned perjury, that would end up in a criminal charge.

      that lawyer has integrity. Her interview with Cuomo was awesome. If she had been in charge of the case- it would have been different and this wouldn't have happened. Plus her demeanor is a lot better than Morrisey's. Morriseys personality and vibe screamed vendetta against Baldwin. He didnt mean to kill Helyna. ITs a horrible situation. I think Dave Halls should have been held more accountable - 6mth probation? Plus with an inexperienced armorer and you are supervisor.... you better supervise and check her work.

    The judge never told the prosecutor she was going to testify. She tried to tell her not to be she did it anyways.

      I think she *did* tell her that when Morrisey said something like "now if Mr. Spiro wants me to testify under oath..." and then the Judge cut her off and basically said "you *will* have to testify under oath!" (but I think she moreso meant "you *will* have to testify if this continues in this direction") and Morrisey said "I'd be happy to!" But then right before doing it, the Judge was trying to warn her not to - I think mainly because the Judge had already decided to dismiss the case by this point, and she knew that anything Kari admits to under cross-examination only has the potential to ruin her further. No explanation from her at that point could've saved her case, so it'd be better to just call it a day and hope you can move on from it without being disbarred or something.

      @@matthewdekker6064 Judge said if she (Morrisey) want to impeach Spiro theory (That those ammo is valid evident) she would have to testify, but then Spiro want to rest, and the Judge then told her you don't need to. She said she would love to, and then the judge tell her she should not and no one is forcing her to.
      The difference between she talks in court and not, is basically admitted wrongdoing on her part in an open court, it will (rather can) come back and bite her, this is like Baldwin ABC interview but worse because it does have legal consequences. Depends on how far the judge want to go and Spiro want to go, she could go to jail on Perjury. If Spiro really show her who she call the "p word" and the "c word" with to impeach her.

    It was obvious from the trial of the armorer the prosecution didn't really understand the movie production process or prop guns/ammo enough to successfully prosecute Baldwin. They never had a handle on the chain of possession of the live rounds. A huge waste of money and resources. In the end the lead prosecutor looked inept and shifty.

    At worst this prosecutor willingly withheld crucial evidence from the defense and at best she was as negligent in her duties as Hannah Gutierrez was with her responsibilities. Either way, both of these individuals are horrid at their profession and should never be in a position where their judgment has this much impact on the lives of others.

    What this means is that the D.A. is boned. Not turning over potentially exculpatory evidence is a good, quick, and solid way to lose a law license. And I recommend the NM State Bar bring up the former D.A. for suspension or disbarment. This is, plainly and in a word, unacceptable.

    The prosecution hid exculpatory evidence by putting the evidence in a separate file. Time to leave Mr Baldwin alone. Let him go on w/his life. It was a tragic accident, not an intentional act.

      They did go on and on about his behavior trying to make everyone think that. Well his behavior and his arrogance is irrelevant. He was rehearsing with what he thought was a prop. It was bad prosecution for sure. And what if he was guilty, she threw the case in the toilet. But I can’t figure out what he’d be guilty of. Glad it’s dismissed

      I agree and I’ve been wondering who watches the armorer. One movie under her belt does not make her experienced. Where does she get trained and who over sees the young armorer on the set. Who mentors that person while they gain experience. They put her in that job because of her seasoned father. She was directly incompetent and deserved her verdict. Now they might actually get her verdict overturned.

      All dummy bullets have visual and audio verification. The armorer failed to inspect each bullet, visually and audibly. It was complete incompetence and negligence on the part of the armorer. Movie productions hire an armorer to ensure the safety of all weapons. That is what they are paid to do. Alec Baldwin is completely innocent.

      This is ridiculous, I agree Alec did not mean to hurt anyone, but he did. He was acting recklessly with a gun and his actions resulted with someone being killed. I'm not surprised he walked, I knew he would from the beginning because he is rich and famous. If I did this, they would lock my ass up because I'm not a celebrity, what a joke.
      If he followed any 1 of the 3 most basic rules for firearm safety, that woman would still be alive, I knew this as a child and unlike Baldwin, I never shot and killed anyone because of it

    Im glad it was dismissed. There never should have been live ammo on the set in the first place. I dont believe he should be held responsible for holding and shooting the gun. If the armorer didnt have live rounds on set, the gun wouldnt have a live round in it.
