  • @wardenxghost9113
    @wardenxghost9113 3 ปีที่แล้ว +758

    In my opinion I think TH-cam should just leave content creators alone and let them have fun on their platform as long as it's legal content. Deleting someone's channel entirely is an over exaggeration, and these 4 issues you've pointed out can be dealt with in a more humane manner then to just unperson them. Although, since TH-cam has become the grim reaper of free speech, I honestly don't expect anything less from them.

    • @danielels224
      @danielels224 2 ปีที่แล้ว +8

      That solely depends on what the content of the video is. In most cases You Tube gives you strikes before they delete your channel. As for when it comes to creation of video's, Google are paying for the servers that are running You Tube and therefore we are obligated to follow their rules. We may not like it, it is just how it is. You Tube has a very difficult task of keeping the advertisers, the government and us creators happy at the same time. I do not envy You Tube CEO's job. You Tube is far from perfect but I believe that their are great people working at Google that will improve You Tube as time goes on and hopefully the guidelines and ways of making content will improve. To answer your comment You Tube does not just delete your channel they do however give you a strike depending on the violation. If you feel they unfairly gave you a strike you can always file a dispute. I would advise getting a lawyer's advise when doing that. I am not a lawyer. My point in all of this is that TH-cam is not a perfect platform and that you channel do not just get deleted their are channels that need to go through before that happens and I do not think that TH-cam will intervene if deem it necessary.

    Really great information. I need to make an update on my channel based on one piece of information you shared...appreciate that. Regarding the use of music that you do not have rights to. In most cases the copyright owner will just issue a copyright claim on your video and all ad revenue or partial will go directly to them. There are few that will demand TH-cam to take down the video in which case TH-cam will issue a copyright strike on that channel but it really all depends on the copyright owner. I would say that the use of music isn't always a bad idea, it's just best to know the copyright owner's rules and stipulations of use.

      Shorts have a feature called Remixing. Creators can choose to turn on or off Remixing on their long form videos, but most Shorts are made available for Remixing. Because this is a TH-cam feature, its perfectly fine to use those short clips of audio or video so long as you do it via the Remix tools. Taking that same content and reusing it outside of the Remix tool could get you into copyright issues.

It looks more like they think the spam messages will contribute to making their comments look more "active" or something, and will often make a point of not removing anyone, almost ever. I'm almost convinced some of these people have paid people to spam all responses with irrelevant answers. Cuz it still looks like activity.

      Copyright Music
      Xyz by xyz (2020)
      Does this pass as copyright permission? If not, what can be done if you really need to use a particular non-copyrighted music?
      Thanks.

    • @chrisdunnettmusic
      @chrisdunnettmusic 2 ปีที่แล้ว +8

      @@Enewerome_CQ Hi, no that does not pass for "permission" that is merely an acknowledgement of who owns the copyright. Some do that as their own "disclaimer" but that really doesn't protect you under law just gives you slightly better escape plan LOL
      The second part of your question I don't really understand? "Non-copyrighted music"? By definition that would pretty much only be music in the Public Domain such as a Mozart piece or some ( but NOT ALL) Christmas Carols etc... If it's Public Domain you don't need permission at all...you don't really even have to credit it but it's still the cool thing to do ;)
      The bottom line is if someone owns the copyright, get permission (which may involve paying a license or Sync fee - depending on the status of the song). The last thing you want to do is put a great deal of work into a project only to then get a Cease and Desist and lose that work.
      Fortunately though, and I can't speak for all, but many Copyright owners allow YT to monetize their music even if THEY are not the ones posting it. For example, (and this is JUST an "example" I can't say for sure) but let's say you use a Madonna song in your video. Can Madonna and/or her Record Label make you take it down? Absolutely! Will they? Probably not as they would rather leave your video up and hope it goes viral because they then will collect the money from their song playing in it. YOU wouldn't be able to monetize that video but they can. Again, I just chose "Madonna" as an example. Hope this helps, cheers,

      Now that's not true. Fair Use does exists in UK and is called Fair Dealing. You can look more up on it on gov . uk, exception to copyright page (comments with links are sometimes held for review). Here is an excerpt:
      -------------------
      Factors that have been identified by the courts as relevant in determining whether a particular dealing with a work is fair include:
      1: does using the work affect the market for the original work? If a use of a work acts as a substitute for it, causing the owner to lose revenue, then it is not likely to be fair
      2: is the amount of the work taken reasonable and appropriate? Was it necessary to use the amount that was taken? Usually only part of a work may be used.
      The relative importance of any one factor will vary according to the case in hand and the type of dealing in question.

    I just found out recently that TH-cam doesn't even like when you do a cover of a song, even if you created the music 100%. Their software actually recognizes the songs immediately. They have allowed my covers, and even the songs in which I downloaded the music & sang live. The "copyright claim" comes up immediately. Fortunately, all of the songs I've covered have been allowed by the copyright owners. On the bad side, if they ever change their mind & don't allow it, TH-cam will give you a copyright strike, even though it was allowed when you posted the video.

    • @NickNimmin

      It would be super rare that once you get a claim that it would get upgraded to a strike in the future.

    • @JunkBondTrader
      @JunkBondTrader ปีที่แล้ว

      the claim comes from the owner of the song not youtube. All it usually does is send the revenue from the vidfeo to them, or, they can request removal of it which is rare. But if they do you you can remove it, all is ok. OR you can dispute it lol but if you lose the dispute you get a strike. I cover a lot of Elliott Smith songs, who passed in 2003. The owners of his music, whoever they are have been super chill. They claim some, and leave some alone completely, never ask for removal.

It seems to become increasingly hard for new content creators to gain an audience, because these rules create a gate that separates people that are just starting from the ones who are already at the top. While they teach us to navigate a system, that's constantly trying to tighten the pipeline. TH-cam will let you use other people's music sometimes. I've used music and been notified that it's not a strike, but that any monetization will be given to the owners of the song. I'd love clarification on when you can do this (if you know.) I think it's a great idea as the song owners can potentially get money for doing nothing. This is certainly a preferable solution to striking people, muting sound in the video, deleting videos, banning channels. I'd gladly make more videos with copyrighted music and therefore give up all monetization if I knew a little more about how to do that safely.

      Google does take action where their trademarks have been used without permission. They have a whole policy devoted to that.

      @@NickNimmin Thank you for responding, but the violations are broad and conspicuous. Do you actually know of anyone or any channel that was impacted by that? Apparently you can sell the TH-cam logo on shirts, coffee cups, and anything you want to. Is there a way to report it to see if it's legit?

    Nick, thank you so much for all your advice. When put into practice you do see results. My channel is growing and it’s because I’ve taken your words so seriously, along with studying TH-cam and patients. I’m still learning a lot and fully understand that this will take time. Peaks and valleys.

      It's your THUMBNAILS. Thumbnails are almost EVERYTHING.
      Don't get me wrong, quality content is Important, but you Need to get people to click on your video in the FIRST place to even worry about the content.
      You NEED to put more effort in your thumbnails. Make them more attractive, add some words or graphics, do something.
      *Just work on your thumbnails because they are very unappealing!*

    I often see a lot of people that talk about celebrity gossip using tag stuffing in their descriptions a lot.

    Definitely some great information here. There are a lot of 'TH-cam Hack' style channels out there with false, misleading or outright incorrect information out there, and some of them even recommend 'tag stuffing' as a method of increasing search visibility so I really appreciate you debunking that method and saving a lot of fledgling channels such as mine from being deleted due to incorrect advice. So thank you very much Nick and keep up the excellent work!

    Thank you for clarifying and confirming these no-nos/rules.
    I never got to follow through with the first channel that I wanted to do a couple years back. But i'm thinking of starting or just having my own personal one. But there is a touchy topic. Before I upload that video, I need to know if there's any wording that is taboo. I will head on over to the TH-cam Academy and check into this. Thank you.

    Thanks, Nick. I never thought this stuff would completely ban channels from the face of YT 🤯 I kinda thought they'd just delete whatever they did.

      you get three strikes typically, and they expire after 6 months I think, or a year? then they ban you.

    Very hopeful information, thank you for sharing it. Yes the background is a detractor. Makes it hard to focus on the good quality information you're sharing.
