The thing with trademark is that if you don't defend it, you lose it. So she's absolutely not just a buzzkill. There's a chance that if she let it slide, she would have lost her trademark entirely.
That’s a fair point, except I think it’s really hard for that to happen, like it needs to enter common language and even than it takes a lot for the trademark to be lost, like how a lot of people in Britain call vacuums Hoovers whether it’s a Hoover brand vacuum or not but Hoover still owns that trademark, a trademark that was actually lost is Escalator since it eventually just became the common name for a moving staircase and not a brand name
The thing is you are right, if she legally doesn’t defend the trademark of her name then she loses rights to it. Something like escalator is a name which now describes an object but this is directly correlated to her as her brand as a living person. 🤷🏻♂️
Exactly so. Even if someone tried to argue that it was a parody, another person who wants to exploit the copyright can argue that she let X or Y slide, so the copyright is now invalid and at the very least, becomes far more difficult to protect in court.
1 you're correct about losing IP, that is also the reason free servers for otherwise defunct/nonpublished any more games get served with takedowns for example 2 there's a whole fiasco with fortnite over this right now (selling famous dance emotes...who gets the cash) the precedent so far set seems that only dances that meet certain categories fall into being trademarkable and so far none seem to have been found to tick every box of that category. so this sets a precedent in the US even if it's chronologically like 10+ yrs later people are right about the song being plagiarized too though yep and you are right about how you have to be an asshole for copyright in order to keep it just thought i'd add that part about the fortnite dances because i read about it recently and it got me started thinking about this gray area, because that's what it is.
Yeah, I actually agree with Gaga's team's point. There's a difference between an affectionate parody character, and a massive monetized campaign that crosses into her field, leans very heavily on the parody, and doesn't have any obvious disclaimers.

But you better do it now before it's gone forever!" So children see this and it flips a switch in their brain where they realize in a panic "I *need* this thing, otherwise I won't be cool/popular/happy!" but since they generally don't have money for the thing, well that's where parents factor in; "Mom and/or Dad has money, *they* can buy it for me!" So the child begs, pleads, tantrums for the item... whatever will work to get what they want, and the parents will buy it for them, and that money goes into the deep pockets of those at the top of the corporation.

Me and my friend literally started an entire 'economy' based on getting moshling figurines from people who'd outgrown them and then selling them to kids just getting into Moshi Monsters who wanted to get everything. We made 20 pounds in a week, meaning, as 8-9 year olds, we were billionaires. People with older siblings and cousins who handed their Moshi goods down ruled over the playground with an iron fist. Teachers and parents cracked down on it fairly soon, meaning if you weren't part of the original wave, you were just left with a bunch of moshlings and nothing to show for it. It was a very interesting week and a half.
I remember what you had to do to earn Lady GooGoo in the game. Context for the unfamiliar: They had missions or whatever for members to solve little mysteries and at the end you could get moshlings as prizes for completion. And I DISTINCTLY recall the Lady Goo Goo moshling being gifted after a mission where you’re in the woods and there’s this cabin in a tree or something and you have to mix potions for some reason in some weird click and point format. So this video really unlocked a lost memory haha

sablelioness i think weird al is fine because he gets permission from every artist he parodies before making the song. additionally all his songs are humorous in nature and make it clear which song he’s parodying. moshi monsters was using the song and character in a serious manner to promote their own brand without offering much credit. i hear bad romance when they sing “let’s do the moshi dance”, which sounds like the same melody of “caught in a bad romance”.
How is "Moshi Dance" serious? =/ It should be noted that you don't NEED permission to parody anything, at least not in the US. Weird Al does generally because he's a nice guy, but especially after finding out he didn't actually have permission from Coolio to parody "Gangsta's Paradise." It was still perfectly fine for him to parody the song, though. Also, just looking at "Perform This Way" in a vacuum (not taking who Weird Al is into account), the song *appears* to take jabs at Lady Gaga... which may be one reason why her legal team originally told him no. =/ I think artists should be allowed to parody what they want. Freedom of expression, you know? Whatever similarities there are between Gaga and GooGoo... I mean, that's kind of the point of the parody. The songs just do NOT sound that similar to me, and I think her lawyers were kind of malicious by using UK copyright laws regarding a US pop star.
sablelioness it’s serious in the way they used it to promote their own brand. there’s a point where it ceases to be a lady gaga parody and becomes an original creation that is ripping off copyrighted work. for many weird al songs, such as “perform this way” and “smells like nirvana”, it’s necessary to be familiar with the source material to understand the joke. it can’t ever be fully separated from being parody. in the case of lady googoo, she was being treated as an original creation, to the point where some of the children playing the game wouldn’t be able to tell she was a product of someone else’s work. i don’t feel it’s malicious for the lawyers to be using UK laws when suing a UK company just because lady gaga is from the US. moshi monsters also parodied justin bieber, so if his lawyers sued them would they have to do it by Canadian laws? i can’t really help you to hear how the songs are similar over text. it’s not the entire song, it’s the opening part played in the video. “let’s do the moshi dance” and “caught in a bad romance” have the same number of syllables and are falling on the same beats. but i guess that just furthers my point that they used a melody from a lady gaga song and lady gaga is receiving no credit for it.

I had the ds version of this, it was actually great. You didn't have to buy anything, it had cool minigames, and you had to figure out where the Moshlings were hiding and lure them out with things they liked to eat. It was fun, but then again, I was like 8 when I played it... Finding the Moshlings does get pretty tricky though!

I... highly doubt that. Her lawyers were kinda sue-crazy and didn't give Weird Al permission to officially release his parody of one of her songs. It was only after the song was uploaded online for free that fans heard what was going on from Weird Al himself, Gaga spoke up and gave him permission, and her lawyers backed down. I really don't think a cutesy cartoon clearly meant to be a parody (as the site had other parody characters as well) would really have harmed her brand. Then again, I don't really feel bad for celebrities filing frivolous lawsuits.

elder millennial here and I actually remember this pretty well, because it happened at the same time as a bit of a kerfuffle with her and Weird Al Yankovic which is what i think *really* gave people the image of gaga/her team being thin skinned and humorless. Mmm... I don't think miscommunication was the issue. Lack of communication, maybe - that I would buy. If I remember correctly, it was ONLY after Weird Al put the song online for free that Gaga said anything and the lawyers backed down. I always thought it was hilarious when I was young, and recognized it and KNEW immediately. Moshi monsters was for 2012-2015 kids, when Lady Gaga was at her HIGHESTTTT. Kids today ALSO would know her cause she’s still known. Idk what the heck your saying “what kid would understand the reference”, so many kids would, I thought it was hilarious and everytime I saw it when I was younger I’d call over my mom and be like “LOOK! LOOK! LADY GAGA! BUT ITS LADY GOOGOO!”

The thing with trademark is that if you don't defend it, you lose it. So she's absolutely not just a buzzkill. There's a chance that if she let it slide, she would have lost her trademark entirely.
That’s a fair point, except I think it’s really hard for that to happen, like it needs to enter common language and even than it takes a lot for the trademark to be lost, like how a lot of people in Britain call vacuums Hoovers whether it’s a Hoover brand vacuum or not but Hoover still owns that trademark, a trademark that was actually lost is Escalator since it eventually just became the common name for a moving staircase and not a brand name

The thing is you are right, if she legally doesn’t defend the trademark of her name then she loses rights to it. Something like escalator is a name which now describes an object but this is directly correlated to her as her brand as a living person. 🤷🏻♂️
Exactly so. Even if someone tried to argue that it was a parody, another person who wants to exploit the copyright can argue that she let X or Y slide, so the copyright is now invalid and at the very least, becomes far more difficult to protect in court.
1 you're correct about losing IP, that is also the reason free servers for otherwise defunct/nonpublished any more games get served with takedowns for example
2 there's a whole fiasco with fortnite over this right now (selling famous dance emotes...who gets the cash) the precedent so far set seems that only dances that meet certain categories fall into being trademarkable and so far none seem to have been found to tick every box of that category. so this sets a precedent in the US even if it's chronologically like 10+ yrs later

Yeah, I actually agree with Gaga's team's point. There's a difference between an affectionate parody character, and a massive monetized campaign that crosses into her field, leans very heavily on the parody, and doesn't have any obvious disclaimers.
And it's not like Moshi Monsters was a poor widdle company with barely any revenue.

But you better do it now before it's gone forever!" So children see this and it flips a switch in their brain where they realize in a panic "I *need* this thing, otherwise I won't be cool/popular/happy!" but since they generally don't have money for the thing, well that's where parents factor in; "Mom and/or Dad has money, *they* can buy it for me!" So the child begs, pleads, tantrums for the item... whatever will work to get what they want, and the parents will buy it for them, and that money goes into the deep pockets of those at the top of the corporation.

Me and my friend literally started an entire 'economy' based on getting moshling figurines from people who'd outgrown them and then selling them to kids just getting into Moshi Monsters who wanted to get everything. We made 20 pounds in a week, meaning, as 8-9 year olds, we were billionaires. People with older siblings and cousins who handed their Moshi goods down ruled over the playground with an iron fist. Teachers and parents cracked down on it fairly soon, meaning if you weren't part of the original wave, you were just left with a bunch of moshlings and nothing to show for it. It was a very interesting week and a half.

sablelioness i think weird al is fine because he gets permission from every artist he parodies before making the song. additionally all his songs are humorous in nature and make it clear which song he’s parodying. moshi monsters was using the song and character in a serious manner to promote their own brand without offering much credit. i hear bad romance when they sing “let’s do the moshi dance”, which sounds like the same melody of “caught in a bad romance”.

It should be noted that you don't NEED permission to parody anything, at least not in the US. Weird Al does generally because he's a nice guy, but especially after finding out he didn't actually have permission from Coolio to parody "Gangsta's Paradise." It was still perfectly fine for him to parody the song, though.
Also, just looking at "Perform This Way" in a vacuum (not taking who Weird Al is into account), the song *appears* to take jabs at Lady Gaga... which may be one reason why her legal team originally told him no. =/
I think artists should be allowed to parody what they want. Freedom of expression, you know? Whatever similarities there are between Gaga and GooGoo... I mean, that's kind of the point of the parody. The songs just do NOT sound that similar to me, and I think her lawyers were kind of malicious by using UK copyright laws regarding a US pop star.

for many weird al songs, such as “perform this way” and “smells like nirvana”, it’s necessary to be familiar with the source material to understand the joke. it can’t ever be fully separated from being parody. in the case of lady googoo, she was being treated as an original creation, to the point where some of the children playing the game wouldn’t be able to tell she was a product of someone else’s work.
i don’t feel it’s malicious for the lawyers to be using UK laws when suing a UK company just because lady gaga is from the US. moshi monsters also parodied justin bieber, so if his lawyers sued them would they have to do it by Canadian laws?
i can’t really help you to hear how the songs are similar over text. it’s not the entire song, it’s the opening part played in the video. “let’s do the moshi dance” and “caught in a bad romance” have the same number of syllables and are falling on the same beats. but i guess that just furthers my point that they used a melody from a lady gaga song and lady gaga is receiving no credit for it.

I had the ds version of this, it was actually great. You didn't have to buy anything, it had cool minigames, and you had to figure out where the Moshlings were hiding and lure them out with things they liked to eat. It was fun, but then again, I was like 8 when I played it... Finding the Moshlings does get pretty tricky though!

Her lawyers were kinda sue-crazy and didn't give Weird Al permission to officially release his parody of one of her songs. It was only after the song was uploaded online for free that fans heard what was going on from Weird Al himself, Gaga spoke up and gave him permission, and her lawyers backed down.
I really don't think a cutesy cartoon clearly meant to be a parody (as the site had other parody characters as well) would really have harmed her brand.
Then again, I don't really feel bad for celebrities filing frivolous lawsuits.

My dad bought it online for me when i was 6, i was upset about the lawsuit and i hated lady gaga and said very morbid things about her. I never actually got to see lady googoo in moshi monsters. I got a reupload of the moshi dance in my recommendations, that's what started it.

The thing is- they HAVE to protect the trademark. It's a "use it or lose it" situation. Defending the trademark is a big part of trademark law, and being permitted to hold that trademark. Frankly it makes sense they went after Moshi Monsters, and it wasn't unjustified. With how /big/ of a push they we're doing, the brands definitely could be confused for collaborating

i literally thought it was all a fever dream. i remembered getting a moshi mag with a code and gem thingy for lady goo goo. I also remembered watching the Moshi Dance music vid, then this lady rox chic came along. it was wild
watching this gives me an intense sense of nostalgia with a tinge of awkwardness realising the reality of what the hell I dedicated so much time to as a child
I mean, even affectionate parody characters have had to change names and stuff, so I'm not surprised about this. Reminds me of when I was in the MLP fandom and I was incredibly mad over Hasbro changing the name of the main character I wrote fic for (Coco Pommel to Miss Pommel, essentially giving her no last name out of fear Chanel would sue them once they started selling merch of her.
