The issue wasn't about basic law. It was about the policy of the shopping centre - which will vary from location to location. Not even a KC will know that without studying it for each mall.

Every part of Britain is owned by someone or some organisation, quite often by the Crown or local councils, even the pavement in a street is owned, so by your definition that places that are owned aren't public that would make it illegal to take any photos anywhere, and walking down the street would be trespass.

It was very noisy in that shopping centre. People talking loudly and shouting can be bad for mental health, but we can always walk away. That's what the woman could have done. Perhaps there was 'muzak' being played there too.

It's open to the public but still private property. As the building owner/occupier, they are perfectly entitled to refuse entry or eject anyone from that property at any time. So, in order to appear reasonable, they produce a policy or guide to expectation for anyone on their property. You then have a choice to either accept those conditions or leave. If you contravene their conditions, you may be asked to leave or the police may be asked to assist them to eject you. However, there is also a commercial consideration, if you start ejecting people for petty contravention, you'll very soon have an empty shopping centre!

Hi Brendan, this is the first of yours that I have had the pleasure of watching and it looks like a very good job. The interesting conversation with the cop who tries to do his best but does not understand that photography is not a crime and cannot be proscribed by anyone in any place that is open to the general public regardless of the ownership of that property.
What I do see is yet another good example of a police officer getting high value in service training!, if nothing else he will go away with a good deal to consider.
The second cop's proposition that you use a mobile phone to film so that you do not attract unwelcome attention would qualify you for arrest under the terrorism laws for covert surveillance!, I understand that his intention that you breaks the law, just his inane attempt at de-fusing the current situation by diversion. Anything at any cost to avoid addressing their own incompetence.
