    I believe they are referring to asylum cases. If someone obtains PR after filing for asylum, they might encounter challenges when applying for citizenship. However, anyone who entered the USA with a valid visa, such as H1 or L1, and later gets PR should have no issues when applying for citizenship.

    For topic discussed around minute 15 of the video - Reg. H4/H4 EAD processing with H1, with the Edakunni v. Mayorkas ruling of Jan 2023, the H4/H4EAD processing happens alongside the parent H1B, be it premium or standard. With this ruling, they are no longer decoupled. My wife got her H4/H4 EAD along with my H1 earlier this year. It's a court ruling/settlement agreement, so my opinion is that the new administration would need to have some new tricks if they want to try to decouple them again.

      Edakunni v. Mayorkas ruling has an expiration date of Jan 18, 2025 as per the same settlement text. After that date USCIS would no longer be required to adjudicate H1/H4/H4EAD together, as the case has been as per this ruling. Please validate this information that I provided here!

    Hi Mandar! We are a 501c3 nonprofit church and I want to say thank you for the information you are providing! Very helpful! I did notice that you haven't done a new R1 (EB4 I believe). I'd love to see if they have any changes since then! I know we have been a 501c3 for 1 year and I want to be prepared and start now because the immigrant has to wait 3 years and certain countries are taking longer than others from what I understand. Anyways, appreciate your work on this! thank you!

    Hello Mandar. Based on your recommendation, I did premium filing of my EB1A and just got it approved. My PD is 2nd August 2024. By When do you think the I485 filing date will be available for me? My L1A will max out in Jan 2029. Second question, do you think EAD will be given to I140 approved cases in the Trump organization? Look forward to your reply.

    To your question on the USCIS update -
    Before this update, immigrants applying for U.S. citizenship had to prove they were lawfully admitted to the U.S. as permanent residents during all entries or reentries into the country. This was confusing, especially for those who traveled abroad and returned multiple times.
    With the new policy, USCIS will only look at whether you were lawfully admitted or adjusted to lawful permanent resident (LPR) status during your first admission or adjustment. You no longer need to prove lawful status for any trips or reentries after that.

      AP is not a guarantee. Read the fine prints.
      Everything related to immigration is stipulated so stop being fearful. If you have not done anything wrong then you shouldn’t have any problem.

      Trump vetoed a bill passed by a Republican Senate in 2020 that would have resolved these issues.
      The idea that only Trump can do it when he was the one who prevented it from being fixed in the first place is hilarious.

    Hi Mandar- as always very insightful video…On H4 EAD, if they revoke is it possible that anyone who has their EAD active or being processed will get cancelled with immediate effect? Or does that get revoked post the last date of the currently active EAD?

    Hi Mandar Sir. Thanks for providing this useful information. Could you make comments on my situation? I came in the US in April 2019 on J1 to do post doctoral studies as I have a PhD in Bio Science. After 5 years I got approved H1b sponsored by my University recently. My visa stamping is yet to be done and I got my consular appointment in mid February 2025. May I expect some problem having the visa stamped during that time? The question remains the same for my family for dependent visa. Thanks in advance.
