Hi, Atty! Just wanna share what I just learned from Aldaba v. Roque (GR No. L-17304, 1922) as to the numbering of pages correlatively in letters (48:20 in your video). The SC held that such requirement "may be attained by writing "one." "two," "three," etc., well as by writing A, B, C, etc." Hehe I watched this video po kasi last Aug, and I remembered it now as I was reading for my Succession class later. Thanks, Atty! I'm a fan

@@TheHowsofLaw Sir, nagtanung na po ako sa LEB pero di pa po sila nagrereply after 3 months na. Maari po ba akong makapag Juris Doctor kung ang undergraduate ko ay natapos ko sa ibang bansa po? Nag email po ako sa ibang law schools, all of them told me na to go ask LEB po. I am now studying with AMA online in case na di po tanggapin credentials ko dito. More powers po Atty. Sir, first of all, I really learn in all your lectures here in TH-cam. Ngayon ko lang naiintindihan yung mga grey areas sa civil law. Thanks a lot. Just want to be clarified dun sa example Nyo na Inadmissible yung possible testimony nung nakarinig na..." Pag pumasa ka sa Bar sayo na yung kotse or land..." According dun sa mga lecturers ng Revised Rules on Evidence Now, yung pong Dead Man Statute at wala na, but exception na sya sa Hearsay rule, so admissible. Salamat po.
Hi Edgar. Thank you for your comment. The Dead Man's Statute specifically applies to wills. If the testator had written a will and had directed what happens to his estate, that will shall be followed. Any alleged promise, communication or gift allegedly made by the testator while he was alive but not so stated in the will cannot be given effect, unless it can be filed as a claim against the estate under Rule 86 of the Rules of Court. As to your statement that the Dead Man's Statute is an exception to the Hearsay Rule, maybe you are referring to Section 39, Rule 130 of the Rules on Evidence?

sir good day po. sir sana matulongan nyo po ako.. ang title ng lupa ay nakapangalan pa sa lolo at lola ko tapos ang bahay ay bahay ng tatay at nanay ko. 2 lang kaming magakapatid sa nanay at tatay ko. namatay na amg tatay, nanay at bago palang namatay ang kapatid ko.
sir, additional info po, bakit hindi po nakapangalan sa tatay ang lupa tinirhan kasi ang mga kapatid ng tatay ko ayaw pumirma sa extra judicial settlement kaya ang title hanggang ngayon ay nasa pangalan pa rin sa lolot lola ko po.
may mga tanong ko lang po ako sir:
1. sino po ba ang may karapatan sa bahay ng tatay at nanay ko, ako ng anak na naiwan o ang mga pamangkin ko?
2. pwede po ba mapaalis sa bahay mg magulang ko yung mga pamangkin ko? may basis po ba kon pwede or basis?

Is an IRREVOCABLE Last will and Testament valid? Or is it null and void right away?Is there such thing as irrevocable will?
No, there is no such a thing. Hehe. A will is by nature revocable. It can be revoked by execution of another will or by physically destroying it. A will is a gratuitous act on the part of the testator. The testator cannot be compelled to give away his property to anybody if he/she doesn't want to 😊

What is the basis for determining the amount of collated properties of the decedent for partition purposes? Is it at the time of acquisition, at the time the decedent died, or at the time of judicial or extrajudicial partition?
The estate to be partitioned shall be determined at the time of the death of the decedent. The net value shall be determined after deducting debts owing to third persons, including the government. After that, the legitime shall be computed. If they are inadequate, the donations made by the decedent while he was still alive may be revoked or reduced to answer for the insufficient legitimes.
