    Imagine coming home & discovering trees in your backyard that you may have spent decades watching grow...were cut to the ground by a neighbour who couldn't even be bothered to knock on your door first.

      Something like that happened in the news last year. A man wanted a better view so had someone chop down dozens of trees on their property. The tree owner took him to court, won, and now the tree cutting neighbour has to pay for replanting new trees. It will cost millions.

      Maybe I can aide in that
      If we are to believe the defendant, who, kinda seems like he's making things up as he goes, that the trunk of the tree was 50% over his line, and 50% over the property line of the plaintiff, one would reasonably assume that the leaves and branches of said tree are also on the side of the defendant.
      Given that the tree MAYBE was close to the defendants house, it would be semi-reasonable to assume that he cut the tree down because you can't really just cut a tree in half or it's going to die
      That said, yeah, he should have had a word with the plaintiff about it first to see if there was another way.

      ​@DyNaStYCaRl that would seem like an ALMOST reasonable defense but for the fact that the tree service had to go onto the plaintiffs property to cut down the trees to begin with. If that was the cade it sounds like the trees were further from the property line than he first stated because if you go back and listen to him again he amends his initial statement on the portion of the tree that is "50%" on his property to just the canopy of the tre leaning over the property line to his side. Legally the only thing he could have done was to trim to the property line and not beyond.

      @@stevenp25100 a court order wouldn't have made a difference. He had no right to go on someone else's property and no right cut someone else's trees. If part of the tree was growing on his side then he can only cut the part that's on his side. He kept saying he didn't do it, the treecutter did it, but he told the treecutter what to do. His only defense which is not a defense was that he didn't know the owner of the house, even though he lived there almost a year and there are many ways to find the owner of the house. This was a very easy case and the gall of the defendant is unbelievable. If I did that I would be too ashamed to show my face anywhere especially on TV.

    I know he was worried about the damage from the hurricane, but it's just ridiculous that he thought he could kill trees that must have been 80 years old. If he had the time and skill to get that house, then he had the time and skill to get in touch with whoever owned the house next door. "Oh, nice to meet you. By the way, I noticed you have pets in your back yard. I shot them because I have asthma. Bye." Get real.

      I'm sure that is just a convenient lie. He just hated those trees. I bet it was a petty reason like he hated raking up the leaves, or he wanted more sunshine coming in his windows. This defendant is the worst type of selfish person.

    The nerve of someone cutting down another person's trees without permission and going on their property without their permission to do it. If that's not crazy enough, the fact that the defendant doesn't think he did anything wrong and keeps insisting he did the right thing makes it even crazier.

      Yeah but in the end his house wasn't damaged. The plaintiff doesn't live there, normally wouldn't care but he got his 5k payday. But defendent doesn't have to worry about damage win/win tbh.

    I can not believe the defendant would cut down trees on property that is not his. Is he crazy? Only an idiot would do that. $5K was not enough penalty for trees that large.

    he got away easy. I remember seeing some tree law video's where people get way much more than 5k due to depreciation of property value + value of the trees / lumber itself etc.

      $5000 was the maximum the plaintiff could receive based on his jurisdiction, but I understand what you're saying and agree those trees were worth way more than the maximum $5000. Based on the stumps, the trees had been there for generations and were ginormous! Makes me sick that the defendant cut those trees to a stump.

    It does happen; Some neighbours are so brazen and rude; A man who lived across the road came into our property in Brisbane with a chainsaw and cut down our live trees because he said they were annoying our next door neighbour. It was none of his business and he never asked us. This happened in the 90's. He had to pay.

    I'm a die hard gardener and arborist. I'd absolutely lose my 💩 if someone cut down any of the various old growth trees and otherwise... that I have on my property. Good gawd!? The excuse from the defendant, is insulting to ones intelligence. I'd have sued him for max. Not cool buddy.

    Defendant should've paid for replacement trees, in my opinion. AND fined for trespassing and defacing property. As far as I know, the plaintiff could've sued for replacement of the tree, devaluement of his property, trespassing etc.
    There should be higher punishments for these kind of shenanigans, especially given the fact that in the ENTIRE YEAR the defendant lived there, he never bothered to contact the plaintiff about his supposed dangerous trees.

    This case should've been done and over with in one clip, not two. It was a no-brainer. The defendant clearly trespassed on the plaintiff's property. He's very lucky that the plaintiff didn't call the police on the defendant for breaking and entering, not to mention defacing property, which is exactly what he did given that he had no permission to cut down those trees.

    I agree with the verdict, but if someones trees are hanging OVER my house, it does show negligence on behalf on the tree owner. Been in a similar situation and having to continuously PAY to have the trees trimmed to avoid damage to your car, house or property because the owner won't take any financial responsibility isn't a fun position to be in either.

    This is why you communicate with people. It it not up to you to decide what happens to trees on someone else's property. If you have a concern, you talk to the homeowner. It's called common sense, which apparently this guy has none.

    Trees should be propritized over property lines when it comes to branches/curved trunks at least. Unless they pose a threat to a vehicle or the house itself. We kinda need those to live.

    The defendant got off easy. Mature trees will go for MUCH more than 5k for 3. He is lucky criminal charges were not pressed against him.

      Small claims court limit is usually $5000 as well. These cases are all pulled from small claims court.

    Tree Law is Crazy and I honestly believe if he Plaintiff had been able to show evidence of what types of tress and how old they were He would have gotten more money outside of JJ's court(since her cap is 5,000). Glad he got what he got though.

    Plaintiff should have gone to a different court. He could have gotten a LOT more money! Tree Law is fascinating! If he had called an arborist and determined the age/type of trees they were, he could have sued the neighbor for like $200k plus!

    What kind of company chops down someone's trees because a neighbour has asked them to ?
    Surely (unless the defendant lied to them) you would need the permission of the owner of the trees before you even got the chains saw out..

    My neighbor hates our mulberry trees and has asked us multiple times to cut them down. Honestly, I don't blame him, because the berries fall on his driveway and make a mess, and the trees are invasive. But my parents like them.
    We told him he could cut any branches on his side.

    An example of someone who got suckered by a tree service to cut down trees that probably have survived MANY hurricanes without issue. He let fear overtake logic. What if he had a shed on his property? That could potentially be a threat, too! Were you going to have it removed as well? The defendant is a piece of work.

    His excuse doesn't wash with me. If they were "shared trees", he at least was still obligated to contact the "other owner". In fact, if what he claimed was true, the "other owner" would be on the hook for half the tree-chopping expenses..... yet dude paid for it all. He was frustrated that the absentee owner couldn't quickly be contacted, so he just took it upon himself. "Shared trees" LOL
