Same thing happened to me: I told aunt to tell my uncle I wanted my trees trimmed, I looked outside and he had cut cedar trees down. I was so hurt. Those trees had been there since my mom built her house.

NEVER mess with someone’s trees. Tree law is insane, and you can be on the hook for hundreds of thousands of dollars per tree depending on the type and age of the tree.

Both these guys honestly seem like two good dudes. Unfortunately there was bad communication between them when this whole tree chopping thing happened. I tend to believe the tree cutter more than the plaintiff just because he seems like he’s been in the business for a while so he’ll know the difference between someone telling him to trim a tree or cut a tree

I reads like 'Cut + Stake'. The defendant should've clarify what that meant with the home owner. It just good business practice to do that with any project.
Especially a project that changes the whole look of the house.

If a homeowner asks for something you deem kind of crazy, get it confirmed in writing. People don't normally want mature and healthy trees cut down randomly.

@@BobDobbs681 No he will have to plant new ones. Maybe $100 each. Or something. I have a Crepe Myrtle in my yard that is 18 years old and it is 50' tall, and it doesn't get a ton of sun where it is. I also have about 10 other crepe myrtles that have sprung up from that tree dropping seeds. I use to cull them as weeds, but now I let them grow and transplant them.

It does not take long to chop a tree down. Much more difficult to trim/prune than take an axe or saw to it. The tree guy is a scam artist.

Every one thinks that just cause your Mexican you know something about landscaping. My Mexican grandfather was like this. The Arizona Ash tree in his backyard was huge. It is so large that you can’t wrap your arms around and canopied everything. One day he cut it down to practically nothing. My grandmother was devastated. But he was known for doing that. He would cut plants down all the time.

"Cut and Stake" is what I read the note to say. Then the defendant wrote, "Remove." That's completely different. Maybe there was a language barrier issue. Definitely a miscommunication.

Maybe I'm wrong but crape myrtles should come back up from the ground the following year. He should've cut them down much earlier so he wouldn't have all those dead spots.
My friend cuts hers almost to the ground every fall. They come back beautifully.
My dad had a crepe myrtle and he hated it. So he did EVERYTHING he could to take that tree out. He freaking burned the sucker and it came back.

Definitely a miscommunication. Plaintiff probably said to him to cut and stake- as in trim, but defendant understand cut as in chop it down.
If he said, move your car, I don't want to damage your car when I drop your tree, that should have been a red flag for the plaintiff.

He dropped not one, but two with the guy in the house. I drop trees and I know the sound. It's distinctive. He knew what was going on and didn't care until he found out his wife cared.

But the fact that he charged $150 for chopping down trees down to stumps - are you kidding me? Call around and find out. Not only is that STRICTLY a trimming price - cutting costs TWICE as much - it IS common knowledge that this breed of trees takes on: a) trimming in the early year season and b) use the terms "cut" all. the. time.
Especially since "cut" and "cut-down" can be different things.
Those are a DECADE AND A HALF old trees that are just to be chopped down based off of some scribble on a paper, at a trimming price?? It is the DEFENDANT who should have had more discretion, if you suggest that it is a matter of that, to have at least confirmed why someone would want two full-grown ass trees cut down, especially that anchor the house.

The defendant filled out his part of the paper first and asked the plaintiff to add his part. The plaintiff knew. He wanted the logs stacked in the back for his fireplace. He even mumbled towards the end of part two that the defendant wrote it, he knew he wrote cut down two trees. Dude just tried to cover his butt because his wife is pissed.

You, on the other hand, (conveniently) have NOT even touched on the more relative and relevant matters being the price inconsistency with the job (remember how it costs DOUBLE for that kind of service?) along with the treatment of that tree type itself with the season itself. Those points are beyond far more relevant than some handwriting. Have you seen Judge Judy with the other episode, regarding the carpet/flooring dispute? She didn't even regard a similar piece of trash that the defendant alleged as their "receipt". This handwriting is minuscule, it does NOT say to "cut down", the price is NOT consistent with the nature or vastness of the job, and the tree itself CALLS for trimming in that season - I checked, and that info checks out. It is, in fact, common knowledge.
Sorry - to have cut down a decade and a half old trees, two of them, that are perfectly healthy, and anchor the house, without paperwork - adequate language, not scribbles - was fully on the defendant's part. If you fancy it is appropriate to get your head chopped off or balded because you said CUT instead of TRIM at the salon, then I hope you never find a hairdresser who thinks the same.

Those trees aren't that big and he might just charge that price for those. Everywhere the price is different for things. The look on the plaintiffs face when JJ read the notes about cut n stake made it look like he was caught in a lie.
It actually made it look like he was unclear about what “cut and stake” meant. He wanted a trim and you can tell that he definitely did not understand what those words meant. Like JJ said it’s a miscommunication. He should have clarified what it meant to the client to make sure there was an understanding. And the client should have better handwriting. 🤷🏽♀️

Those trees did not need to be trimmed. If the owner wanted this trees trimmed then obviously there would be nothing left. Get new trees and let them grow. No need to trim a crape myrtle. I have several and never trimmed them.
