Nascar def saw this coming, which is why they included provisions barring teams from taking any litigation against nascar, which might be the thing that bites them in the ass in the end. The charters actually help, teams can sell the charter and get money back. The old system a team quitting would only get maybe 200k for 2 million worth of equipment

We had every dollar laid out on an entry blank for every event and everybody could try to get their piece of that pie. Including tv money. This is what is hurting Indycar.... NASCAR ties up the oval tracks and Indycar cant get dates or reasonable track fees. As mentioned it doesn't allow drivers to run in other series... we saw that with Kyle Larson at Indy last year.

I blame nascar majorly for the reason indycar only has one high speed oval in the schedule, being Indy itself and that’s it. Break up nascar and isc so nascar doesn’t have direct ownership of a major chunk of high speed ovals in this country. Also look at breaking up Imsa and nascar so that imsa isn’t directly owned by nascar themselves.

The downfall of NA$CAR began when NA$CAR started taking money from sponsors to become the official "X" of NA$CAR without having to sponsor a team. That took millions of dollars from the teams and put it directly into the bank accounts of NA$CAR.

How can we have a strong sport where the participants aren't making money? Especially a sport that is as capital intensive as racing. No one goes to the races to see NA$CAR banners. No one goes to see a Ford or Chevy either. You go to see your favorite drive put a whipping on the field. Back in the day when Nascar was formed, it was to ensure that the tracks paid the drivers after the race. That is no longer an issue. The sport would be far better off if the teams owned the sport like the rest of the major sports in America. Nascar should go away and the teams should get together and have a commissioner and that commissioner can do exactly what NASCAR does now without taking all of the money. Nascar is nothing but a middleman and the teams are a hell of a lot more sophisticated today than they were in the 40's and 50's. The teams are plenty able to ban together and hire people to do every single thing Nascar does and instead of that money going directly to the France family, it should be going to the teams that make the whole thing possible.

NASCAR “greed” ran off all the fans. Now they are to the point that the teams have “had it” and are obviously feeling trapped, strapped and willing to risk being pushed out. Not good for anybody, including the fans.
They've also spoiled the product on track. The new gen car has worsened the racing at a lot places, and stage racing is a bogus fabrication. There are guys in the 10-20 finishing position with as many points as some in the top 10, even top 5.

I expect this to be settled before NASCAR goes through discovery. We don’t know with any level of certainty that all of them signed the same charter agreement. For example, we all are of the belief that HMS and JGR will be allowed to have 4 charters but everyone else is limited to 3, clearly not the same agreement. Would it be so hard to imagine HMS getting a few more points of the TV money that say TrackHouse? I’m not saying that is the case, I’m saying NO ONE outside of NASCR knows. After 70+ years of strong-arming people there will be a graveyard of bodies buried in those books, the France family will cave before discovery. If NASCAR does allow this to go to trial (bad, bad idea) they could be forced to sell off all of the Tracks, any other racing leagues - Like Xfinity and Truck, not just ARCA and IMSA. I would expect the 23IX team to highlight that the only true competitor for NASCAR CUP is the NASCAR owned Xfinity and Craftsman series also owned by the France family. NASCAR as a lot more at risk than 23XI, and 23XI knows it.
Settlements only happen when ALL parties agree to it and a judge approves it. If a judge or 23XI or FRM say no to a settlement, then it doesn't matter what NASCAR wants.

Spot on. From a risk perspective, NASCAR has exposed themself to a plethora of less than favorable outcomes for themself. Their best option will be to dictate their own outcome before the courts do for them.
Buying the majority of the tracks on the circuit is one of the most damning indictments against NASCAR. In the end, 23XI & FRM need to win this suit for more than just the rest of the teams but rather for the future of the sport. If they lose, not only will they exit the sport entirely, the status quo will continue until the sport itself declines and ends up like IRL before Roger Penske bought it because the current business model is not sustainable.

Yeah JR's sister said the reason why they wont move up to cup from the xfinity series is that it didn't make sense financially not too long ago. This is right on the track. That is how i found out how expensive the charters were and how its a bad investment.

At 2:53 I think he implies that the teams had to *buy* their charters. I think he slipped it in as "the teams could pay millions of dollars to have the right to compete". The charters have obviously become worth something and are apparently transferrable, but I've never seen nor heard how that came to be. Was this addressed from the start with the charter "agreements"? Anybody ever read the original charter agreements? Is there such a thing? Did both sides know in 2016 that "the teams could pay millions of dollars to have the right to compete"? It may well be that this is just a nitpick, but sure seems interesting to me - especially with the way he slid it in there as obviously being something that everyone understood from the start of the charter system. My understanding was that they were considered "rewards" for the teams who had consistently showed up to qualify for the races. Were they transferrable from the get go?

because all the other teams got scared to loose their charter and so signed a paper (with a max of 12h time) that includes can't sue us for that reason!
It’s still early but I’m sure a lot of teams are having discussions with their attorneys this week to see what evidence they have to support the claim and what the benefits/downside of joining in to the suit as a party would do for their team
The biggest issues with the argument presented, "where else are you going to race" is that Indycar, IMSA (which, yes, is NASCAR owned but does not require a charter), USAR, World of Outlaws, NHRA, etc all exist. Also you can run as an open car (which he highlighted here), which is what they'll have to do next year until the eventual injunction is granted that gives them an extension on their charter until this is resolved. On the Arbitration complaint, well welcome to 2024. If you order a sandwich from Uber Eats you can't sue Uber when they run you over with one of their taxis. Have fun reversing binding arbitration in the US. I expect they'll just settle. I don't think they want to win, they just want NASCAR to give a higher revenue share. If they had a fundamental issue with where things are going they'd find something else to do. This is what Tony Stewart did. He hates NASCAR and now he's a drag racer and happier for it. Good on him. NASCAR doesn't want to deal with this either. They'll find the price they need to pay and all of this will go away.

If you want an objective opinion, I am a Canadian lawyer with 15 years of experience in the field. I have no skin in the game. I just want to provide an objective legal perspective.
Anyone who pays attention to history saw this many years ago when some of the drivers tried to organize the drivers into a union and earned a lifetime ban from competing in any Nascar organized race. Or Bill France Senior stood on the inside of the track holding his wallet up at any driver outrunning the rest of the field. In short, slow down or you won't get paid.
So the goal is to force nascars hand to make changes to better the sport, or face the hands of the law to make them do so. I’m all for it. Nascar leadership is the most incompetent it’s ever been since Brian took over and the France family needs a reckoning or to be removed from the sport. Whatever it takes to make the sport legitimate again and make the sport healthy long term.

I promise you this, if all the teams get together and not show up for just one race, NASCAR will change it's tune. I know there are a lot of lives and livelihoods at stake here but this is the sure fire way to deal with NASCAR.
They should have done it before they signed. Now the teams don’t have any leverage. NASCAR will drag this out in court for years and bleed those 2 teams dry. Like the attorney was saying they could race for maybe a year without a charter but if it goes on for many years. They’ll be out of business.
Hopefully the attorney that filed the suit is reading this you stated the 9 race teams owners went out of business filed bankruptcy from 2016 and the charger system that was configured for your Discovery go back several decades and you can prove a pattern

Myself I just like to see the whole thing change they have managed to ruin the sport for for me we were spectators for several decades and invested quite a bit of money per year to go to several tracks we had season tickets to when the France family started changing everything up from the points to actually win a championship Howard points Championship is dispersed all the way down to the driver did Dale Earnhardt and the Richard Petty's and Gordon with the seven championships those are legacies it had never been reached the way they can figure a championship with the current running I myself was a Dale Earnhardt fan from 1981 to the day he passed and then I supported Dale Jr what the France family fails to realize is you're correct they don't go there to see the France family they go to see the people they support the teams and drivers what are the teams and drivers you have nothing unfortunately for the sport most people don't even watch Nascar these days play a single-handedly managed to screw it all up for myself and my family and lots of friends we all went as big groups we all spent tons of money per year most times on average well over a hundred thousand dollars just to watch our drivers drive mind you we had trucks with big expensive RVs pay to go on the infield then we had our season tickets in the stands we generally got to the tracks on Wednesdays or Thursdays and left Mondays a lot of money was spent through these times I'm in my late 50s and I had a lot of friends we all went to the tracks together 20 to 40 families it was a big group out of all those families not one of us even watching on TV is completely free they completely write the sport and none of us even take time to watch it unbelievable. For myself I'm a Ford guy but I did purchase a Chevy four-door Dooley color black I had a big number 3 on it with Dale Earnhardt flags on the back what's a real nice RV behind it it made the news several times it was a short looking truck but I will use it to go to the tracks I only bought the truck because of Chevy and Earnhardt any other time I drove my Ford F-350 I think back at all the money I spent through the years and I justify it being as money well spent today I would not spend a copper penny to go to a race I want to go with someone else paid for it all I have zero interest in it. After Junior retired then I pulled for Stewart-Haas now they leave in the sport because it's awfully expensive hobby when you can't make the return on your investment hopefully MJ has Deep Pockets and can afford illegal bill I'm sure he's got every owner talking to him discreetly I'm probably going to help with the financial aspect of that I'd be curious if someone filed for a GoFundMe to fight this in court and make some changes to stock car racing I'd be curious to see how much a GoFundMe can raise I sure would contribute.
Na$car has been a monopoly and exercised monopoly power since the beginning. It started at the very beginning with Big Bill and if you need proof, look at what happened when drivers tried to unionize or what happened when drivers wouldn't race the first race at Talladega.
It's so much worse now. NASCAR owns the majority of the tracks, they bought ARCA, various other series, teams have to build spec cars, with spec parts, from single source NASCAR authorized suppliers. NASCAR basically locked all the teams in the NASCAR walled garden with the NextGen car and left them no choice but to fight. If teams were running the last gen car they could have had some choice to take the cars they had and have an IRL / CART style split. Now if they left then cars are so proprietary they could never get the parts. Not to mention they can't book more than half the tracks NASCAR owns. This lawsuit has some legs given how much control NASCAR has over stock car racing as whole. The interesting part will be the discovery for this case. NASCAR will likely have to show their financials. It is going to be enlightening to see how much ticket, TV, sponsor and IP money they have been making and keeping for themselves.
I think for this to have any real traction, A court would have to in fact, classify a charter as a franchise and a requirement to race in Nascar. As of now it is not , nor is it a requirement to be able to race in Nascar. Its original selling point was to guarantee a starting position to aide teams in obtaining major sponsors .

Let’s all remember, this guy represents the teams suing and therefore only giving their view point. His client in 23XI is one of the most outspoken against NASCAR for years. We don’t know why the other 13 teams signed unless we hear directly from them, not this lawyer. HMS, Penske, and Gibbs (the top teams for all 3 manufacturers) all signed. If those massive teams thought it was unfair they wouldn’t have signed and would be doing the lawsuit. This isn’t to say this lawsuit isn’t right, rather the facts from all sides need to come out rather than just trusting this one dude

So four years ago 23XI agrees to start a team knowing what the costs and the rules to do so were. Michael Jordan's net worth is $3.2 Billion, not million. His income every year is $44 million. The numbers for Rick Hendrick are almost identical to that.
The bill is coming due for the France family allowing Brian to run the sport into the ground for so long before Uncle Jim took the wheel away from him. The bargain NASCAR made with the owners and drivers decades ago was this: "we own most of the big tracks, we will make sure the other track owners don't screw you over and not pay you, we will make rules so that the sport is as close to fair as it can be." Later they added "we will negotiate TV contracts that benefit you that you could not negotiate without us." NASCAR broke that deal with the owners when Brian France and his idiotic coke-fueled gimmicks destroyed the popularity of the sport. Why should the owners keep letting NASCAR get fat off the profits of this sport if they can't keep growing the pie? They'll win this lawsuit, it's frankly a slam dunk. NASCAR would do well to settle, but nobody with France as their last name has done anything smart since Bill Jr died.

From what I understood in Jordan's lawsuit the teams buy the cars from NASCAR but NASCAR actually own the cars not the teams unlike as recently as 2021 when the teams built their own cars in house and owned them.

This could also change the entire you have to bring money to race as a driver. If teams are making money they will be more likely to take a chance on a kid who clearly has talent but not the bank account. This is huge for the sport
I'm not a lawyer, but considering that all other major sports have lost these anti-trust suits for actions FAR less egregious than NASCAR's monopolistic behavior, this case seems like a slam dunk W for the teams involved.
This is a defining moment for nascar, either the France family relinquish full control of the series or come out and admit that it’s only entertainment with the outcomes largely predetermined. Hate to say it but this fight could ultimately lead to the death of the series.

This is what is hurting Indycar.... NASCAR ties up the oval tracks and Indycar cant get dates or reasonable track fees. As mentioned it doesn't allow drivers to run in other series... we saw that with Kyle Larson at Indy last year.
not only indy car literally any racing series can't run on france tracks... they need to be in jail locked up for decades and some smart person need to be put in place to run it (please no team boss we seen how this worked with cart...)

Anyone who pays attention knows how nasty and more controlling the NASCAR sanctioning body has become. It's brutal. We feel it all the way down to the local track level with the weekly series racing.

I blame nascar majorly for the reason indycar only has one high speed oval in the schedule, being Indy itself and that’s it. Break up nascar and isc so nascar doesn’t have direct ownership of a major chunk of high speed ovals in this country. Also look at breaking up Imsa and nascar so that imsa isn’t directly owned by nascar themselves.

The downfall of NA$CAR began when NA$CAR started taking money from sponsors to become the official "X" of NA$CAR without having to sponsor a team. That took millions of dollars from the teams and put it directly into the bank accounts of NA$CAR.

How can we have a strong sport where the participants aren't making money? Especially a sport that is as capital intensive as racing. No one goes to the races to see NA$CAR banners. No one goes to see a Ford or Chevy either. You go to see your favorite drive put a whipping on the field. Back in the day when Nascar was formed, it was to ensure that the tracks paid the drivers after the race. That is no longer an issue. The sport would be far better off if the teams owned the sport like the rest of the major sports in America. Nascar should go away and the teams should get together and have a commissioner and that commissioner can do exactly what NASCAR does now without taking all of the money. Nascar is nothing but a middleman and the teams are a hell of a lot more sophisticated today than they were in the 40's and 50's. The teams are plenty able to ban together and hire people to do every single thing Nascar does and instead of that money going directly to the France family, it should be going to the teams that make the whole thing possible.

I expect this to be settled before NASCAR goes through discovery. We don’t know with any level of certainty that all of them signed the same charter agreement. For example, we all are of the belief that HMS and JGR will be allowed to have 4 charters but everyone else is limited to 3, clearly not the same agreement. Would it be so hard to imagine HMS getting a few more points of the TV money that say TrackHouse? I’m not saying that is the case, I’m saying NO ONE outside of NASCR knows. After 70+ years of strong-arming people there will be a graveyard of bodies buried in those books, the France family will cave before discovery.
If NASCAR does allow this to go to trial (bad, bad idea) they could be forced to sell off all of the Tracks, any other racing leagues - Like Xfinity and Truck, not just ARCA and IMSA. I would expect the 23IX team to highlight that the only true competitor for NASCAR CUP is the NASCAR owned Xfinity and Craftsman series also owned by the France family. NASCAR as a lot more at risk than 23XI, and 23XI knows it.
Settlements only happen when ALL parties agree to it and a judge approves it. If a judge or 23XI or FRM say no to a settlement, then it doesn't matter what NASCAR wants.

Spot on. From a risk perspective, NASCAR has exposed themself to a plethora of less than favorable outcomes for themself. Their best option will be to dictate their own outcome before the courts do for them.
Buying the majority of the tracks on the circuit is one of the most damning indictments against NASCAR. In the end, 23XI & FRM need to win this suit for more than just the rest of the teams but rather for the future of the sport. If they lose, not only will they exit the sport entirely, the status quo will continue until the sport itself declines and ends up like IRL before Roger Penske bought it because the current business model is not sustainable.

At 2:53 I think he implies that the teams had to *buy* their charters. I think he slipped it in as "the teams could pay millions of dollars to have the right to compete". The charters have obviously become worth something and are apparently transferrable, but I've never seen nor heard how that came to be. Was this addressed from the start with the charter "agreements"? Anybody ever read the original charter agreements? Is there such a thing? Did both sides know in 2016 that "the teams could pay millions of dollars to have the right to compete"? It may well be that this is just a nitpick, but sure seems interesting to me - especially with the way he slid it in there as obviously being something that everyone understood from the start of the charter system. My understanding was that they were considered "rewards" for the teams who had consistently showed up to qualify for the races. Were they transferrable from the get go?

It’s still early but I’m sure a lot of teams are having discussions with their attorneys this week to see what evidence they have to support the claim and what the benefits/downside of joining in to the suit as a party would do for their team

The biggest issues with the argument presented, "where else are you going to race" is that Indycar, IMSA (which, yes, is NASCAR owned but does not require a charter), USAR, World of Outlaws, NHRA, etc all exist. Also you can run as an open car (which he highlighted here), which is what they'll have to do next year until the eventual injunction is granted that gives them an extension on their charter until this is resolved.
On the Arbitration complaint, well welcome to 2024. If you order a sandwich from Uber Eats you can't sue Uber when they run you over with one of their taxis. Have fun reversing binding arbitration in the US.
I expect they'll just settle. I don't think they want to win, they just want NASCAR to give a higher revenue share. Anyone who pays attention to history saw this many years ago when some of the drivers tried to organize the drivers into a union and earned a lifetime ban from competing in any Nascar organized race. Or Bill France Senior stood on the inside of the track holding his wallet up at any driver outrunning the rest of the field. In short, slow down or you won't get paid.

Myself I just like to see the whole thing change they have managed to ruin the sport for for me we were spectators for several decades and invested quite a bit of money per year to go to several tracks we had season tickets to when the France family started changing everything up from the points to actually win a championship Howard points Championship is dispersed all the way down to the driver did Dale Earnhardt and the Richard Petty's and Gordon with the seven championships those are legacies it had never been reached the way they can figure a championship with the current running I myself was a Dale Earnhardt fan from 1981 to the day he passed and then I supported Dale Jr what the France family fails to realize is you're correct they don't go there to see the France family they go to see the people they support the teams and drivers what are the teams and drivers you have nothing unfortunately for the sport most people don't even watch Nascar these days play a single-handedly managed to screw it all up for myself and my family and lots of friends we all went as big groups we all spent tons of money per year most times on average well over a hundred thousand dollars just to watch our drivers drive mind you we had trucks with big expensive RVs pay to go on the infield then we had our season tickets in the stands we generally got to the tracks on Wednesdays or Thursdays and left Mondays a lot of money was spent through these times I'm in my late 50s and I had a lot of friends we all went to the tracks together 20 to 40 families it was a big group out of all those families not one of us even watching on TV is completely free they completely write the sport and none of us even take time to watch it unbelievable. For myself I'm a Ford guy but I did purchase a Chevy four-door Dooley color black I had a big number 3 on it with Dale Earnhardt flags on the back what's a real nice RV behind it it made the news several times it was a short looking truck but I will use it to go to the tracks I only bought the truck because of Chevy and Earnhardt any other time I drove my Ford F-350 I think back at all the money I spent through the years and I justify it being as money well spent today I would not spend a copper penny to go to a race I want to go with someone else paid for it all I have zero interest in it.
After Junior retired then I pulled for Stewart-Haas now they leave in the sport because it's awfully expensive hobby when you can't make the return on your investment hopefully MJ has Deep Pockets and can afford illegal bill I'm sure he's got every owner talking to him discreetly I'm probably going to help with the financial aspect of that I'd be curious if someone filed for a GoFundMe to fight this in court and make some changes to stock car racing I'd be curious to see how much a GoFundMe can raise I sure would contribute.

Na$car has been a monopoly and exercised monopoly power since the beginning. It started at the very beginning with Big Bill and if you need proof, look at what happened when drivers tried to unionize or what happened when drivers wouldn't race the first race at Talladega.
It's so much worse now. NASCAR owns the majority of the tracks, they bought ARCA, various other series, teams have to build spec cars, with spec parts, from single source NASCAR authorized suppliers. NASCAR basically locked all the teams in the NASCAR walled garden with the NextGen car and left them no choice but to fight. If teams were running the last gen car they could have had some choice to take the cars they had and have an IRL / CART style split. Now if they left then cars are so proprietary they could never get the parts. Not to mention they can't book more than half the tracks NASCAR owns. This lawsuit has some legs given how much control NASCAR has over stock car racing as whole.
The interesting part will be the discovery for this case. NASCAR will likely have to show their financials. It is going to be enlightening to see how much ticket, TV, sponsor and IP money they have been making and keeping for themselves.

I think for this to have any real traction, A court would have to in fact, classify a charter as a franchise and a requirement to race in Nascar. As of now it is not , nor is it a requirement to be able to race in Nascar. Its original selling point was to guarantee a starting position to aide teams in obtaining major sponsors .

Let’s all remember, this guy represents the teams suing and therefore only giving their view point. His client in 23XI is one of the most outspoken against NASCAR for years. We don’t know why the other 13 teams signed unless we hear directly from them, not this lawyer. HMS, Penske, and Gibbs (the top teams for all 3 manufacturers) all signed. If those massive teams thought it was unfair they wouldn’t have signed and would be doing the lawsuit. This isn’t to say this lawsuit isn’t right, rather the facts from all sides need to come out rather than just trusting this one dude

The bill is coming due for the France family allowing Brian to run the sport into the ground for so long before Uncle Jim took the wheel away from him.
The bargain NASCAR made with the owners and drivers decades ago was this: "we own most of the big tracks, we will make sure the other track owners don't screw you over and not pay you, we will make rules so that the sport is as close to fair as it can be." Later they added "we will negotiate TV contracts that benefit you that you could not negotiate without us."
NASCAR broke that deal with the owners when Brian France and his idiotic coke-fueled gimmicks destroyed the popularity of the sport. Why should the owners keep letting NASCAR get fat off the profits of this sport if they can't keep growing the pie?
They'll win this lawsuit, it's frankly a slam dunk. NASCAR would do well to settle, but nobody with France as their last name has done anything smart since Bill Jr died.

The charter isn't there to help the teams. It was for nascar to dictate what the teams can and can't do and to make nascar themselves a lot of money.

From what I understood in Jordan's lawsuit the teams buy the cars from NASCAR but NASCAR actually own the cars not the teams unlike as recently as 2021 when the teams built their own cars in house and owned them.

Didn’t this kinda happen in INDYCAR in the 90’s or sr something like that there was a weird season when there where all the same cars in one catagory and physics experiments in the other yes I was joking about the physics experiments but those cars where wicked fast
well in the 90s both series could run the same tracks, since nascar own them we would need to find/build other tracks and get people there to watch!

This could also change the entire you have to bring money to race as a driver. If teams are making money they will be more likely to take a chance on a kid who clearly has talent but not the bank account. This is huge for the sport
I'm not a lawyer, but considering that all other major sports have lost these anti-trust suits for actions FAR less egregious than NASCAR's monopolistic behavior, this case seems like a slam dunk W for the teams involved.
This is a defining moment for nascar, either the France family relinquish full control of the series or come out and admit that it’s only entertainment with the outcomes largely predetermined.
Hate to say it but this fight could ultimately lead to the death of the series.
