Google "Garner vs GPS" for more info As of September 27, 2024, the U.S. District Court for the District of Delaware issued a memorandum opinion addressing the case. In the class-action lawsuit against Global Plasma Solutions (GPS), the court granted summary judgment in favor of GPS on two of the plaintiff's fraud theories: 1) Elimination of COVID-19: The claim that GPS's ionizers could eliminate COVID-19. 2) Absence of Harmful Byproducts: The assertion that the ionizers do not emit harmful byproducts. The remaining fraud theory that survived summary judgment was: 3) Independent Testing: The allegation that GPS misrepresented its ionizers as being independently tested. The court declined to certify this remaining claim as a class action, citing concerns that individual issues would predominate and that the plaintiff would not serve as a typical or adequate class representative.
