You have no case, you need to understand these songs are NOT yours, you can not make money on other people's art work. Publishers don't give a fuck because they are have been historically fucked on the internet (Piracy). It is out of hand about lyrics though. I don't think without the actual sample being played that they should be able to claim rights. You could copyright any phrase if that is the case.

There needs to be some sort of union for TH-camrs, and online content creators in general. I wouldn't even know where to begin with that, but in a more traditional business, that's what the first step would be.
It would work out pretty well theoretically, youtubers get together and agree that if one of them gets fucked over they stop uploading until it's set right. Most of the fans of these youtubers would reasonably set their hatred towards TH-cam and the Claimant and youtube would lose a portion of income from the lack of new videos from potentially incredibly large channels (though in reality this wouldn't be a big deal).

**UPDATE** Sony has placed a copyright claim on this video because I dared to cite the source of Pewdiepie singing Despacito. Yes that's right, they actually placed a bogus claim on a video talking about abusive copyright claims. If I wasn't so angry I'd find it hilarious. I will make sure this claim gets removed. A way to dissuade companies from abusing the copyright system, is to make it so that there is a mediator between the content creator, and the company, and to(if the company loses the counter claim) make the company pay the money that the video made, with an interest of some kind added on top.
So here's a thought, if the company must pay back the money they made on the claim if they lose... but they're the ones who decided to accept a counter claim or not... would this not just worsen the already terrible tendency of companies denying counter claims even if they're right?
@@lazypayday4476 you make a valid point, but if you make the mediator familiar with the rules for copyright claims, and it is found by that mediator that the creator did in fact not break the rules then they can make a mandatory counterclaim which the company will have to participate to keep the revenue that they've gained from the claim in the first place.

the copyright strike you received on the Monday prior to this video's release ( mentioned at 22:55) is clearly a violation of copyright law ( or at least my grasp on it) for the fact that there are dozens of other content creators out there that created similar content to the alleged violation. due to this, you would have a prosecutable case against the particular company that issued the strike. it should also be mentioned, however, that these company's are likely fully aware of the ridiculousness of their claims, but they often feel that to have a prosecutable case against actual violators that they need to respond to every copyright infringement on the internet. either the law needs to be changed to accommodate the development of the internet, or TH-cam needs to change their policies. if you read to the end of this comment, your an awesome person!!!

We need something more basic first. Independent arbitration. A dispute is not like a lawsuit. You're telling the company that made the claim that they're wrong. They have absolute say over whether they agree with you or not. That's self-evidently stupid. we NEED such disputes to be independently arbitrated or the whole system is meaningless.
Filing a false claim is already illegal. It gets abused because they know no one can actually afford to litigate that against UMG or Sony or whoever's big dick lawyers. It's broken and it sucks.
The worst part is that this isn't even only affecting TH-cam. In almost any situation, big company's can do whatever they damn please and the government doesn't have the balls to speak against them because they are rich and influential. If a big enough company decides to treat you unfairly or ruin your life, well you better get to terms with it. Because unless you are willing to fight a potentially years long and most likely unwinnable fight in court, you are at their mercy.

A couple years ago I watched a youtuber who had copyright strikes on several of his videos, his account was taken down but after about a month or so, he managed to get the account back up. It's still sad that such a small yet funny youtuber can get torn down by a single company.

As someone that actually helps content creators find the problem and to help resolve this its getting out of control its getting to we're ill have to file complants about CRA or copyright abuse and I need to start actually calling the respective companies personally to resolve the issue

You have no case, you need to understand these songs are NOT yours, you can not make money on other people's art work. I don't think without the actual sample being played that they should be able to claim rights. You could copyright any phrase if that is the case.

There needs to be some sort of union for TH-camrs, and online content creators in general. I wouldn't even know where to begin with that, but in a more traditional business, that's what the first step would be.
It would work out pretty well theoretically, youtubers get together and agree that if one of them gets fucked over they stop uploading until it's set right.
Most of the fans of these youtubers would reasonably set their hatred towards TH-cam and the Claimant and youtube would lose a portion of income from the lack of new videos from potentially incredibly large channels (though in reality this wouldn't be a big deal).

A way to dissuade companies from abusing the copyright system, is to make it so that there is a mediator between the content creator, and the company, and to(if the company loses the counter claim) make the company pay the money that the video made, with an interest of some kind added on top.
So here's a thought, if the company must pay back the money they made on the claim if they lose... but they're the ones who decided to accept a counter claim or not... would this not just worsen the already terrible tendency of companies denying counter claims even if they're right?
@@lazypayday4476 you make a valid point, but if you make the mediator familiar with the rules for copyright claims, and it is found by that mediator that the creator did in fact not break the rules then they can make a mandatory counterclaim which the company will have to participate to keep the revenue that they've gained from the claim in the first place.

the copyright strike you received on the Monday prior to this video's release ( mentioned at 22:55) is clearly a violation of copyright law ( or at least my grasp on it) for the fact that there are dozens of other content creators out there that created similar content to the alleged violation. due to this, you would have a prosecutable case against the particular company that issued the strike. it should also be mentioned, however, that these company's are likely fully aware of the ridiculousness of their claims, but they often feel that to have a prosecutable case against actual violators that they need to respond to every copyright infringement on the internet. either the law needs to be changed to accommodate the development of the internet, or TH-cam needs to change their policies. if you read to the end of this comment, your an awesome person!!!

A couple years ago I watched a youtuber who had copyright strikes on several of his videos, his account was taken down but after about a month or so, he managed to get the account back up.

What we need is a law that lays out penalties for false takedowns and claims. Theft is a crime; this is theft too.
