      dogs are work animals, like a mule or ox. if they are bred away from their original intended purpose, they trend towards mental instability, nuisance behaviors, not unlike their emotionally immature owners.

    We had an incident here in Arkansas probably around 17 years ago now. Small town. Someones wife was attacked by a neighbor dog encroaching on their own back yard. The husband eventually shot the dog where it ran back home and died. The husband notified the police, who responded and took a report and seemed to dismiss the incident as not a problem. Later the same day the patrolman returned on direction from his chief to issue a citation. Thus the long battle. Which only ended when the husbands attorney on the day of the trial happened to be friends with the Prosecutor discussed things before court and dismissed the charges. Couldn't believe it went this far especially in rural Arkansas.

    As far as the judge's ruling on self defense only applying to other human beings, I would argue that we have more of a right to protect ourselves from animals with no questions asked, because no matter what PETA says human lives and safety are more important than animals

    The thought of going to trial after a self defense encounter freaks me out more than actually being in a dangerous situation in which I would have to defend myself or others. I find it very concerning when you have to worry about going to prison and being stripped of your rights even when you are just trying to protect yourself or those around you. Odd how we call it the justice system when often times, What occurs afterwards is the complete lack thereof.

    I'm a delivery driver who used to 100% love dogs until one day I went to one house where a large poodle snapped at me without provocation. Injured me and I spent the rest of my shift filing a police report. My company's policy about carrying weapons at all is very strict so I look at all medium to large sized dogs with suspicion and still carry a koubaton after that incident. The dog owners play it as some silly game but as a delivery driver its very infuriating when customers don't take precautions to keep their dog under control when it slows our workdays down.

    a couple from out church were attacked by their neighbors dog, he shot and killed it. His wife needed surgery to repair the bites. The dog owners sued them and cost them thousands in court fees and time before they lost their case.

      I was on a civil jury for 10 days, I will do everything in my power to never be in a position where a "jury of my peers" decides my fate. Several people spent those two weeks doodling, falling asleep, reading, etc. When it came to deliberation 3 jurists pointed to another guy and said whatever he decides I agree with. I had 15 pages of notes, most people had zero and just tried recalling things they thought they remembered from the last two weeks, often being wrong. This was a pretty frivolous civil case, imagine those people deciding if you murdered someone or killed them in self defense.

    The main reason I got my CPL was because nine years ago my 4 year old daughter was attacked by a pitbull(she is fine, and I didn't press charges on the owner). I was 20 yards away. It was the most terrifying moment of my life. I've never felt so helpless.

      I was walking my 3 yo boy who knew to ask people if it was ok to pet a dog before he could pet it (on a dog walking trail), he asked a person they said yes, next thing the dog lunged in for an attack, luckily the owner pulled the dog back in time, my boy petrified, owner laughing, and me feeling absolutely helpless, never again will I ever allow myself or my family be a victim

    Very insightful. Im still stuck on the first case. how could self defense not apply to an animal? Where i lived as a kid, a woman down the road got mauled by a mastiff that got out of it's yard. She didn't stand a chance. Since when does self defense not apply to any being, human or animal attacking someone?!

      Because you need to do the leg work. I've had a CCW for years in California with no LEO experience. You can't assume your former profession gives you more rights than the average citizen. A former LEO dhould know better but likely got a pass at some point and rolled with it. It's way easier these days in Cali to get a CCW in certain counties

    This is scary. As a dog owner in a neighborhood filled with other dog owners, I’m well aware of how many people out there are irresponsible dog owners. I was also chased by a large Rottweiler when I was in my late teens, so I personally know the fear that comes from the idea that you’re about to have teeth sink into your calf or hamstring.

      I'm a plumber and go in and out of homes all day. I had to snap on a customer about a year ago. She had a pit in her basement that she said doesn't play well with new people. I had to go into her basement. I should have refused to go down when she said and I quote "I couldn't find him down there and I didn't wanna wake anyone up getting the dog wrangled." I got to the bottom of her steps and this dog snapps, chases me down a hall into a room. I slammed a door on it, made this lady get he dog and refused to work for her and left. That was horseshit, to know the dog would do something that aggressive and send me down anyway just because she didn't wanna bother anyone. I'm a dumb ass for even going to her basement after what she said, but she also a pos owner to know that was coming but let it happen out of sheer laziness. Needless to say, she's tagged in our system and we'll refuse work for her ever again.

    My poor brother shot a dog that was loose and had a history of biting. His initial charge was aggravated animal cruelty. After hiring a lawyer, the case was thrown out.

    In most states, nothing will happen. Especially if the dog is acting aggressively. Pets are considered property. The only thing you need to be sure of is that you don't discharge a firearm illegally. That's far more likely to get you a jail sentence than killing a dog.

    I was a pest control technician back in the 90s and I went to a regular customer's house that happened to own a trained German Shepherd attack dog. I rang the doorbell in the housekeeper said 1 minute I told her I was going to spray the outside foundation she said okay forgetting that the German Shepherd was outside in the back!! Not in his corral.. I opened the stockade fence gate and proceeded to spray the foundation and the shepherd came around the corner.. didn't bark didn't growl.. just opened his mouth up with his teeth and came right at me!! I used my metal steel pump sprayer to block him from grabbing me.. but I was trapped between the house and The stockade fence. I had a Beretta 25 Jetfire in my right hand pocket in a pocket holster.. but did not want to shoot the dog because I would have been fired and who knows maybe charged? . I had a canister of pepper spray on my belt.. so I threw the metal sprayer at the dog to distract him and then hit him with three shots of stream pepper spray.. the dog was lapping as if it was a stream of water at first!!! but then the dog laid down and started rubbing his eyes with his paws allowing me to escape out the gate... So there you go pepper spray save me from having to use my firearm on the ferocious pooch...

    I chuckled when you related the testimony of the "witnesses" to the Lee shooting case----were these people even in the same county when this occurred???? I remember Vincent Bugliosi saying much the same thing about "eyewitness testimony" when he was interviewed about the La Bianca--Tate murders trials.       A shooting of a dog in Nashville, a couple months or so ago, stirred some people up after a "witness" met reporters from local TV stations at the scene and told them what happened. From the statements to those reporters, the "witness" seemed to think the location was 8 or 9 miles from where it actually was. The "witness" also claimed the man that shot the dog was cocking his handgun (a .380 semi-auto pistol) between each shot, and her count of the rounds fired was at least twice what police told a reporter had been fired in the incident.
      A few days later, a local news report quoted police as saying that none of the witnesses interviewed by police had actually seen the shooting.

      @@Jonesy_Ripley yes, it's right there on their website under their self defense liability policy. If you didn't catch it the first round you can go back and look for it. Click membership then click "start membership" scroll down to below the big "join platinum now" button, the blue button. Below it are two options, a membership agreement and the self defense liability policy. Once you open the PDF go down to section 2 subsection B (exclusions) and it says so right there. It's illegal for an insurance company to cover a criminal act. So as soon as you're charged with a crime your fucked. They try and make it seem like that's what they cover, using sneaky language, but it's right there in the fine print

    Very timely and topical subject as I was actually there in the first video you referenced in your video samples (Miami Beach).
    Excellent review as I considered all of the options you mentioned (as well as each relevant consequence 🥹, legal and otherwise) in this ordeal.
    It was an incredibly chaotic situation as a Pitt-bull has just snuck up and clamped ‘jaw locked’ on my buddy’s dog whom was crying for dear life in the most terrifying, high pitched screeching scream you could imagine.
    In the process of helping to get the Pitt to release 2 of us we’re bitten in the ordeal…As it was not my Dog and I was not initially attacked I reasoned that I would not have been justified in any more lethal response but Boy, we’ve debated and considered all of the above since then.

    The fact that James didn't refer to dogs as whores as he usually does astounded me. Your legal analysis videos are top notch counselor. Also, Legal shield could totally run a hotline commercial mimicking the commercials of the 80s and 90s. You know the ones, "hot girls lonely and wanting to talk." Spin is its attorneys in full suits on a mahogany desk doing the leg flitter landline phone cord twirl.
    On another note the hotline is a step towards real, impactuful, meaningful advocacy for a client and damn if it isn't more likely to produce results versus the arrest and roll back the charges alternative which is normally experienced for those without an attorney on speed dial.

      There's no such thing as stand your ground laws, only the ABSENCE of any unconstitutional "mandate to retreat" laws.
      Such mandates may be on the books, they may be considered constitutional but they aren't.

    My neighbor has 2 aggressive pitbulls that they don't restrain (or even observe... they just "let them out"). They've charged me about 5 times over the last few years (and I've seen it happen at least another 5 times to others in the neighborhood... including delivery guys that will eventually just take my house off of their route) and I finally had enough and started calling the sheriff when I saw it happening. It took three separate events before they were even ticketed. Even after that, the neighbors did 100% of nothing to control their dogs _until_ I put up security cameras. Suddenly there was a new need in their minds to install an invisible fence (which I don't think is going to work on its own) and start using chains and leashes. Even after all of that... the guy is now fighting the ticket. He has a bench trail scheduled for 8:45a on December 21st... So now I'm waiting for a summons to show up, a few days before Christmas, because I may have to testify against this guy when he tells whatever lies to the court (we wasn't even home when it happened... his kid let the dog out). Anyhow... I'm about done with warnings and assuming that today isn't the day the dogs are going to actually bite me.

      Sue for private nuisance to your property. You can’t be outdoors on your own land because of their acts or omission to act. Water tight case. A reasonable person does not fear their yard because of the neighbors

      @@Sig_P229 This is a rented house. It's not worth the legal expense to do all of that if the cameras, tickets, and other clear deterrents don't work. I'll just move. My job situation could force that at any time anyhow (which is one of the reasons I let this slide as long as I did... and shouldn't have).
      It's also worth mentioning that no one else in the neighborhood has done anything to remedy this situation either and I've seen those dogs go after their kids. They'd apparently rather let their kids get mauled than even be bothered with calling the sheriff and filing a complaint. I don't want to live around people like that anyhow. Frankly, I don't want to live around people at all anymore.

      If the _neighbors_ were renting, oh for sure would I be on their landlord about this. My landlord doesn't even allow dogs for exactly this reason. 😆

    She is some kind of LEO right? Well she made several strategic errors: 1) She had no method of intermediate force everyone would benefit from having something between a harsh word and a gunshot she had nothing, big mistake. 2) She was apparently unable to prove reasonable fear of imminent death or great bodily harm, 3) lack of marksmanship, she hit something but not her assailant, 4) she was in California.

      😂 that’s funny, that’s like the same exact assessment I had. Always use spray first, especially on dogs, and maybe also carry a walking stick (I know some places hate collapsible batons), only use deadly force when you can easily articulate a clear and ongoing imminent threat of harm or death to you or someone nearby in a situation you can’t retreat from (unless in a stand your ground state, even then it’s a good idea to just gtfo there instead, if possible), never use deadly force as a warning for future use of deadly force (lol), and last but not least, don’t live in Cali

    If a dog is a legit threat,and you have a Right to be where you are,then self defence should absolutely be an option. However,don't trespass on somebody else's place then whine and demand a dog be put down if you get bit while being somewhere or doing something you ain't supposed to. I've seen video's of cops walking up and shooting a dog that was on chain and easily avoided. That in my view is completely different than being attacked by dogs when you out in public doing nothing wrong. In the case talked about in this video it sounds to me like California earning its nick name of kommifornia.

    Would this play out similarly if you used a knife to kill or seriously injure a dog in self defense? Not getting into all the different knife laws from every jurisdiction but assuming that it is legal to carry an edged implement instead of discharging a firearm it might avoid serious charges. Not that I want to get into a knife fight with anything I always carry OC with my handgun but just curious.

    I live in rural Louisiana and man I always have to deal with random dogs, especially if I'm on a bicycle. I go on long rides between towns and even across my Parish so I'm usually alone for the most part. Thankfully I haven't had to shoot any, but one time was close was when I was riding my bike uphill in the middle of nowhere on a highway, no houses or anything and a group of dogs were aggressive. That was a tense few minutes of me going up the hill using my bike as a shield between me and the dogs. Eventually I got enough distance and a downhill descent to get away fast enough. I couldn't outrun them on my bicycle going up hill.

    James - almost every tort from before like 1900 has "trespass" or "trespass on the case" as the cause of action. This is because lawyers before 1900 were mostly apprentices who never went to law school and were too stupid to think of other torts or figure out what their names might be. When the federal reporter was invented around the turn of the century, judges started actually requiring you to state a cause of action instead of using a catchall tort and then telling their client to perjure themselves before a bunch of drunken farmers. Hope this helps.

    As a LEO in a large southern city that is not a leftist cesspool...if it can be articulated it was self defense and there is no hard evidence to the contrary...it's highly unlikely you'll be charged with anything here. If the circumstances are a bit sus (no witnesses/no injury/conflicting account)...or your actions were grossly negligent in the process (wildly mag dumping putting others at direct risk of injury or death)...we'll more than likely confer with the State Attorney's Office before making a physical arrest. If it's a clear cut BS story...there'll probably be a one-way ride downtown that night. In short...elections have consequences...

    We had an employee that shot a dog while working in the capacity of armed security in Oceanside, CA . He was responding to a noise complaint knocked on the door and asked the tenant to control his dogs barking and the tenant was drunk and argumentative. Our employee asked him to just please calm his dog down turned to leave and the homeowner basically let his dog out and the dog charged our employee and our employee got bit turned around and put about 3 rounds of .45 ACP in it. This happened in Southern California and it was pretty cut and dry. Oceanside PD basically congratulated our guy on a job well done because all the shots were controlled and stopped the threat. The homeowner tried to sue us for damages (dead dog and distress) and the case was dismissed immediately. The only true pain in the ass was as usual the Department of Consumer Affairs under the Bureau of Security (BSIS) who wanted to disarm the employee despite the police report that absolved him from any criminal wrong doing. That took about 6 months and cost us a lot of money because we were trying to pay him his normal wage while working unarmed until that was resolved so he was basically getting paid 9 dollars an hour over our unarmed rate for doing unarmed work (watching cement grow type jobs).
    Its not always the lawsuits that get you , its all the other outside agencies and nonsense that will get you in California.

      Depends. Pets are considered property. So theoretically, if your state allows deadly force against actors attempting to steal your property, than you would be legally justified to do so. This however does not apply to military or police working dogs. If you try to steal a police or military dog, they are allowed to use deadly force against you…assuming the dog doesn’t get you first.

    What scares me more about the conflicting stories, which is a case of people simply not noticing and processing the same things, is that all of these people who are horrible at noticing and/or processing things going on around them all have driver's licenses. And we share the road with them.

    So I EDC and when I go on walks with my wife in the evening there are dogs that are randomly doing thier dog stuff, one time there was a pit bull mix that snuck up on us from behind, he was literally on my wife’s heals when we noticed him sniff her leg she kinda freaked out as did I but we didn’t run or anything, she goes “what are you going to do in a scared voice” I said “unfortunately let him bite one of us and then a drop his ass” and she goes “really”? And I told her if I shoot this dog right now I’m probably going to jail, so yes let his ass bite one of us” anyway I turned and looked and the dog was walking back in the opposite direction.
    In short only shoot something that you have no other choice to shoot, let the dog bite you, let the criminal give you no other option, and don’t be a hero. We are not the police and we will not be given the benefit of the doubt for our actions.
