- This video is based on Section 5 of Transfer of Property Act, 1882.
Case Laws covered in this video, are:
Sunil Sidharthbai v. Commissioner of Income Tax, 1986 Honorable Supreme Court observed that transfer of property means passing of a right in the property from one person to another.
Pramatha Nath v. Pradyumna it wa held that an idol, however, a juristic person and capable of holding property, is not a living person and therefore, a dedication of a property to an idol is not a transfer and need not be made in writing or by a registered instrument u/s 123 of the Act.
Jugalkishore v. Raw Cotton Co. Ltd. 1955, the Supreme Court held that the words in “present or in future” means the word “coveys” and not the word “property”. When a future property is transferred, the transferee does not get that property or interest therein. Transfer of any non-existent or future property operates only as a contract which may be performed in future and can be enforced as soon as the property comes into existence.

ma'am i have a doubt.. you said property can only be transfer if it exist at that point but what about cases like a builder is building a 4 floor building (HOUSE), his workers are still building the first floor means property does not exist at this point its still in process of making and yet someone purchases the top floor which does not exist at the time and he has paid the sum of money but can only have the property in future when it is made. so is this situation will be void?

Jismein aapko mercantile law n IPC ki videos to mere channel se mil jayengi, constitution ki bhi achhi videos hai TH-cam par . Magar international law ki nhi hai shayad.. aur sabse phle to aap jitna concept videos se clear kr paye kr lijiye kyounki tab aapko Kahi Jana nhi padega chhoti chhoti cheeze dhundne, magar bare acts samne rkh kr hi padhiyega jab padhenge, phir aap last years k question papers study Karna start kijiyega wha se apako sab clear ho jayega.
