    In this video Heimler walks you through another required Supreme Court case for the AP Government curriculum, namely, Citizens United v. Federal Election Commission (FEC).
    This case is all about campaign finance laws and how they affect the first amendment's protection of free speech. And if you think that corporations aren't people, well, then the Supreme Court disagrees with you.

    It's unfortunate that it's so common for people to equate corporations with unions when it comes to campaign funding, when the power of unions have so steadily decreased, while the power of corporations has increased. They really shouldn't be put in the same category.

    One small error: The name of the legislation is the "Bipartisan Campaign Reform Act." Hence the acronym BCRA.
    On to my opinion, which is that corporations are NOT mere associations of individual persons. Corporations are granted privileges which would not otherwise apply to any association of people. Privileges such as limited liability so that shareholders in a corporation cannot be sued for that corporation's wrongdoing.
    Every other democratic country on planet Earth has serious limitations upon corporations influencing election campaigns with corporate money. And not just within 60 days of an election.
    For example, in Canada, corporations and trade unions are banned from donating any money whatsoever to a political party, candidate or third party advocating for a political party, candidate or issue. They are also banned from providing any of their employees to work for a party, candidate or third party advocate.

    • @Lucyyy-1313
      @Lucyyy-1313 ปีที่แล้ว +7

      Hello! I know it’s very late, but I’ll try my best to explain (from my admittedly limited understanding)
      Yes, this decision can be challenged. However, it has to end up in front of the Supreme Court in a case. SCOTUS can’t overturn cases whenever they want to (see the Dobbs ruling - there’s a reason that Dobbs overturned Roe, instead of the bench overturning Roe without prompting). The case also has to have real harm done to the prosecuting party, etc, etc. Also, Citizens United was recent enough that it would be extremely difficult to prove that the precedent is outdated or wrong. (Remember, many of the justices on the bench now were also on the bench for Citizens United.)
      Congress can also ‘overturn’ it through legislation. While this doesn’t remove Citizens United from existing, as Congress cannot actually overturn Supreme Court rulings, they could write (and pass) a law that makes Citizens United unconstitutional. However, it would have to be a constitutional amendment, which is very hard to pass. Additionally, since the effects of Citizens United actively help politicians, Congress probably wouldn’t pass that amendment.
      I hope this helped!

    So I’m watching your videos from the perspective of a 22 year old trying to understand politics. And I really like your content! But- something I noticed and made me think was these “required” vs “non required” cases. As someone trying understand campaign finance, all of these cases seem relevant and important to learn for cultural context. This tendency in the US to focus on what to remember for the test rather than synthesizing and contextualizing info is one of the contributing factors to why people are so politically ignorant, myself included! I remember getting out of highschool feeling like I learned a LOT but didn’t understand the connections between ANYTHING. Bc we memorize events we don’t LEARN how they connect and cause and effect and stuff like that. Idk 🤷🏼‍♀️

    • @ignhoopz
      @ignhoopz ปีที่แล้ว +4

      The difference is for AP gov, college board requires only 15 cases to be known for the exam.. thats why heimler says "required case". Although all cases have some importance

    • @graciewestphal7898
      @graciewestphal7898 ปีที่แล้ว

      Yeah, like @rpqx. said, this channel is technically made to help high schoolers taking AP exams, this one is specifically for the AP Government test. For the test, these cases are required, so while you're not necessarily wrong and it's important to learn about more cases than just these, Heimler's History is focused on helping AP students, not necessarily the general public.
