      Na that case says that the school can't stop individuals from praying at school. It is very specifically saying that banning religion is the same as endorsing it which we already knew because that's what the first amendment is

    I think you'd find the case of Downes v Bidwell interesting, considering they were part of the "Insular Cases" that defined the political classification of the US territories. Thought it'd seem relevant considering all the talk about PR statehood.

    Here is Canada, publically funded Catholic schools are enshrined in the continuation, but because Canada is supposed to be secular, these schools are not supposed to refuse non Catholic students. Which is why growing up I was sent to a Catholic school because my parents didn't like the public option.

    Based on my understanding... The separation of Church and state is a separation of powers. Civil and ecclesiastic authority resides in different bodies in order to have checks and balances which operate in common law structure.
    State law determines legality and Church doctrines determine morality. Phrased differently, the state can make an act illegal but cannot make any act guilty (sin). Church doctrines determine which acts are guilty (sin) but cannot make any act illegal. A defendant may choose a bench trial in which the laws of the state will be applied without regard to morality, or they may choose a trial by jury in which the jurors are sworn to give a true verdict. An intrinsically innocent act cannot be converted into a crime by the state.
    This separation of powers also permits a specialization of labor. If held to the limitations within the Christian bible, "the sword" is only to be used against those who do evil. The state gains legitimacy because it is not dividing people and creating turmoil in attempts to force people to be virtuous; and the Church is free to extol the highest virtues because it does not bear "the sword" to force virtuous behavior. This separation of powers creates a middle ground where people are free to use their discretion. ... A unified civil/ecclesiastic authority will compromise the virtues it preaches because they must be watered down enough to be enforced; and the state will be oppressive and tyrannical because force will be used in efforts to create virtuous behavior.

    I'm big on separation of church and state, but I actually wasn't immediately sure on that one. I mean, it's not a slam dunk like it would be if, I don't know, the government decided to do something crazy like establish the existence and virtue of god on all of the money they issue. You know, just as an example.

    First of all, the government didn't establish a religion, it's just supplemented already previously existing one, in this case, *Catholicism* when the Constitution talks about establishing a religion is talking about a 'state religion' in layman's terms, the government saying one religion is correct while the other religion isn't.

If not, then, it's hard for me to see how when the government does vice versa that's "favoring" religion.

      @@theflaggedyoutuberii4311 My point is that followers of a religion are not exempt from paying taxes, but religions are. Expecting followers of a religion to be exempt from taxes is absurd, as is thinking that religious people paying taxes is akin to religions paying taxes.
      In any case, you are focussing on the wrong thing here, as seems to be a quality of yours. It's not a question of who exactly a citizen is and who pays taxes, it's a question of what constitutes an establishment of religion. Clearly, individual followers of a religion do not constitute an establishment of religion.
      As to who is talking to me, you are. You are commenting publicly on a platform available to all. All may read and all may reply. If you'd rather not recieve replies from anyone and everyone, you may restrict yourself to a private exchange where only those you choose may read and reply.

    The Lemon test seem fine but there should be a way to help private schools strugling financially without donating to a church. It seems pretty obvious that these laws were meant to give children in those private schools a better education, not to side with any religions

    I am very much a believer in the separation of church & state. If the “church” receives any funding then they have to pay taxes like any other business. If this is the case a tax will hurt the very small religious orders only to benefit the larger ones.
    Today’s MEGA churches reap millions of dollars, getting involved in politics that have disrupted the selection process of people running for local & federal offices. Government & religion do not mix as has been seen in through centuries. A “state mandated” religion will give more power to one & the non recognized religions will leave or cease to exist.

    “Separation of Church and State” is not part of the constitution. All the constitution says is that the government can’t favor or disfavor any religion.
    The constitution was written with English history in mind; specifically, the late Tudors. The Founders were afraid of a scenario where different sects would be fighting each other to avoid persecution.
    When people mention Jefferson’s letter with that phrase, they forget that a) Jefferson wasn’t even in the country when the constitution was being written, and b) his saying that phrase was in response to someone’s fear of persecution.
    Barring certain lucky evidence being found in certain scenarios, judging by intent is really hard to do, especially with the presumption of innocence standard.

    Gotta be honest. I don’t like separation of church and state* I feel like if a smaller government wants to support its local religious institutions it should have the power too, if people don’t like it they should vote. But not on the county, state, and federal level, and not in anyway that actively or passively hinders free practice of another religion or lack there of.

    I would strenuously to diverting public education funds to a for-profit school, religious or not. So what if they're struggling; failing businesses may merit a bail-out in the form of loans, but not what amounts to a direct donation from the taxpayers.
