Thanks for covering this case. I’m a Dover resident and have been following and speaking out against these incidents since they occurred. What’s even more disgusting is the official public statement that was released by the Dover Marshal’s Office that tried to blame the Duos brothers saying that they had been repeatedly causing issues even though they were no allegations or charges prior to this arrest aside from a minor traffic infraction and then they tried to make false claims about Justin saying he was tampering with a police vehicle, harassing staff and citizens inside the building, and stated this gem of lies. “While escorting Machenry into the building for processing, Machenry thrust his right shoulder into Capt. Lillard’s left chest and drove his right elbow into Capt. Lillard’s left side, causing him to rotate 90 degrees to the left and strike his back against the door frame.” They tried to cover up both incidents and totally excused the officers behavior. After several public backlash Dover Marshals office has since removed their entire Facebook page.

It's not that they are being given special treatment; it's that the law itself requires the act to be intentional, before they are liable. Mistakes are protected for everyone, not just cops, in civil court. None of that is true in criminal court. Our country is full of cops who ignore Supreme Court rulings that have been in force since before they were born. Not only are there many cops who ignore the law and the constitution but prosecutors and local judges who find people guilty and railroad citizens who don’t have the money to appeal the cases . Cases being dropped at the last minute or dismissed is not enough even when citizens sue and get paid there are zero consequences for prosecutors or judges and most times a bad cop might resign and move to another department but there is no real punishment. As long as there are no real penalties for corrupt and tyrannical behaviour cops will continue to abuse their powers and let their egos run wild . Systemic bullying intimidation and corrupt behaviour is endemic among law enforcement at all levels and tacitly supported , if not actively encouraged by police unions local politicians and Mayors .

Thats what you get when you give people with a low grade Highschool diploma and just 6 weeks of training a Badge and the power of authority. I am German and our cops have to have a higher school graduation and at least 3,5 Years of training. All of that only gets you in a patrol car at the lowest wage and only under observation by a senior officer for a substantial time frame. If you want more you seriously have to do more and KNOW more.

LIn my area we have a nice little thing called castle doctrine and it doesn’t matter if you are a law enforcement officer or not, you make a move like that on a person they are allowed to protect themselves. Most of the law enforcement officers I have dealt with in my area know this and tend to be more level headed. You never know the level a person may be trained and making a stupid move like that could get you seriously hurt. So kudos to the auditors for having more restraint than I would have exercised in that situation. I am not a badass and may have got my ass beat but the idiot would have not made it out unscathed. He will either receive some additional training, or retire. Once it comes back down from the appeals court, it will give the captain plenty of time to make a plan. 4-5 years of no resolution, and 4-5 years with a captain with this behavior.

This is why all public servants should wear body camera's that start recording the second they clock to the second they clock off without an ability to stop mute or manipulate in any way & will punished for doing so including up to criminal charges & termination. Our country is full of cops who ignore Supreme Court rulings that have been in force since before they were born. Not only are there many cops who ignore the law and the constitution but prosecutors and local judges who find people guilty and railroad citizens who don’t have the money to appeal the cases . Cases being dropped at the last minute or dismissed is not enough even when citizens sue and get paid there are zero consequences for prosecutors or judges and most times a bad cop might resign and move to another department but there is no real punishment. As long as there are no real penalties for corrupt and tyrannical behaviour cops will continue to abuse their powers and let their egos run wild . I am German and our cops have to have a higher school graduation and at least 3,5 Years of training. All of that only gets you in a patrol car at the lowest wage and only under observation by a senior officer for a substantial time frame. If you want more you seriously have to do more and KNOW more.

LIn my area we have a nice little thing called castle doctrine and it doesn’t matter if you are a law enforcement officer or not, you make a move like that on a person they are allowed to protect themselves. Most of the law enforcement officers I have dealt with in my area know this and tend to be more level headed. You never know the level a person may be trained and making a stupid move like that could get you seriously hurt. So kudos to the auditors for having more restraint than I would have exercised in that situation. I am not a badass and may have got my ass beat but the idiot would have not made it out unscathed. I spent 20 years in the military and people like that cop make me sick.

This is why all public servants should wear body camera's that start recording the second they clock to the second they clock off without an ability to stop mute or manipulate in any way & will punished for doing so including up to criminal charges & termination.

If they learn the law, then they could be held responsible when they violate the law. ignorance of the law only counts for you the citizen, ignorance of the law to them keeps their qualified immunity in place if they know they’re violating the law then they lose their qualified immunity, so it pays for them to be stupid.

Nowadays I see so many of these videos where the cop just reaches out and grabs you! Then twists your arm, and acts like you are not supposed to have any negative reaction to such an action. Nowadays they seem to treat you as if, “You are a violent criminal and I’m going to treat you as such!” Even if you obviously are not.
