    One time, a new firm sent me a cease and desist and threat of a suit out of the blue because of a domain I owned. I had owned this domain for several years. I sent them a letter stating that, based on dates of registration and founding, it was I that actually owned their firm's name, and soon they would receive a cease and desist from me.
    They countered with a more cordial tone and an offer to buy my domain at a more than fair price. Thing is, if they had just contacted me politely, I would have sold the domain to them for 30 times less than what they paid me, and they would not have had to pay their attorney's anything as well.
    Bullies bullying had to pay up.

      After a little research it seems Doug registered the domain in 1999, 5 years before the UK company came on the go. So the funny thing is if this is correct if Doug took out an international trademark through the Madrid Protocol he could possibly force the guy to change his company name as he used the name in the market first.

      BTW, Ed, speaking of lawyers, You need to have Steve Lehto on this channel talking about some of the fun he's had with lemon law lawsuits and his own foray into the car world. He used to own an Army Deuce and a Half and some muscle cars. He's also written books about Richard Petty, NASCAR, and the Superbirds and Dodge's winged cars.

      In my experience with the court system in the US, it’s basically like a 10 year old sibling argument. The whole thing is an absolute joke, but if you don’t play their game and argue back then you’re going to get screwed.

    The idea of public domains is brilliant but flipping them is a whole other level of genius. Back in the 90s people would just lock in OG domain names as if they were character names in popular video games with the sheer hopes of selling them. I am glad Doug knew his way around the particular set of laws he was up against!

    I can relate to this story. Shrewd negotiation is perfectly fine until they cross the line and hit a nerve. And once they cross that line I will NOT do the deal. I was selling an item on eBay via the 2nd chance offer. I offered to sell it to the guy at the price where he got outbid. After a couple of days of haggling over a $50 I was ready to give in and let him have it until he said, "The market value of the item is steadily decreasing. It would do you well to sell it to me. Otherwise you’re going to miss out. I also calculated what it would cost you to relist the item and ship it to another buyer. Your net profit will be much less than what I’m offering you right now."( This was the mild version of what the guy actually said to me in email) So I replied by saying, “OK. No thank you. I’m not interested in going forward. I have another interested buyer. If I happen to find another one of these do-hicky gadgets in the future I’ll reach out to you.” What ticked me off was that he decided to discuss what it would cost me to not do business with him. I couldn’t help but to snub the guy as a matter of general principle when he thought he had me over a barrel. To add insult to injury, I publicly resisted the item and sold it to someone else for less than the first guy's asking price.

    Apparently Ed stepped in and bought the site for $250 from Doug... then after watching a single TH-cam video...spent $4750 on Search Engine Optimization for Google. He’s now in negotiations with the UK’s 🇬🇧 largest direct limousine for hire service. Their first offer was $50,000 but Ed politely declined and countered with $325,000 assuring them he would wait before notifying ALL their competitors and secondary brokers. Ed had one final statement before boarding a private jet to the U.K. 🇬🇧...

    For starters, I have a deep knowledge of Trademarks, he is absolutely right about the nuances in the Trademark laws (vs copyright). But most importantly, he has very practical knowledge of how the lawsuit is implemented.

    This video should be used in business schools - related to negotiations and Trademark law. Every step of the way he has shown a mastery of how to practically negotiate. Void of emotion, he is absolutely able to say, we are both smoking crack on our first offer, now let's find some common ground.
    .
    It also shows that if the UK person had not been lazy, done some investigating into the website owner, he would have seen that the owner did draw value from the website and would have to have prepared a more valuable offer (rather than a mere 500 bucks).
    .
    you know, a simple phone call and "pleasant discussion" could have resulted in getting a gut feeling of the website value, making a new friend and more reasonable offer that would result in a successful transaction.
    .
    Instead the Brit chose to do some sort of lazy childish hard ball and got no where.

    When the buyer changes the tense of the negotiation ( instead of making an offer on something you've told them is not for sale, they ask what you want for it) then tell them to get lost because you can get into a legal situation that your not bargaining in good faith.
    When they try turning you into a seller instead of them as a buyer you know you're being conned.
    Don't try to be all cool about and think you can out con them.
    They have thought long and hard about this and have got more ways to get you than you've thought up to get them.
    Just tell them to walk away.

    Reminds me of the guy at a flea market who was selling a lamp. He wanted $25, a woman came up and offered him $5. He said no, she said you won't get a better offer, I'll be back later. She came back and asked if he had changed his mind. He said no, she said look the days half over, you probably won't be able to sell it why don't you give it to me for $10, he said no. She came back again at closing and said look you haven't sold it, instead of dragging it back home I'll give you $5 for it. The man replied I'm not taking it home, with that he threw it on the ground and broke it into a hundred pieces. The woman screamed why did you do that to such a beautiful lamp. To which the man replied it can't be that beautiful cause nobody bought even at $25.

    I've found that in most interactions it's always best to lead by being nice and putting the other person in a position where they like you and want to help you. Worst case scenario is that it doesn't get you anything and you still have the option to get tough later. But more often than not it can be beneficial. We were looking at buying a car and the dealership tried to tack on all kinds of additional charges and fees-and was insulting when we insisted on paying the price quoted. They finally came back with a good deal, but at that point we were done with them on principle.

      @One Two True story and to the people who are up in arms about the $500 offer... Doug and Ed lowball on every first offer. That’s how the game is played... Ed even admitted it in a video and said he gets hate messages all the time for low balling. If that guy would have offered $5000 Doug would NOT have accepted the deal. In the entire history of shrewd negotiating not one single first offer of “make me an offer” has been accepted. It’s contrary to shrewd negotiating...

      @@xrayron9557 Absolutely, you always try to get the other guy to go first then you go a couple rounds regardless to get the best offer from both sides.
      Some people are poor negotiators and do take lowball offers. All you have to do is watch that Pawn Stars show.

    I wish I could buy that domain name from Doug. I don't have the money to build the business around it, let alone the asking price for the site that Doug wants. If I were to get it, I'd probably create some sort of car rental or matchmaking service catering to the TV/Movie industry.

    Awesome story 'cuz it's so reminiscent of a similiar situation my company had with another company that tried to legally intimidate us with trademark infringement on a domain we owned many years ago. Same scenario - our companies were in two separate countries, and the only commonality in the domain was the adjective 'Wicked'. After being contacted by their "in-house" attorney with threats of lawsuit...I contacted my own attorney for legal advice. He suggested we offer to sell them the domain - but ask a ridiculous price. Similiarly, we weren't making much use of the domain at the time and hadn't generated much traffic to it...so I opted to offer it for sale. We negotiated back and forth and we ended up selling it for substantially more than we could have earned from it in revenue. Two years later they allowed the domain to expire (lol)...and as tempted as I was to re-register it again...I left it idle.

    I’m a commercial litigator with 25 years experience. People like the Brit who tried to bully this guy into selling carsforstarz.com for basically nothing are the reason why commercial litigators have jobs. If people would only be reasonable and not greedy and crazy and ruled by their ego there would be very little litigation.

    I had this same experience some years ago with a Chinese company that wanted my domain. They offered $5, I said 10K. Instead of coming to a middle ground, they spent at least 10 times that putting me out of business. They contacted me some months afterwards that it went that way essentially for bragging rights for being able to squash a mom and pop business. Yeah, way to go Wang Chung...
