      These are re all very good and informational and e.lowering as an employee. I lost a job yearss. Ago for attending a requested in add vance funeral. When i returned to work i found that the locks were changed my keys didnt work. After knocking. Was told I n;o longer worked there. I knocked again saying "You cannot do that " door opened told to hand over keys told i had no business go to any guys funeral. I turned to leave saying "that was a very close friend of mine . i gave notice . and before i knew it i was swirled around and slapped to the ground. "What are you doing!" He left i got up shocked and my disabeled daughter & i were thrown into a. Season of awful chaos because
      was knocked i also rented an apartment it was rented out from under us. I forgot all about unemployment or fighting it i onli knew i ad to take care if my girl. Just listening to your short to the point videos was so relieving.

    Please clarify the benefit for a California resident filing CFRA versus FMLA. I have listened to both videos and the only difference I heard was military and the same sex unmarried couples।
    Thank you

    Thank you so much for this helpful video. i have a question. so the CFRA allows you to take 12 weeks of leave in 12 months. whether in one go or intermittently, so e.g. if an employee has been working for a company for more than 2 years how many CFRA leaves does he have in his pool.

    CFRA leaves are counted every calander year or the date of joining of the employee the 12 months period will count.
    Also are these CFRA leaves carried forward every year like if an employee has used 10 weeks of leave out of 12 this year so next year will he be having 14 weeks of CFRA or they are only refreshed every year.

    Do Teachers Aids in California qualify for FMLA or CFRA? I have worked for the employer for 7 years and work 6 hours a day and have June and July off. I was told we don't qualify because we do not meet the 1,250 hours. Is this information accurate? I know some that have taken it and have the same position i do. I would really appreciate some feedback on this.

    Hi, I don’t qualify for additional absence of leave with my company but I still applied & the state is paying me PFL for baby bonding time. My work told me to go back to work or I can loose my job since I didn’t reach the amount of hours within a year. If I were to put my 2 weeks of notice of work can I still claim my PFL benefits or would it stop? Also would I need to pay the money back if I were to put my 2 weeks in?

My employer gave me more 60 days of under ADA, but right now im not sure when the surgery will take place amd how long my recovery will be. My employer told me if i don't come back by the end of the 60 days with a doctor's note that i can do my job without any restrictions they will fired me. What i can do??

      Without knowing more, it's possible that you've exhausted all of the leave of absence rights that CA has created for employees. You may be out of luck as far as job protection goes.

    I been working almost 4 years in the same company. I’m 38 weeks pregnant my obgyn take me out of work at 36 weeks because I was positive of covid and I been having contractions. Company didn’t pay me my quarantine, and now they said I don’t qualify for baby bonding because I’m short 47 hours. Please I need your help? I’m so stress and confuse. ( I talk to HR on Jan and they said I don’t have to worry about the hours now is a whole different story) I’m son upset

      @itstaniia 3 ปีที่แล้ว +1

      If you’re in CA you can apply for disability from 36 weeks since your OB put you on leave. After birth, you get 6-8 weeks of disability and then you get 8 weeks of PML. Then, you can take 4 weeks of unpaid leave because the FMLA allows you to take 12 weeks. It’s CA law and every company must follow it.

    The lawyer gets the big money! The person who's right were violated will only end up with if they're lucky $10,000 while the lawyer will end up with $300,000 or more so us it really worth your time to make somebody els rich?

    • @braniganrobertsonlaw
      @braniganrobertsonlaw  3 ปีที่แล้ว

      I think there is something wrong with your math. I've never been paid a 96% contingency fee. That would be unconscionable. If your lawyer charged you that in an individual case (excluding class actions as those function very differently) then you should report him/her to your State's bar. Why would anyone agree to that in the first place?
