      These lawyers have business built around these claims. In San Francisco they barred a attorney from filing theses claims he was doing it all over SF and LA. He had one client that filed over 3000 claims and would never vist the business themself. This should be considered extortion especially when they comply and they still sue.

      There are no damages. The businesses are out of compliance with the ADA and obligated to make changes. Unfortunately, the way the ADA is structured, it relies on a bounty system to encourage businesses to comply.

    This so called lawer Jessica Molligan who appears to be targeting Asian businesses has been disciplined by the state bar before for professional misconduct (the article never makes mention of either)and was prohibited from practicing law in the past but got back her ability to do so since.Maybe she’s just a crummy lawyer and can’t get legitimate clients through regular channels.

    There was a guy in AZ who's law license was suspended for filing ADA frivolous lawsuits. It's a scam. They intentionally target very small business owners who they believe cannot afford big wig representation, and are usually forced to settle. Typically, none of these lawyers are disabled, nor are the filing on behalf of someone with a disability.

      Yup. California several years ago. A SoCal firm had a guy go around in his electric wheelchair. Most targeted were business with a stepped entrance on a sloped street where it would be impossible to make the place ADA compliant without taking over the entire sidewalk. Lawyers failed to read exceptions.

    I saw another youtube news station video in another state just recently reporting this exact issue! An out of state lawyer hired a local firm to represent them and went after small businesses for ADA violations. They are using Google earth and drone footage to find “violations”, demand fixes and fees in a very short time period and then file with court even after changes were made. I am going through my viewing history to find the video and send the link. This is hideous behavior and sounds, like Kyle says, unethical, at best!

      There should be no consequences for a business that actually fixes things when they're pointed out.
      They should have 1-3 months to fix what needs fixing without any consequences.
      That she did it in 6 days is really awesome.
      Now if they refuse to fix things or take a ridiculously long time to grudgingly finally fix it then there should be some consequences. But it should be from something like the ADA not an individual.
      Personally if I had a business I'd download all the requirements & go through to insure everything complies.
      Then there's no worries about some a-hole using ADA laws to extort money.
      Also those who need the requirements really really appreciate them.

      It's also quite possible that when you first start your business, you are ADA compliant but ADA guidelines change and now 10 years you're out of compliance and you'd have no idea.

    I am half South Korean and the word from the Korean side of my family that lives in the US is that there are legal scammers like this who target Asian owned businesses who will make phone calls or visits in person to imply that if the victims don't cooperate, their naturalisation status will be cancelled and they will be deported. Yes, US citizens are being threatened with deportation--and the victims have the impression that these lawyers have the clout to file the paperwork to make that happen, not realising that such legal action is almost vanishingly rare.

    It's particularly unfortunate since you can see the good will behind laws like the ADA and some others like service animal protections, but there are plenty of people who only see something they can exploit for their own selfish reasons. Don't know what it would take to tighten up those laws so they aren't used as a racketeering tool.

    I saw a series of investigations from an Arizona station on the same thing. One law firm sued a ton of people of one guys behalf. Funny thing is, the law offices had multiple ADA violations. It’s a racket and I hope they keep pressing this.

    An ADA compliance scam happened in California before being shut down.
    One can go to asian restaurants, non-asian stores with entrances on city sloping sidewalks. There is no way they can become ADA compliant, but get targeted anyway.

    This is a problem everywhere; there was an A&W car hop in Modesto CA that was in business since the ‘50s (and likely George Lucas ate there during his high school years). Then last year they announced they had no alternative, but to close down the restaurant permanently. They had been sued for an ADA violation and lost. The plaintiff and the lawyer is said to have been involved in a number of such suits. Only to add insult to injury the owners were finally looking at retiring and selling the restaurant so it legacy would continue when they got hit with the suit. I’m disabled, and these types of suits sicken me. Civil suits should have no place in this, and should only be a matter of regulation and enforcement by the local government. Yeah, these business owners were in violation; so in that regard they are not victims, but I shouldn’t be entitled to money from them for not having disabled parking. It should be as simple as report them, and they fix it within say 30 days or they get hit with a hefty fine.

    These types of lawyers have been around for a while. There used to be some piece of garbage who was a lawyer in a wheelchair, and went to restaurants, cafes, gas stations, etc., and sued them anytime he could find a place where the counter was one inch too high, the ramp didn't meet guidelines, etc. They're just people who have learned how to extort their income.

    About 20 years ago or more, there was another lawyer doing the same, but he was not targeting any ethic group, but would go to businesses and check their parking lot and sue. Even sued an elderly couple whose business was to sell handicap equipment.

    They should have also mentioned that unless she did a tenant improvement to her space that required a permit and the work triggered certain areas/all of the space to be brought into ADA compliance, it's an existing building/space and you are not required to bring a space into compliance unless triggered by code. And even then, there are safe harbors for very old buildings where it's infeasible (not the case here, but just giving context). So, my point is it's also not illegal to simply own/operate a space that isn't ADA compliant.

    @KGW News - its a modern form of ambulance chasing. The Tenesse firm probably does this in many states because its easy money. I would recommend you look into the firm a little harder. There is a similar firm that targets "toxic" ingredients in the cosmetic industry and another firm that targets false advertising in the food industry.

    Many businesses have struggled with this issue. It is NOT just "Asian" owners. Gaslighting this as a race based issues does nothing but undermine and separate the effective group of owners as a whole. There needs to be a collective action against the overreach of ADA & it's member's.

      It’s not the ADA, it’s people using good laws for nefarious purposes. In this case it seems racketeering and extortion laws should apply.

      @@coopersy I agree somewhat - that's it's those abusing laws that cause much of the issue. However - the problem begins with bad laws (easily abused laws) that fail to protect everyone equally. Being disabled doesn't grant an individual a right to cause undue harm to someone else. Unfortunately loose laws leave gaping holes that are abused often.
      The attorneys involved should have their licenses revoked for extortion.

    But were the businesses in violation ? As a disabled person I can say I am shocked by the lack of accommodations I find when I go out in public and because of that I limit where I go to places that I know are compliant.

    As someone who is disabled I think this is horrible. I would be the first to point out to them that they may need to improve access for me but to sue them right from the start a small business? It’s not like you are talking about Walmart, Target, or some huge corporation that has a department dedicated to ensuring they are in compliance. Also from what I seen and heard it seemed very small infractions and all this was is a money grab on people who could barely afford it. Lawyers targeting people they knew who couldn’t mount a legal defense. I’m all for going after people who target the disabled but these people clearly are not them. Were they not up to date on every single law on the ADA most likely were they purposely trying to hurt the disabled I would bet a great deal of money they were not. I personally have been to many places that technically don’t meet every new requirement of the ADA but are still ADA friendly and when I have brought the shortcomings to someone in charge they have been apologetic and helpful and said they would look into fixing it. If it has been I route I take on occasion more often that not it has been fixed and I find someone to compliment about the changes. People for the most part are good. It reminds me of the old joke “what do you call a thousands lawyers at the bottom of the ocean? A good start!”

      This. All ^THIS. Not everyone knows all the details, or how local laws change over time, or what is/isn't grandfathered in. I saw the "van" sign violation and ??????. I've known about accessible parking. And accessible parking signs. Never heard there needed to be a specific sign for vans. The fact that the threatening letters didn't bother to mention what violations were involved - tells you everything you need to know - they're not protecting access for the disabled - they're committing a shakedown.

    It might be "legal", but it deserves constitutional scrutiny, because every jerk with a lawyer can basically inject whatever bias they wish.
    Since this happened across state lines, the law of both states, and (often broader) federal protections apply.
    If and when they eventually get sued for their activity, as law firms, they will have to give up all their internal documents as part of discovery.

    You'd think that the community in such a progressive city would have the decent sense to support minority-owned businesses and communities, rather than targeting them like they're victims of protection rackets. An outside power behind this just makes it all the more muddier.

      BS. The woman said that she would have willingly done what was needed to be code compliant. All she needed was to be informed of the issues. NO ONE had ever complained before until this Shylock showed up and tried to line her own pockets over petty violations.
      If a disabled person has an issue with a small business over a violation, have some integrity and inform the owner of the problem. If the owner refuses to comply, then go after them. Don't allow some huckster lawyer to go searching for violations that's never bothered anyone before, just so that lawyer can make some easy cash. Compliance can be achieved through ethical means and we don't have to resort to corruption.

    This is a shake down. Disability advocate lawyers do NOT ago after small businesses like this. They will first talk to the business owners, tell them what is needed, and work with them to specifically meet the ADA requirements. This is totally a criminal scam that these Tennessee lawyers figured out and then hired this local attorney to implement. Imo, these people are criminals. As a disabled person, this makes me furious that they are using the ADA laws, meant to protect other vulnerable groups of people, by bullying and extorting Asian Americans in this way. Keep on this story please!

    I'm the daughter of immigrants and it absolutely riles me up when fellow immigrants are targeted like this. The audacity. This is bullying. And it needs to be stopped. I think it's safe to say most children of immigrants have had to learn to fight back and advocate on behalf of their parents or families very early on in life. I will go to battle to seek justice for my family and I can't even stand my family. But nobody better mess with them

    My question is how is an out of state firm finding these violations .I would advise all these small businesses to ask for a review of all the requirements need to operate there businesses from the city ,county and state for a start .this is and obvious harassment for the making of money by an out of state company .
