1. There was no country named India before 1947. British occupied multiple territories and merged it and formed two nations in 1947. Kashmir was not part of India but was included in India in 1947.
2. As per constitution, India is a federal republic. In a federal republic, each states has some different sets of law.
This is one of the STRANGEST CASE. Here SC is trying to convince a Lawyer whereas it's the job of lawyer to convince the Court, A Supreme Court. Laughable process of judiciary.
Lawyer is assumed to be wise because of seniority. But one thing is clear. Each one of the judges is trying to tell him that his line of argument is outdated, of course, without hurting him. He is refusing to recognize that they are respecting his age but not wisdom.
Illiterate people telling because of their bhakti that the honorable supreme court is laughable, but they forget to understand that if supreme court gets compromised by politicians then this country will go back to stone age and the age of maai-baap era of zamindari system....

@@secular_citizen No Sir, He says Union Govt cannot touch 370 unless recommended by "Constituent" assemble of J&K which was resolved back in 1957. J&K "Legislature" Assembly is also not authorized to recommend. Even President cannot initiate it.
His argument is basically that "Constituent" assemble of J&K should be formed first, by dissolving J&K "Legislature" Assembly then only they can recommend.

Every Law in the Constitution of India and its reforms comes under the purview of Judicial review which cannot be denied. And Judicial review is much needed in a civilised society with democratic values.

Also note that this hearing is not only viewed by Indians but by the whole world. As J&K is the reason of friction between India and Pakistan. That's why you can see the Judges all calm and composed and letting Sibal to keep his points in a respectful manner.
That's the beauty of India. We are transparent even though there is lot of internal clutter. If this was Pakistan Mr Sibbal would have been killed for speaking against the govt.

Well for India, Pakistan is buried but we need to wipe out our memories by getting to Numero Uno not 2 or 3. That should be practically and strategically done by our politicians in the next 25yrs. Our. Institution is not a sacred document given by the divine. Citizens of India in 1952 have given themselves a constitution, appropriate for their times.
We the citizens 2023 have the same right to amend or give a whole new constitution,as per our present situation.

Has Sr.Advocate Gopal Subramanium advocated that Article 370 should go. Relying only on the Constituent Assembly prior to the state adopting acRepublic form of govt and the constitution of India. They are following it as their constitution of J&K . The constitution can be amended with the development in their accepting Indian Parliament, Presdent who appoints tge Governor .

@@soumyadeepsengupta9797 SC has right and power to declare unconstitutional but As a spirit of our constitutional structure and spirit SC always hesitate to comment or pass verdict against the parliamentary resolution because generally it assumes Act by parliament cannot be abusive in nature or abusive to the fundamental rights but executive order or ordinance may be abusive. So SC always forwards to a constitutional bench in such case resulting a prolong post scenario of post-Act affects are precisely reflected publicly. And hence the case challenged ll have a clear picture of that act passed . Therefore in this case since 4 years are already over and the JK people are satisfied sufficiently then SC can't give a verdict against the parliamentary act.

Going by the way cases are filed left and right, it appears that, after 2014, the precious time of the judiciary is being eaten by a handful of self styled legal luminaries.
The court should take up suo moto the plight thousands of undertrials in jails for years and order the Govt to release them. Some of them are for petty cases.
These so-called celebrity layers are denying justice to the small hapless undertrials.
I have been watching Kapil sibal in many cases. As a common man my opinion is that rather than making valid points , he relies on bulldozing and making fun of comments by judges. Very intimidating person and the judges look like they are intimidated by him.
Had this case was about Nupur Sharma or of a Hindu, SC would become outraged and sentenced the victim in 1st couple of mins.

Needless Waste of time. President has all the powers and in line with the Parliament duly elected by the people of India. They are interpreting minor words here and there to suit their own convenience. These have to be read as a whole. The preamble for enacting should be the main concern. Having said then the effects of such order by the President and more so, in current circumstances where 4 years have elapsed the overall mood and will of the needs to be taken into account as a support to the presidential order. It is as simple as that. To hell with the frivolous petitions which has a right place in the waste bin.
Does this man requires so much time to be given to present his case? Ive heard in higher courts of the west , limited time is allowed to present the case in terms of time slots and date n time of judgement is published in advance.
