      All three of my DUI convictions were in the same year and over 44 years ago? All were pullover & arrest offenses and without accident or incident. (Pull over and blow into a small black box!)
      Further, all three DUIs were acquired after returning home from serving 6 years as a United States Marine and the last two years in Iran during the Iranian hostage crisis as a foreign interrogator! (1979)
      Coming back from Iran was very difficult because of PTSD. (If you know what that is?)
      Many veterans at the time weren't as fortunate having decided to take their own lives (As many still do today) rather than fight the head demons. Alcohol was the only relief under the circumstances since drugs were never an option. That was 44 years ago and before having my own family and grandchildren!
      I served my country as a United States Marine and cannot even possess a single bullet, for life ...
      However, we currently own fast-food franchises in three different states (We Left Michigan) creating hundreds of jobs in other states!
      Drinking and driving have never had anything to do with 2nd amendment gun rights!
      Heck, the DUI felon can still lawfully carry black powder rifles and handguns while driving and you don't see them shooting up the streets do you? No, of course not... The two have no nexus with each other!..

    This happens to me. Devastated my life. Even though charges weren't filed the arrest stays on your background check, especially for government jobs. Laws need changed.

      They're their own little mob. No snitching, no breaking ranks, everybody knows what everybody else has done, so they feel their silence and loyalty is the only way to avoid them being guilty of complicity. And every new member gets indoctrinated into that bully culture.
      It's basically the definition of toxic masculinity, but with a gun, a badge, and qualified immunity.

      They are above the law. Even in the areas where it is a crime for one officer not to report police misconduct, they still skip that part.

    Thanks for all the TH-cam auditors for shedding so much light on this. I live in this state and between Loveland, Idaho Springs, Ft. Collins and Denver. This is literally happening all over this state and our AG refuses to look into it. Know your rights folks, these officers are no longer here to support us.

    All those people who got arrested for DUI and tested clean should join together for a massive class action suit. It would be much more impressive for a jury to see that this is a systematic problem with the police department and not just one isolated instance.

    "Drug recognition" officers need to be regarded with close scrutiny. They have been granted the ability to make up a crime out of thin air based solely on their perception. "I deem that you have been using illicit substances and shall be arrested!"

      They have been busted in some states for doing this with pot detection. They act like doctors and they are not doctors. Theses programs need to be stopped.

    A few decades ago I was pulled over for suspected DUI in Fort Collins. brought to the jail and sat there all night. They never gave me a test and int he end said I refused. When in court I asked to show the tape of me saying I refused they could not produce one and I STILL got a DUI arrest. Its all bogus! They ruined my life for so long.

      Kind of the same here, was accused of DUI because I was speeding, refused roadside test and asked for a breath test. He said it hadn't been configured yet so I'd have to go to the station. I did, passed the test with triple zeroes but the officer said he believed I was on pills. I had to do a urine test and I sat in jail for 49 days waiting for the results to come back (I was single at the time and no close friends or family so no bond) and when they finally did the prosecutor, instead of dropping the charges, amended them to reckless driving and disregard for public safety. I was going 61 in a 55 and the judge said it was unethical to fish for a guilty plea like this and he threw the case out. I retained a lawyer and won a 13,000 settlement. I was 20 when this happened, I'm 52 now and that money is long gone but I've never had an issue like that since. I know what it feels like, even happening once is enough to change your attitude towards police. I don't wish them ill will but there are several of them who are bigger criminals than the ones they arrest. It's just sad.

      Never take a roadside sobriety test. You can’t pass. The tests aren’t designed to be passed, just failed to justify an arrest. Always demand a breathalyzer.

    I'm amazed at the people who persist in equating
    the legal system with a justice system. In the US
    we have a legal system. The goal of each side in
    a criminal case is to win and not to find the truth.
    Never talk to a cop without a lawyer. Ever.

      I've seen some bizarre things in court and in my own life. I had a shipmate in the U.S. Navy be convicted of breaking a store window. The witness said the person who broke the window was 5" 8" tall. My shipmate was 6" 0" tall. Both the police, the prosecuting attorney and the jury found that difference to be acceptable. And the guy who broke the store window wore a waist length coat while my shipmate wore a Navy raincoat that went down to his calves and was even a different color. My shipmate received a dishonorable discharge for that conviction.

      Aside from the USA no one does Field Sobriety Tests. We are in the twenty-first century not in 1880. Other countries the police have breathalyzers and other (urine) tests for cannabis and other drugs.

      When DUI offenses are in FACT, victimless (Pullover blow & arrests) and void of the second party, should never eternally remove gun rights!...
      All three of my DUI convictions were in the same year and over 44 years ago? All were pullover & arrest offenses and without accident or incident. (Pull over and blow into a small black box!)
      Further, all three DUIs were acquired after returning home from serving 6 years as a United States Marine and the last two years in Iran during the Iranian hostage crisis as a foreign interrogator! (1979)
      Coming back from Iran was very difficult because of PTSD. (If you know what that is?)
      Many veterans at the time weren't as fortunate having decided to take their own lives (As many still do today) rather than fight the head demons. Alcohol was the only relief under the circumstances since drugs were never an option. That was 44 years ago and before having my own family and grandchildren!
      I served my country as a United States Marine and cannot even possess a single bullet, for life ...
      However, we currently own fast-food franchises in three different states (We Left Michigan) creating hundreds of jobs in other states!
      Drinking and driving have never had anything to do with 2nd amendment gun rights!
      Heck, the DUI felon can still lawfully carry black powder rifles and handguns while driving and you don't see them shooting up the streets do you? No, of course not... The two have no nexus with each other!..

      ​@@turtletruth That's weird. 43 years ago I was arrested for DUI by the same cop, THREE TIMES. It happened because a stupid friend had unexpectedly screamed an obscenity at a man from inside my car as I drove down the road with a car load of friends on Saturday evening. This wasn't a crime, mind you, just a teenaged prank, but apparently it infuriated the fellow, and unfortunately he was a cop, and could do something about it. (He had been in plain clothes at the time and nobody knew he was a cop.)
      When he used all the powers of the government to track me down a week later and threaten me, I still wouldn't tell him who did it, so he told me that my "ass was grass", and steadfastly proceeded to back it up. Immediately his buddy on the force who was assigned to my area of town started following me around everywhere I went, pulling me over, ransacking my car, and when all else failed, falsely arresting me for DUI... over and over. I was terrified that he was going to plant something serious on me, and send me away for good. I still believe he would have done it too, had his buddy, the original cop that started it all, not suddenly been struck down by a fatal bout of cancer at a tender young age, thus prompting an unexpected change in his priorities. I know for sure the harassment would have continued indefinitely, just as he told me it would several times.
      The legal limit at the time was .1. I blew .08, .02, and .01. In other words, I was perfectly legal to drive the first time, and as sober as a judge for the other two. Strangely however, I wasn't able to pass a single roadside sobriety test. Go figure. All were thrown out - eventually - after I had spent a night in jail three times, had my car towed three times, and spent money on attorneys etc three times, and spent countless months fretting over it all.
      And the worst part is, it still changed the course of my life! I had always planned to join the Air Force and fly. I scored well on all the tests and just needed to go through the formalities of joining up. After this however, I was told that, "The US Air Force doesn't take drunkards". And, "We don't care that you say you were innocent. We only care that you were arrested". I therefore was forced to spend my completely sober life in another industry, which I considered to be much less desirable. And though I did reach a respected position, married a wonderful girl, raised two fine sons, paid for a home and retired, I was always bothered by the thought of that one corrupt cop and the unmitigated power he had to adversely affect the course of my life forever without consequence. And to this day, I do not trust just any cop. Go figure.

      CSU’s blood panels are able to test a wider range of drugs and substances but the cost is very high. Bottom line is, Derrick Groves vehicle went over, and he failed his field sobriety test.

      I have no doubt that SOME drivers are actually DUI.
      But these drug tests are ONLY "valid" if they can SUPPORT the railroading of an innocent driver!!
      Departments are awarded additional DUI funding based on the raw DUI count, NOT their validity!!
      Dirty cops, like Haferman, get honored by MADD, promoted and photographed with the brass and their little plastic awards based exclusively on raw DUI count, NOT their validity!!
      Also, prosecutors are NOT generous OR forgiving people!!
      Their career drives them - and their careers are built on convictions!
      Cases get thrown out before going to court ONLY when prosecutors KNOW a judge or jury would see through the cop's lie!!

    Once is an accident. Twice is questionable. Three or more should disqualify you from being a cop. Also just remember that the Supreme Court thinks it is okay for police to lie to you without consequences. But if you lie to them it's a chargeable offense.

    Well, they just got a police officer not long ago for tons of DUI arrest. One person decided to fight back in court. Then all previous DUI's were reviewed from this cop. Camera footage showed the reoccurring story over and over. Even to go as far as him saying he couldn't find a reason for a DUI charge but he thinks the person is DUI. He's no longer with that department, but probably signed right on with another.

    Field sobriety tests are designed to make you fail. The complete lack of evidence of DUI is exculpatory.
    This man's record now is permanently marred with a DUI arrest. This will affect his ability to hold or gain a number of jobs. It's inexcusable.

      @@concernedcitizen2898 Some states require you to participate or suspend your license. Not necessarily what I would call voluntary. Some states have bo mobile breathalyzers so a refusal is an arrest with transport to jail to be tested.

      I’ve practiced law for almost 25 years, a large portion of which as a federal prosecutor. The FSTs are designed to allow officers full discretion to determine whether a driver passes or fails any test aspect. The process is little more than a formality; if you do the FSTs you will inevitably fail. I’ve never seen one defendant who didn’t fail FSTs. Not one. Refusing to cooperate, in almost every state, wins the driver a trip to lockup and a breathalyzer or blood draw (and in some places, both). When the driver’s results come back clean, cops will still argue you were too impaired to drive regardless and/or were under the influence of an unnamed drug they can’t even say is illegal even if it actually existed. And they’ve largely gotten away with it until recently. But in years past I remember dismissing charges when I learned that K-9s can and had been trained to alert at the presence of a tire. Or a bumper. That resulted in over 50 illegal searches where they initially found nothing. The officer in question was better prepared for the next traffic stop, having tucked a dime bag of marijuana and another of methamphetamine in his pocket to “find” when a search was fruitless (and these were pretext stops to be sure). That officer was sentenced to 15 years in federal prison; the state was too busy investigating themselves internally to bother prosecuting. That’s where we come in.

    But if it means extra department funding for raw DUI count, even if NOT legitimate - Who cares, right?!
    A DUI can be devastating.
    A driver can lose his freedom.
    A driver can lose his job.
    A driver can lose his home.
    A driver can lose his family.
    A driver can lose his vehicle.
    It doesn't matter if it is later thrown out.

    A police officer was arrested in the county just north of us for planting drugs on citizens in traffic stops. He had apparently done this to a dozen or more. There should be very special punishment for these officers.

      I've said before that ANY office that is found to have violated a Citizen's Rights should get a MINIMUM of 25 YEARS (without parole) for EACH violation to run consecutively... this should be a federal law and they can never be in a position of authority of any kind again, even a security guard... I've additionally have said that there needs to be a NATIONAL list of bad cops that should NEVER be hired as a police officer in ANY State.. having ones only by State allows cops to move to a different State and start their bad behavior all over again... ALSO, no investigation into ANY cop should ever be dropped just because he resigned and went to work at another police department... by doing that, it's enabling his unlawful and horrible behavior to go unchecked and unpunished... they're basically saying "whelp, not my problem anymore...'

      It takes money to hire an attorney and challenge a bogus arrest. How many innocents just took the shit because it was cheaper than the alternative. With qualified immunity, it is unlikely to be worthwhile for the wrongfully accused to pursue justice.

      As long as the money extorted and the good stolen goes to the state. The conflict of interest will remain. Cities even put the money that they expect to get for fines when applying to loans. Meaning that they will do whatever it takes to make sure that they get enough extortion money to pay the bills.

    If it doesn’t show up in the panel you run, then you can’t charge them for it. It’s pretty simple, chief. You can’t charge someone for intoxicants you can’t prove are in their body. And I lived in Fort Collins for years and never thought this could happen there.

      The chief was quite rude at the thought of offering an apology. When the man sues them, then maybe? My nephew is an A.D.A. He told me NEVER do roadside tests. Let them take you in to blow and/or a blood test.

      If they were serious about safety then the standard is "impaired driving" meaning a person can be impaired by something the drug screens don't match for.
      There is no evidence the defendant was impaired.
      But if they were serious about safety they would have to arrest half the force for driving under the influence of not enough sleep and too many devices. That can't be good for safety.

    This same thing happened to a friend of mine in Florida. The cop lied about everything charged him with DUI, leaving the scene of an accident because he walked across the street to wait for the police to show up and resisting arrest.
    The officer just wanted another DUI arrest. All the charges were dropped but he was out $15, 000 in attorneys fees.

    If an officer makes an arrest and there is no evidence to support the arrest, the officer should be subject to the maximum penalty for the offense plus 5 years in prison and a $25,0000 fine for arrest without cause. There should be no plea bargains permitted and all sentences must be served consecutively and fines paid in full before release from prison.

      Lookup Admiralry Law. We’ve been living under it since the end of the Civil War. It’s not the law of the original Constitution. There are no Article III courts anymore, just administrators in black robes sitting three feet high off the floor enforcing the statutes and codes of the “government”.

    Seems like instead of standing behind the officer, they would question why his arrests are being overturned. Maybe he needs to be retrained or they don't care because on average, his arrests stick. If he didn't have qualified immunity, he wouldn't be fabricating evidence and testimony.

    I mean the dude was just in a pretty serious accident, head trauma is pretty common in a car accident and would cause symptoms similar to being under the influence.

    I was pulled over by this same cop almost a year ago. I work 2nd shift some times and might have been going faster than I should have on 287 and got stopped. It was late and the the 1st words out of this guys mouth when he came to my window was how much have you had to drink tonight! He asked that question 3 more times during his police questioning. He then Gave me my stuff back and said have a good night. He was just odd. Like he had nothing better todo but mess with me odd

      The problem is, as he said, the panels are only designed to detect certain drugs, NOT every drug. If someone huffs something for instance the tests will come up negative because there is nothing out there that can test for inhalants. Does that mean it's a false arrest? No. This has happened in my area. HUGE area known for huffers. Had a couple people absolutely bomb their tests, even additional experts said they were impaired. But the tests came back negative because inhalants are difficult to test for. At the time of both arrests, the subjects were absolutely impaired, but the charges were eventually dropped, after the blood samples did not show anything in the normal panel of tests they run. Officers have to make the best judgement at the time of the incident. Doesn't mean every single one of them is corrupt. Are there a few out there who are? Yes, as in any profession sadly.

    As a non American I will never understand how fast you can end up in Jail.
    In my country the police will do a breath alcohol test or as drug test via sweat or urine, only if that comes back positive a blood test will be ordered.
    If any of those pre-tests is positive the police can prohibit further driving on the scene and maybe take your keys till the next day.
    But you would only end up in a cell if you are so intoxicated that you are a danger to yourself.
    Just the suspicion of a DUI will never get you in cuffs or a cell.

      The blood tests they have currently do NOT detect EVERY drug out there. It's impossible. There are too many variants, types of drugs, etc to be able to test for them all. There is a standard drug panel that is tested for and if the blood falls outside those panels, it will come back negative. Real life is NOT CSI or NCIS. Most of the stuff the show on those shows do no exist in the real world. Drug tests can take months to get returns on because of the chain of custody.

    My Son in Denver was also arrested for dui all charges were dropped but he still has to have an Interlock. He had a seizure while driving and could not agree to breathe test because he was actively in a seizure, he requested one at hospital and they refused to said he had his chance in the ambulance?

    Isn't it strange that lie detector tests are not admissible in a court of law because they are not "100%" reliable but officers that are given financial incentives based on quantity of arrests and not accuracy of arrests, are considered reliable enough to put someone in jail over night?

    This happened to me twice in Florida in a 5year period despite blowing zeros the first time and on the second they wrote me up for refusal when they saw I blew zeros the first time because they knew they would look stupid. Anyway I won the second dui at trial and cops and prosecutor were admonished by judge.. I however lost my home , cars and everything because I couldn't work with no license and couldn't pay taxes on my home that I paid cash for and owned outright. Town sold it on me for the taxes I owed because they refused payments and insisted I pay all at once!! These cops need to be held accountable because this can happen to anyone.

    This really is unacceptable. I think there are problems within the incentive structure of our police departments. They get grants that are based on arrests, not convictions, for things including DUI. Team spirit can be a bad thing. Some people respond more strongly to incentives shared by their group. "We got the grant, great job, go team!" can be a bigger reward even than personal financial incentives, albeit not for everyone. Certain types of people work harder for the group than for themselves. I think this is the problem in our state with false DUI arrests. Grants for local police need to eliminate provisions that cause adverse incentives. Ft. Collins police, and frankly other police departments in the state and the country, need to think about office culture. Too zealous!

      That is completely false. You are completely spreading misinformation. You cannot get a grant for arrests. Grants are for equipment, vehicles, training, K-9's, Phlebotomy, etc. They are specific for those areas only like they are in EMS and Fire. They cannot be used for anything else as every dollar in those funds are accounted for and tracked as required by the government.

    They get performance bounces for dui arest so it doesn't matter if the suspect has not been drinking. I don't know the name but there is one Colorado cop has over 10 dui arest with victim blood and drug test clean. Was featured on Lehto's law

    This is because law enforcement in so many parts of America such as Loveland is financially incentivised. The more DUI arrests the Pollice Department as a whole makes the more central funding the Police Department gets. Therefore individual Police Officers are actively encouraged to make as many DUI arrests as possible. The more DUI arrests an individual Police Officer makes, the greater the bonus in their paycheck. Police Officers with the most DUI arrests even get presented with trophies. When Law Enforcement is incentivised, innocent people get taken to jail.

    File a 3949-A IRS form against the chief for allowing his officers to practice "Collars for Dollars" it's a fraudulent form of overtime so officers can make a lot of money. It is also a violation of the 4th amendment. The IRS will be happy to put the chief and the whole department on a Life Time Annual Audit. Who ever files the 3949-A form will recieve 15 to 30% reward by filing a form 211.

    In many/most states the roadside sobriety test is voluntary and so is the breathalyzer. If they're going to f## with you anyway, make them take a blood sample that isn't subjective.

    Never consent to field sobriety tests on the roadside. Demand a blood test. Field sobriety tests are subject to opinions of the officer giving the test. The cop doing the interview is convinced that the driver was under the influence even after test results proved the driver was not intoxicated

      Sometimes head injuries can present as someone under the influence or as someone with a medical emergency. I'm a 22+ year EMT and have seen many things like this in the field over the years. If officers aren't trained with a medical background (most aren't), then they can't often tell the difference and will go with their standard training. This is not backing this officer by the way, just providing some general perspective from my experience.

    If the lab test does not catch other specific substances then that is not the suspects fault. The police have a duty to prove the presence of those substances, not just assume it.

    I’m totally against police overreach and don’t side with bs road tests as I have been subjected to them myself even when I knew they were setups. With that being said something definitely definitely looks off in his eyes as someone pointed out maybe it’s some sort of hallucinogen that’s not being picked up by the panel but something is off there I’m not buying this guys story. Mushrooms are also now legal in Colorado so who knows.
