    "Rep. Eric Swalwell (D-CA) was taken aback by a witness’ response insisting that abortions performed on rape victims who are minors aren’t actually abortions.
    During Thursday’s House Judiciary Committee hearing on the impact of the Supreme Court striking down a constitutional right to abortion, Swalwell questioned Catherine Glenn Foster of the anti-abortion group Americans United for Life.
    The congressman alluded to a now infamous case of a pregnant 10-year-old rape victim in Ohio who traveled to Indiana in order to obtain an abortion. Ohio has banned abortion when a fetal heartbeat can be detected, which is around six weeks of pregnancy. Although the state attorney general has claimed she could have obtained the abortion in Ohio, the law itself doesn’t corroborate this.
    “Do you think a 10-year-old should choose to carry a baby?” Swalwell asked.
    “I believe it would probably impact her life and so therefore, it would fall under any exception and would not be an abortion,” Foster replied."

    She's 10, she can not consent.
    Could she choose to carry it with her parents?
    She didn't choose, her parents chose.
    The question itself is flawed, a 10 yr old has no rights, but somehow her fetus does.

      The applicable law allows abortions after a fetal heartbeat is detected:
      “to prevent the death of the pregnant woman” or
      “to prevent a serious risk of the substantial and irreversible impairment of a major bodily function of the pregnant woman”

Do you want to be to religion as sovereign citizens are to law? Or do you love your religion and the Bible enough to take the time to actually understand it in its full complexity?
      Look, I’m actually a conservative against no-cause abortions, however, the truth is the Bible REGULATES abortion, NOT prohibits it. The “Christian” position against abortion is ANTITHETICAL to Biblical precepts of justice BECAUSE abortion is, in specific instances, the Bible’s SOLUTION to prevent injustice.
      ANY NON-PATERNITY EVENT, including rape, is why the Bible DOESN’T outright prohibit abortion. It’s not to eliminate rape’s harmful consequences on females. It’s to eliminate any harmful consequences of non-paternity events upon husbands. It’s for PATERNAL CERTAINTY.
      The Bible’s societal system is patriarchal and the economic system is patrilineal. Non-paternity events in married females is the most heinous attack on the patrilineal-patriarchy BECAUSE the Biblical system legally assigns upon the PUTATIVE genetic father (from the marriage contract) ALL the responsibility relating to the fetus following impregnation, the provision of it after birth until adulthood and to its mother.
      Biblical abortion is allowed to 1) protect the life of the mother, or 2) to PROTECT and SAFEGUARD the FINANCIAL and GENETIC INTERESTS of married MISATTRIBUTED FATHERS. Whichever the case, the Bible places all of the rights over a fetus to its putative father, not the pregnant mother, and ALL abortion cases must be adjudicated by a court.
      To prevent gross miscarriages of justice against financial interests of a husband during his lifetime, against his deceased estate after he dies, against his right to leave genetic progeny (including for hereditary purposes of priesthood, tribal membership, royal succession, inheritance), to ensure that his descendants are ACTUALLY his so that his family line isn’t killed off by a genetic usurper (which is the fundamental purpose and right of all living organisms), the Bible uses abortion to 1) PREVENT paternal-line RESPONSIBILITIES attaching to the INCORRECT male, 2) to PREVENT paternal-line RIGHTS attaching to a genetic usurper, and 3) to PREVENT the unlawful killing-off of a family line.
      But the Bible does this in a way disturbing to our modern sensibilities, in a pre-science and pre-DNA-testing manner.
      In the Biblical abortion procedure, it is HUSBANDS who, in the “Ordeal of the Bitter Water”, have the right of originating a petition to the religious Court for the administration of a Biblically compliant abortion:
      1) a husband who MERELY suspects the fetus carried by his lawfully-married wife is not biologically his, either because he suspects she was unfaithful but he lacks the Biblically required evidence to prove a case of adultery, or he is aware or suspects that his wife was raped, initiates proceedings for an abortion so that the birth of the fetus of another man does not cause loss against him as husband, his family’s estate, and so that his family is not killed-off with him by the passing off of another man’s child as his own.
      2) a male-only panel of Israelite judges, adjudicating the husband’s petition, administer an abortifacient (the Bitter Water) on the under-oath pregnant wife to cause an abortion, which if successful, the abortion is divine judgment that the child was not the husband’s, but if the fetus survives then it is divine intervention and evidence the husband is the father.
      If the abortion is successful, no death penalty for adultery is imposed on the wife because the case was a pre-birth paternity civil case, not an adultery criminal case. The Biblical remedy to the civil case was the abortion itself, because Biblically the fetus is NOT considered alive until birth, while it is a fetus it is considered to have some rights as property of its putative father not it’s mother (and not full rights per se of a living breathing person).
      As Biblically a pregnant woman has a say on aborting her fetus only for healthcare reasons if her life is in danger, she can petition an abortion, but it too is adjudicated by the male-only panel of Israelite judges if her death will come from carrying the fetus to term or the labor will kill her. Otherwise abortion is not permissible, because the fetus is the property of the putative father and she can’t destroy his property without just cause.
      A fetus therefore, as property of its father, also carries a similar classification of being a parasitic entity to its pregnant mother until it is born (when its head is fully outside of her). After its head is fully outside of its mother, if its mother is in mortal danger, both must be attempted to be saved without preference to either. However, before that point is reached, a fetus must be terminated if it is to save its mother just as one is permitted to kill a mortal assailant in self-defence.
      Similarly, a parasitic twin is alive but not a living soul, and it entirely depends on its live-born non-parasitic twin and being attached to it for its survival. Biblically, it is not murder to kill the parasitic twin to save the life of the non-parasitic twin.
      A husband’s right to recourse for disputed paternity of a fetus is extinguished upon the birth of the child born to his lawful wife. Their contact of marriage has that legal effect on the baby once it’s born, even if the husband isn’t the biological father. That’s why if he suspects the fetus is NOT his, the Bible’s judicially sanctioned abortive remedy is for WHILE the wife is pregnant. After birth his paternity is legally established, and all rights and responsibilities can never be challenged or dissolved.
      But what of when a non-married female is raped (whether or not she is impregnated from the rape)? Since there’s no husband to petition the Bible’s judicially abortive procedure in the case of a raped unmarried woman, the Bible’s remedy is to judicially try the rapist for his crime, and if convicted, as his punishment the female he raped (wether he impregnated her or not) is given the option to have the rapist forced to marry her.
      Biblically, marriage wasn’t as we understand it today. Marriage had little if anything to do with love. It was nothing more than a legally binding contract. Still today we sign a “contract of marriage” (in Jewish law this contract is called a Ketubah). Getting married is still called “contracting marriage”. This inconspicuous remnant of marriage’s contract law history hides in plain sight.
      In an ordinary marriage contract, one party undertakes to do and refrain from doing certain things in exchange for the other party doing and refrain from doing certain things. Each had specific rights and responsibilities within the contract. Biblically only the man had the right to no-fault divorce, because he was the one with the financial responsibilities in the contract, the wife has no obligation to contribute financially.
      When a rapist is forced to marry his victim, that was HER option. If she chose it, it was a JUDICIALLY ENFORCED marriage as PUNISHMENT (not reward) to the rapist. That marriage had different terms and conditions; the rapist retains all his responsibilities to his now wife, but loses all his rights as husband, she gains all his rights in addition to her own rights and she is absolved of her responsibilities to him as wife. She doesn’t have to do anything for him she doesn’t want to, neither cook, nor clean, give him sex, bear him children (other than the one she bears if she was impregnated during the rape). But he forever has to house her, in her own home if she wants, feed her, clothe her, provide for any child she bore as a result of the rape, and he FOREVER loses the Biblical right of “no-fault divorcing” her which would otherwise be held only by a husband, not a wife. He becomes the financial slave of his victim-turned-wife, because the rapist deprived her of marriageability, which in patriarchal systems means destitution and possibly death for lack of provision to her or her child.
      Conversely, if a married or betrothed (engaged) female is raped, and the rapist is found guilty, he is executed for “adulterating” her husband’s lineage, and THEN the Ordeal of Bitter Water judicial remedy is initiated by the husband against the fetus.
      Finally, the Decalogue doesn’t say “Thou shalt not kill”. That is a misreading! The Hebrew text says “Thou shall not murder”. The Bible doesn’t outright prohibit killing of breathing live humans, it regulates it, because it distinguishes between lawful killing and unlawful killing. Murder vs killing in self-defence, killing during defensive war, or killing of judicially convicted capital crime offenders (i.e. through the judicial system, DULY prosecuted, convicted, and sentenced, with the execution carried out by a state delegated executioner who carries out the execution without bloodguilt).
      That being said, Biblically, abortion DOESN’T EVEN fall under killing, let alone murder. Thus, if a person unlawfully terminates a fetus extrajudicially (OUTSIDE the Biblical abortion procedure described above which must ALWAYS involve the panel of judges), the Bible classifies that as destruction of property, not killing. The person responsible is liable in tort to pay monetary damages to the father. The tortfeasor doesn’t get convicted for murder or executed BECAUSE the Biblical standpoint is that humans do not have legal personhood until birth, and you can’t kill something that isn’t yet born. Similarly, a fetus of a properly slaughtered kosher animal is permissible to eat without its own kosher slaughter, as it can’t be slaughtered independently, and is considered an organ of its mother.

'D SP' (a self-identified Conservative) has even provided an amazingly comprehensive ethnographic and historical breakdown of exactly 'when' and 'why' the Bible supports abortion. There are plenty of topics where the Bible is ambiguous, or offers contradictory passages in different sections, but on the topic of abortion it is VERY CLEAR.... And it specifies that 1) Abortion IS NOT murder, since murder is a deadly sin, and should be punished by death, while abortion is allowed, 2) Abortion 'on-demand' is fine (though as a document from a male chauvinist culture, it only suggests that 'husbands' get to make that demand), and 3) that 'inducing a miscarriage' (by assault, no less) is ALSO NOT MURDER, since it should be punished only by a fine.

If you believe (no cause) abortions are murder, what is the difference if that pregnancy is the result of rape or incest? Is that fetus not alive or does it’s life not matter? If it’s because of the catastrophic harm such a pregnancy(carried to term) will do to the mother then doesn’t every woman have the right to decide whether the harm is too great to give birth? I’m seriously trying to understand the anti-choice stand. It seems illogical at best and hypocritical at worst.

    Then, what will happen with the baby being born from a 10 years old child (victim of raped)? The very young "mother" and the child born will be more "suffer." Pro-life is the only word...but many children were killed by gunshots at school..a real child, and Republicans don't care. It is pathetic.

    As a survivor of CSA her lies and misinformation disgust me. A 10 year old terminating a pregnancy has had an abortion. She and everyone else like her wants to paint the "policies" they support as humane when they are far from humane. It's best to listen to women about their bodies because only they understand when they can carry a pregnancy and little girls shouldn't even be pregnant, I know it happens and it makes me disgusted with humanity.

Most claims about abortions dont focus on punishing slutty women but instead say its about saving lives. They make hatred of trans people about saving children from bathroom attacks. They arent for America because what they want is to change to a religious fascist dictatorship. They just lie and they now are not even doing a good job at it.     As a medical coder, I can tell you from professional experience that anything that terminates a pregnancy is medically considered to be an abortion. We even have separate codes to identify which type (elective and spontaneous).

    Cenk mentioned that words don’t have meaning anymore. He called it “torture” and that’s followed up by “the seizing of the language”. I call it emotional abuse.
    I’ve said for years: our country is in a toxic relationship, and emotional abuse is rampant from one side.
    I’ve been in this relationship before (as so many people have), and we know: there’s literally no convincing the other side to see reason.     The average weight gain for a pregnancy is said to be 25-35lbs. Now I don't personally happen to know a single woman, nor have I ever heard of a single woman that gained only 25lbs.
    Ana supposed that the 10 year old weighed maybe 80lbs?
    So one could hypothesize that a 10 year old could gain half of her own weight in a pregnancy. Just WoW GOP

    I was in Texas once long time ago... and I was pregnant with my son, and this lady and I got to talking and she was telling me that in Texas in order to have an abortion, you need your husband's permission! If he says NO it's not happening.... Mind you I was just going through cuz my husband was a truck driver... I just had to laugh that one off.... because thinking that I would need his permission for my body was just outrageous to me, comical even.

    I've heard a lot of right wingers clarify: rape is "probably" not okay (a lot don't agree what constitutes "rape"); but forcing the child to have a rapist's baby is acceptable because, although it would most likely damage the child/rape-victim, the baby living is the important thing. This does not extend to government helping the baby and child/rape victim after the baby is born - because that is welfare. I've heard this from a lot of right wingers. Mainly men with a strong predilection to having kids with children, like they did in the old Testament.

      Ohio law explicitly states “to prevent the death of the pregnant woman” or “to prevent a serious risk of the substantial and irreversible impairment of a major bodily function of the pregnant woman”. The 10yo EASILY classifies as both. She could have had the abortion in Ohio. She didn’t for a reason we are unaware of at this point.

Do you wait to get a second opinion for the procedure? See the issue with the so called exceptions? They're only exceptions so long as doctors and hospitals are scared of prosecution. Everyone interprets the law differently and hospitals tend to be overly cautious. It's why the Texas Medical Association is now receiving complaints of things like ectopic pregnancy care being delayed. And it's happening in states with abortion bans throughout the country, not just Texas.

Secondly, the world isn't black and white as I would hope the story of the ten year old rape victim has shown you. Forcing her to carry a pregnancy is incredibly dangerous on top of being cruel. Punishing a rape victim of any age is traumatic, even more so with a child who doesn't even understand what happened to her and extreme abortion restrictions impact these situations even when so called exceptions are put in place. Third, abortion as controversial is a modern thing. Abortion used to be accepted until the "quickening" (Fetal movement). It's only after science discovered the process in its entirety that religious folks in particular started making it a controversial thing when it simply never was before. The bottom line is this. It's not your business. If you don't believe in it, fine. Don't have one or don't be with someone that would have one. Don't shove your beliefs on other people. It's especially concerning when you phrase the women's life as in irreconcilable conflict with the unborn's. I sincerely hope, you don't value a fertilized egg, zygote, or fetus over a living breathing woman's life. That position is just so ridiculously extreme.
      Pregnancy is inherently dangerous by its nature. Banning abortion only makes it even more dangerous and outright discourages women from having children. Birth rates will likely decline as a result.
      It's not just abortion itself that is being limited or outright banned. It's contraception. States are moving to ban IUDs, Invitro fertilization, various drugs are not being filled even when they are not used for abortion. One clerk in Wisconsin even refused to sell condoms. It's not a tenable situation and there's no way a small and extreme minority dictating the lives of others is going to be tolerated long term. It will cause civil unrest.
      And lastly, there was never unfettered abortion access. It was legal in the first trimester. Legal with some restrictions in the second trimester varying by state. And illegal in the third trimester barring extreme circumstances like severe fetal defect that make the pregnancy simply not viable or the mother has some sort of severe medical condition develop. Stop spouting this unfettered abortion access lie. No one has that position.

    We already have places in this country that allow law enforcement to investigate miscarriages. The new Yorker had an article on this and I wish more outlets would talk about it.     Swallwell should have asked her if it's not an abortion as she says, what is it? Should have put her on the spot.
    Swallwell is normall quite quick but he let her off the hook there.

      They would be for sure. I know a couple who are ridiculously pro life and right down the christofacist bunny hole. Yet that same couple, literally 8 years ago in their early twenties, had an abortion. Not because it was life threatening, because they didn't want to be parents yet. It's the good Ole "Rules for thee but not for me" argument.

    I’d like to tell these Republicans that the youngest mother ever was FIVE. She had a rare condition wherein menstruation began at 7 months, and gave birth, at age 5, in South America in the 1930s. That is the type of situation they’re asking for if they insist on dying on this hill.

      Right, and this woman added "if it threatened her life" into the equation as if thats the pivotal element. Any 10 year old trying to bring a baby to term, is in severe medical peril. But still, thats not the issue. If there was no peril, this woman would force a 10 year old rape victim to deliver full term. INSANITY!

    Even if this story was fake, we know this thing has happened and will happen. So the story being fake would still be irrelevant. You would have to discredit every single documented incident in history throughout the entire world, and every single story that may appear in the future.

      its sadly not though. they cant even state how she also was denied the abortion since it was past 6 weeks. the fact of a 10-year-old who just developed enough to get pregnant and likely is not developed enough to handle a full pregnancy without causing her serious damage to her as her body tries to juggle both the pregnancy and her finishing puberty and anyone had the audacity to think she should know before six weeks that she was pregnant? This is insane. They dont care about kids at all. They dont really even care about the fetus much. They want to control others.

    No right to life in the Constitution. Extreme Court is limiting the enumerated right to Due Process, which is what protects the right to life, real, individual, life.
