They have powers but in this case they did not abide by the legislation that gives them the powers, they did not carry out the search under the terms of the legislation and they conflicted suspicion with reasonable grounds.

If he was wearing a balaclava of course that'd be a reasonable thing to do

      @@itshahriar4595 That’s incorrect. It’s not down to him to ask, it’s their responsibility to provide it. Before conducting a search they must provide their name, police station they’re attached to, their reasonable grounds for the search, what they expect to find and which law they are searching under. They must also inform you that you’re entitled to a copy of the search record. There are a few variations to the above under certain circumstances but that’s the general stop & search procedure which covers most situations, such as the one in this video. It’s also worth noting that you’re not obliged to speak to the police or provide your details (unless you’ve been stopped driving a vehicle or have committed an offence).

    My mate works as a chef for a hotel he finishes work at 2am some times 3am the guests arrive at odd times ...he has to feed them ....
    Hes been arrested 15 plus times.. suspected of theft robbery drug trafficking etc etc so clearly police intelligence doesnt work at any level.

    Just because an attempted burglary as happened in an area dose not give them reasonable suspicion to search random people in the street. If you fit the description of the burglar then you could call that reasonable but this idiot said if there were other people in the street he would search them as well and that's wrong.

    reasonable suspicion is more than a hunch bet less than proof
    "belief" is based only on un confirmed information,,
    so the person (PC) declaring the "belief" is hedging his/her bet as to
    whether the "belief" is correct
    BUT he only mentioned "Suspicion" not "Belief"
    there has to 2 parts PC must do before a lawful legal search and that is here below:-
    1 suspicion
    2 grounds
    PACE code of practice :-
    A 2.2

    Firstly, the officer must have formed a genuine suspicion in their own mind that they will find the object for which the search power being exercised allows them to search
    (ii) Secondly, the suspicion that the object will be found must be reasonable.
    This means that there must be an objective basis for that suspicion based on facts, information
    and/or intelligence which are relevant to the likelihood that the object in question will be found,
    so that a reasonable person would be entitled to reach the same conclusion based on the same facts and information and/or intelligence.
    if these 2 parts are not met then it is unlawful search and unlawful detainment and breach of HRA section 5
    which being unlawful s detainment is "Kidnap"

    A sergeant stop searched me because there had been burglaries in the area the previous night even though he had stopped me 5 mins beforehand asking for my name and address which I gave and finding out I had no criminal record lol

    It sounds like this happened in the UK. In the United States if you have a Screw driver in your pocket you would be arrested for Having burglary tools. That happened to me but I had a Reason to have the tools I just got off work on my way home and I carry different small tools in my pocket but once they seen my van they just turned and walked away my van had the company name on the side. They still could arrested me but it would of been dropped and I could of Sued them.

Cause it seems like cops are waiting in the area for you to leave your house and they watch you then they come and search you knowing that you just left the house or something, If you leave your house at the same time every night try changing the time you leave maybe earlier or even later.

    If the person that reported a possible burglary by a man that came to his front door what was the description? Did the description match the person they stopped and searched?     It's not 'reasonable suspicion' to search merely because a crime has been committed. It must meet the 'reasonable' test. Do you meet the description of the perb? Have you been seen coming from the house in of the crime, or seen carrying a object that matches the description of something that was stolen

    You should have asked for a copy of the record of the search, the officers names and numbers, incident number of the attempted burglary. Take further action!!!!! As for their attitude and distain for the public, was reflected in their tone, manner and comments. He also stated that he would be harassing you if he saw you again in the area. That’s a very strong case there my friend.

    Your in an area were there has been an incident, yep turn around and ask if you can search them as they are in the area too.
