Finding pot bags in someone's glove box and charging the passenger with possession for only her proximity to the bags and for no other reason or evidence is wild. It's like the prosecutors just throw any charge a cop makes up at someone and then hopes the judge will ruin the defendant's life for having been arrested.
It's called constructive possession and if you don't like it I highly suggest you avoid Indiana. You have the obligation to ensure you're not traveling with someone who is transporting drugs. You have the obligation to report them for the drugs if you are aware of it. They will railroad you, omit your evidence from court or attempt to destroy it on the side of the road, & of course everything they wish to use against you, can and will be. Including your buddy nodding yes to questions he can't even hear on the side of the road because he wants to expedite the process due to the cold. For example, "Did so & so know you had X substance in the car".. Yep that's more than enough to hold you accountable for it too.

This is why the department often has good relationships with the DA's office. Prosecutors often refuse to charge officers that flagrantly violate the law.
I mean, they verbatim said it was to retaliate by reporting her to her school. They literally wanted to ruin her life. The judge should have berated them for that and encouraged her to do everything within her power to make it right. Now that I’m thinking about it, I bet they did report her since they obviously found out her identity. So absolutely she’s owed some money by the state.

I agree with the judge on a lot, at the same time however, he seems extremely unprofessional and his personality is more fit for a reality court show like Judge Judy. I think the fact a real court is being treated like reality tv is troubling, even if his handling of the law is refreshing for a state like Texas as a southerner myself.

DA’s are super protective about their convictions rates. They hate dropping case. They also bring charges because it helps their relationships with cops, it’s also a good look for the public. You refuse to bring charges, the public starts talking about how out of control crime is. It’s all fucked up
It's not like its the actual court case just a probable cause hearing to see if the case is worth taking to the next level of court. If the defense had video or evidence to the contrary they could submit it but without it judge can only rely on statements from the cops and theiy're intuition then you'll battle those charges in you next hearing.
In fairness, it seems he is willing to take the defendants testimony if they are losing. I think it is totally acceptable to rule against police based only on their testimony.

@@jmsmilin. Truth. The process “is” the punishment. Most judges would automatically find probable cause, set the next court date for pre trial, and discussed bail. They make arrests that they know will be thrown out in a higher court, but it could take years to get there. If you can’t make bail, they will force you into pleading out so you can finally be released. If you can make bail, you’re wearing a path back and forth to the courthouse for the next three years, and dodging retaliation from the police and DA. The process has become the punishment. And if you do get relief in civil court, it’s not coming out of the cops pocket. Qualified immunity put an end to that.
@@Zurd33 According to the complaint that was read, she did leave when she was told, and after the supervisor came as she requested, she came out to talk to the supervisor. At that point, they demanded ID and arrested her when she refused.
This guy is a mixed bag. He strikes me as the type that got railed so hard in high school and now that he is in power, he is gonna show everyone he can wield it. It's interesting that he doesn't show the same exact tone to officers and prosecutors that he does with INNOCENT people. Some judges have shown outrage when they catch departments trying to railroad innocent people with bogus charges. Compound this with the fact that his initial advice was "let sleeping dogs lie" tells me exactly what I need to know: He will always put himself first when tested.
I think his advice is coming from a place within the system knowing that it's a huge mountain to climb to hold police accountable. We see it on this channel all the time. I disagree with his advice, but I don't think he was doing it maliciously. Some people really aren't cut out for the fight that is fighting corrupt gangs with badges, and lawyers aren't cheap.
Officers who issue tickets and arrest people should be forced to attend these court cases. Innocent people take time off work and lose money for something that shouldn't have happened, it's sad to watch.

She will be going to an attorney, and if she already has the complaint done, it doesn't look like she's just going for money. Then also remember the judge cannot legally strategize with her, he can only point her in the right direction. Let sleeping dogs lie is decent advice if she just wants her life to go back to normal. The best thing to do if you're going after cops legally is to move away from that jurisdiction, in fact I've seen/heard lawyers give that exact advice to their clients when they go after the police. What evidence does the judge have of them assaulting her? He can't just be on one side of the story and treat it as fact. I don't agree with his advice and think she should lawyer up and file something -IF- that is indeed what happened. You can feel for her all you want but you need both sides, evidence, and the appropriate court. This is just a probable cause hearing, she won, now she can take action other actions with a lawyer.

Judges have very limited avenues of action, he is a misdemeanor criminal judge, these PC hearings and bond/probation hearings are the majority of his job. Judges don't file criminal complaints they hear cases filed before them.

If the cops are pulling you over, and you're in possession of an illegal substance or contraband, you might shove said substance or contraband in the glove box. In most states the passenger will be equally charged with the possession (or trafficking depending on amt) of drugs if any is found in the car. Texas is the only state I believe where the determination is made based on whether or not you have care, custody and control of the contraband in question.

I can't remember what he was arrested for - it's possible that wasn't valid, in which case the search wouldn't be valid, but they do have the legal authority to search a car after an arrest of the driver.

This judge doesn’t trust cops. After watching a dozen of his cases maybe a little more - he should probably be purely in a diversion program as a legal mediator. Of course what I’ve seen are cases from legal tube channels and only 3 full day streaming sessions from his channel. I know his MO is to “scare straight” misdemeanor offenders so they never want to come back. For all the tough talk, his sentences are fair to me as a lay person

He can't give her legal advice, only where to seek remedy if she believes she's been wronged. He's just keeping his impartiality. The advice he gave her will give her the evidence her lawyer is going to need for the law suit. It was good advice.

I've actually watched other judges state out loud that "sworn officers" have more credibility than defendants. Also, Judge Fleischer is the only judge I've ever heard use the phrase, "Walking while black." as he dismissed a probable cause hearing.

I disagree. He could have done like 99% of other judges do and found probable cause on a nothing charge. I could see why he wouldn’t publicly advocate for someone suing the police but in the end he gave her every opportunity to file a lawsuit as if he had found probable cause she would have had to spend time and money fighting the charges, be found not guilty, then file a lawsuit.

I, like most people, was blind to the erosion of my freedoms by all branches of government. A couple of years ago, I stumbled across this channel on my first time surfing TH-cam, and had a "red pill" moment. Now, when somebody from the government asks me why I'm being awkward, I tell them "I'm defending your children's rights."

For sure. I've watched a ton of court footage and a lot of judges treat people horribly and power trip. It's why I get some enjoyment when the occasional inmate jumps the bench. The judges' demeanor changes real quickly. 😂

Ive watch this judge for a long time. He claims that he is looking out for the citizens. But he was so quick to chastise this citizen and could care less about the police abuse. This is why people are pushing back. This judge is the problem but he doesnt even know it.
@Ersilay no doubt, that he argued in "the light most favorable" to the citizen. My concern is that the police in this jurisdiction are using bad arrests as punishment towards civilians. So when the judge criticized the citizen, he should have then looked at the prosecutor and demanded to know why they would ever condone the arrest in the first place. By bringing the charges, the prosecutor condones the police's action. By speaking out against the citizen and not the prosecutor, the judge furtures the system's abuse. I respect the judge, but in his position, he should do more to stop the use of police to hurt citizens.

Did he compensate her? Did he punish her abusers? What did he do for her exactly? Not put her in jail for not committing a crime? That is the bare minimum, not deserving of praise.

@1337foxs Well she had asked how to press charges, his answer while not the most helpful could perhaps be the right decision in some cases. Some departments run rampant and will target members of society for disagreeing with them. There are countless videos of retaliation on the internet. The purpose of the probable cause hearing was not a case of guilty or not guilty, it was simply if there was or was not probable cause to take the case to trial. He did mention about heading to the Department and filing a complaint. There are many protections that truly should not exist that protect police well above members of the general public. Idk man, he is a really really good judge if you watch his videos and I was simply defending him on that point. Some people will see one bad video and just hate towards an individual without ever looking deeper.

She absolutely should sue them. The reason they charged her was because they wanted to cover up their unjustified use the force because she didn’t bow down to them. I saw a case where he REFUSED to look at bodycam for TWO days while a defense lawyer was pitching a fit. The second he finally looked at the video, the case went down in flames.
At a PC hearing he is obligated to go on the sworn statements made in the charging document. But yes when it can be so easily shown that they outright lied in the report, than he was able to make a clear ruling of no PC. That guy did still get held on the out of state warrant but that was not relevant to the PC hearing. The reasons why that defendant got picked up for a warrant is of zero relevance. Just the fact he had a valid warrant justifies the arrest.
There needs to be repercussions against the officers for charges filed and dismissed. Like a negative credit score. Getoo low and their testimony is considered false

i'll take it. i mean....he's doing the right thing. That's a rarity. His attitude makes no actual difference in these people's lives. He's doing the right thing, that's what matters and we need a lot more like him.
Well, it might be because he knows that filing a civil suit in that area is going to come up against judges that will just try and dismiss the case while the police will retaliate against the victims by getting them arrested for misdemeanors since he sees the retaliation happen. In the end, the federal appellate or Circuit court might find in their favor, but getting to there and still having a job and home when every month or two you are getting arrested for petty bullshit, then missing work for a day or two is going to be a problem for anybody to get through. That's whey he used the phrasing he did as well. It's sad to say it, but this happens in areas of our country and it's something that we need to address using federal law enforcement and a set of national laws so we can clean out police departments one by one, then keep them monitored and audited so it can't happen again. Just suing them when it happens isn't going to work. It takes too long and will never be high enough stakes. It also won't catch enough of them.
My problem with him stems from a video where a guy jaywalked in front of some cops which is absolutely a crime albeit a minor one and cops stopped the guy and searched him and found some pot and the judge went the race route and and dismissed the case against the guy because even though he blatantly jaywalked in front of cops and he just shrugged and said " you were walking while black" and let him go for lack of probable cause. The cops had probable cause he jaywalked in front of them ffs.

Police aren't held accountable nearly enough. The advice to file a complaint with IA over what are obviously assault and battery charges is the absolute wrong thing to tell her. We've seen enough cases on this channel where IA does practically nothing to the offending officers.
He did say spank him like a child with jail time. There’s a difference then just saying spank him like a child without adding the rest of what he said. The young man should’ve known better than to turn up like he was going to hang out friends instead of appearing before a Judge in court. He’d already missed a court date the Judge said so you’d think he’d want to make a good impression.
You don't understand how probable cause works. If there is no probable cause for the encounter, any evidence found is inadmissible in court and the person cannot be prosecuted on it even if they are guilty of it.
It's sad that this is a more "reasonable" judge because COMPARITIVELY he's pretty good. However listen to some of his rulings closely. -No Consequences for lying in the Prosecuter end -Telling INNOCENT PPL to "be more careful" -If you watch more of his vids you'll see that he rules in favor of ppl asserting their rights he LITERALLY tells them afterwards to comply.......
The prosecutors aren't lying, the officers are. And he can't do a damn thing about their officer reports. Literally he has no power to repremand the officers for bogus arrests, he has no jurisdiction there. He can only let people go and CORRECTLY tell them that police are buggin and to watch their backs.
I think it’s good advice. It is usually best to comply even if the police officer is in the wrong. You can still assert your rights - just only comply under explicit threat of arrest. For instance, if you give your ID under threat of arrest then you are asserting your rights while complying. You can challenge the seizure in court later. Refusing to give the ID and spending the weekend in jail is rarely in your own best interest, even if you get a big payout at the end.

You're gonna have a hard to fighting in court after you're on body cam agreeing with whatever the cop says. So I'm not really sure what you're getting at. If you comply you can't fight it because you waived your rights which means you have no legal recourse due to the fact that you agreed to let them do it. The only way you can fight is if you refuse to comply
Should the Court be telling people to be more careful? Likely no... ...Is telling people that the system is stacked against them before finding no probable cause for a 'walking while black' charge good advice? Definitely. I've seen videos where he looks pretty disgusted with the prosecutor for following up on these charges.
In most of the shorts I’ve seen, I found this judge to be highly unprofessional, like he’s acting as if he is a tv judge (judge judy, couple court, etc…), if anyone else in the court acted the way he does, I feel like he would literally throw the book at them. I don’t have a problem with the outcomes of most of his cases, just his side remarks and rude comments.

He is one of the worst of these "reality TV" judges that post their court footage. How anyone thinks he's a good guy is beyond me. He routinely power trips, talks down to people, is super unprofessional and calls people names, etc. he's a clown in the full sense of the word.

It's wild that probably cause hearings work like this. No defense attorney, just a judge listening to the completely one-sided BS from the cops/prosecutor. I'm honestly shocked that judges even push back at all, so props to this judge for that even if he is otherwise unprofessional. Honestly, if the state loses the PC hearing there should be consequences for even bringing the case to trial.
If you ever watched his complete live stream, you'd see that some have their attorney there, some attorneys come in on zoom, etc. I watch him, and he tries to sound stern and tough, but rarely is.

Judges can’t give legal advice. She needs to file a complaint and get an attorney to sue the department. I don’t agree with letting it go, but it’s not in the judge’s authority to do anything about the cops that injured her. Get a lawyer and hopefully she can get some resolution.

judge fleischer is one of the very rare judges that was a defense lawyer before becoming a judge. took a 50% pay cut. we need a WHOLE lot more judges like him. he's no nonsense, but fair to the accused.
He does not treat everyone the same. He was willing to let the cops off the hook with a mere complaint. Dale has shown more than enough cases on this channel where Internal Affairs finds nothing wrong despite clear-cut evidence of constitutional violations. And prosecutors often refuse to charge police despite evidence so they won't jeopardize their relationship with the department.

I'm so glad this Judge has ended up on your radar - he is the most fair I have watched due to the scrutiny he places on the OR's that officers write and that the prosecutors present. The only thing is that he doesn't admonish the cops who cause the defective OR's. The last video - for contempt of cop - should have ended with him saying "I want you to persue this as a civil action for civil liberties violation" not "go to the sherrifs office and speak to internal affairs" mainly because they'll investigate themselves and say "no fault found".

If she signs a sworn affidavit, the cops will try to find any little thing wrong with it and hit her with a perjury charge. That might be why he told her to go the IA route - my attorney advised me of this in my own situation a while back.

I think the fact a real court is being treated like reality tv is troubling, even if his handling of the law is refreshing for a state like Texas as a southerner myself.

My thoughts too! They almost never watch the interaction from the bodycam, the D.A. Just reads the cop’s statement which is always misleading at best.
It's not like its the actual court case just a probable cause hearing to see if the case is worth taking to the next level of court. If the defense had video or evidence to the contrary they could submit it but without it judge can only rely on statements from the cops and theiy're intuition then you'll battle those charges in you next hearing.

@@jmsmilin. Truth. The process “is” the punishment. Most judges would automatically find probable cause, set the next court date for pre trial, and discussed bail. They make arrests that they know will be thrown out in a higher court, but it could take years to get there. If you can’t make bail, they will force you into pleading out so you can finally be released. If you can make bail, you’re wearing a path back and forth to the courthouse for the next three years, and dodging retaliation from the police and DA. The process has become the punishment. And if you do get relief in civil court, it’s not coming out of the cops pocket. Qualified immunity put an end to that.

This guy is a mixed bag. He strikes me as the type that got railed so hard in high school and now that he is in power, he is gonna show everyone he can wield it. It's interesting that he doesn't show the same exact tone to officers and prosecutors that he does with INNOCENT people. Some judges have shown outrage when they catch departments trying to railroad innocent people with bogus charges.
Compound this with the fact that his initial advice was "let sleeping dogs lie" tells me exactly what I need to know: He will always put himself first when tested.
I think his advice is coming from a place within the system knowing that it's a huge mountain to climb to hold police accountable. We see it on this channel all the time. I disagree with his advice, but I don't think he was doing it maliciously. Some people really aren't cut out for the fight that is fighting corrupt gangs with badges, and lawyers aren't cheap.

She will be going to an attorney, and if she already has the complaint done, it doesn't look like she's just going for money. Then also remember the judge cannot legally strategize with her, he can only point her in the right direction.
Let sleeping dogs lie is decent advice if she just wants her life to go back to normal. The best thing to do if you're going after cops legally is to move away from that jurisdiction, in fact I've seen/heard lawyers give that exact advice to their clients when they go after the police. I'm sure the judge was thinking along those lines

What evidence does the judge have of them assaulting her? He can't just be on one side of the story and treat it as fact. I don't agree with his advice and think she should lawyer up and file something -IF- that is indeed what happened. You can feel for her all you want but you need both sides, evidence, and the appropriate court. This is just a probable cause hearing, she won, now she can take action other actions with a lawyer.

Judges have very limited avenues of action, he is a misdemeanor criminal judge, these PC hearings and bond/probation hearings are the majority of his job. Judges don't file criminal complaints they hear cases filed before them.

If the cops are pulling you over, and you're in possession of an illegal substance or contraband, you might shove said substance or contraband in the glove box.
In most states the passenger will be equally charged with the possession (or trafficking depending on amt) of drugs if any is found in the car. Texas is the only state I believe where the determination is made based on whether or not you have care, custody and control of the contraband in question.

I can't remember what he was arrested for - it's possible that wasn't valid, in which case the search wouldn't be valid, but they do have the legal authority to search a car after an arrest of the driver.

I disagree. He could have done like 99% of other judges do and found probable cause on a nothing charge. I could see why he wouldn’t publicly advocate for someone suing the police but in the end he gave her every opportunity to file a lawsuit as if he had found probable cause she would have had to spend time and money fighting the charges, be found not guilty, then file a lawsuit.

Ive watch this judge for a long time. He claims that he is looking out for the citizens. But he was so quick to chastise this citizen and could care less about the police abuse. This is why people are pushing back. This judge is the problem but he doesnt even know it.

My concern is that the police in this jurisdiction are using bad arrests as punishment towards civilians. So when the judge criticized the citizen, he should have then looked at the prosecutor and demanded to know why they would ever condone the arrest in the first place. By bringing the charges, the prosecutor condones the police's action. By speaking out against the citizen and not the prosecutor, the judge furtures the system's abuse.
I respect the judge, but in his position, he should do more to stop the use of police to hurt citizens.

Some departments run rampant and will target members of society for disagreeing with them. There are countless videos of retaliation on the internet. The purpose of the probable cause hearing was not a case of guilty or not guilty, it was simply if there was or was not probable cause to take the case to trial. He did mention about heading to the Department and filing a complaint. There are many protections that truly should not exist that protect police well above members of the general public. Idk man, he is a really really good judge if you watch his videos and I was simply defending him on that point. Some people will see one bad video and just hate towards an individual without ever looking deeper.

I saw a case where he REFUSED to look at bodycam for TWO days while a defense lawyer was pitching a fit. The second he finally looked at the video, the case went down in flames.

At a PC hearing he is obligated to go on the sworn statements made in the charging document. But yes when it can be so easily shown that they outright lied in the report, than he was able to make a clear ruling of no PC. That guy did still get held on the out of state warrant but that was not relevant to the PC hearing. The reasons why that defendant got picked up for a warrant is of zero relevance. Just the fact he had a valid warrant justifies the arrest.
There needs to be repercussions against the officers for charges filed and dismissed. Like a negative credit score. Getoo low and their testimony is considered false
That judge is a mixed bag to me. It's good that he can see through the police bullshit. However, he has an ego problem too the way he talks down to people. And that wasn't the best advice at the end.
i'll take it. i mean....he's doing the right thing. That's a rarity. His attitude makes no actual difference in these people's lives. He's doing the right thing, that's what matters and we need a lot more like him.
Well, it might be because he knows that filing a civil suit in that area is going to come up against judges that will just try and dismiss the case while the police will retaliate against the victims by getting them arrested for misdemeanors since he sees the retaliation happen. In the end, the federal appellate or Circuit court might find in their favor, but getting to there and still having a job and home when every month or two you are getting arrested for petty bullshit, then missing work for a day or two is going to be a problem for anybody to get through.
That's whey he used the phrasing he did as well. It's sad to say it, but this happens in areas of our country and it's something that we need to address using federal law enforcement and a set of national laws so we can clean out police departments one by one, then keep them monitored and audited so it can't happen again. Just suing them when it happens isn't going to work. It takes too long and will never be high enough stakes. It also won't catch enough of them.
My problem with him stems from a video where a guy jaywalked in front of some cops which is absolutely a crime albeit a minor one and cops stopped the guy and searched him and found some pot and the judge went the race route and and dismissed the case against the guy because even though he blatantly jaywalked in front of cops and he just shrugged and said " you were walking while black" and let him go for lack of probable cause. The cops had probable cause he jaywalked in front of them ffs.

Police aren't held accountable nearly enough. The advice to file a complaint with IA over what are obviously assault and battery charges is the absolute wrong thing to tell her. We've seen enough cases on this channel where IA does practically nothing to the offending officers.

You don't understand how probable cause works. If there is no probable cause for the encounter, any evidence found is inadmissible in court and the person cannot be prosecuted on it even if they are guilty of it.
It's sad that this is a more "reasonable" judge because COMPARITIVELY he's pretty good. However listen to some of his rulings closely.

The prosecutors aren't lying, the officers are. And he can't do a damn thing about their officer reports. Literally he has no power to repremand the officers for bogus arrests, he has no jurisdiction there. He can only let people go and CORRECTLY tell them that police are buggin and to watch their backs.
I think it’s good advice. It is usually best to comply even if the police officer is in the wrong. You can still assert your rights - just only comply under explicit threat of arrest.
For instance, if you give your ID under threat of arrest then you are asserting your rights while complying. You can challenge the seizure in court later.
Refusing to give the ID and spending the weekend in jail is rarely in your own best interest, even if you get a big payout at the end.

Judges can’t give legal advice. She needs to file a complaint and get an attorney to sue the department. I don’t agree with letting it go, but it’s not in the judge’s authority to do anything about the cops that injured her. Get a lawyer and hopefully she can get some resolution.

He does not treat everyone the same. He was willing to let the cops off the hook with a mere complaint. Dale has shown more than enough cases on this channel where Internal Affairs finds nothing wrong despite clear-cut evidence of constitutional violations. And prosecutors often refuse to charge police despite evidence so they won't jeopardize their relationship with the department.

I'm so glad this Judge has ended up on your radar - he is the most fair I have watched due to the scrutiny he places on the OR's that officers write and that the prosecutors present. The only thing is that he doesn't admonish the cops who cause the defective OR's. The last video - for contempt of cop - should have ended with him saying "I want you to persue this as a civil action for civil liberties violation" not "go to the sherrifs office and speak to internal affairs" mainly because they'll investigate themselves and say "no fault found".

If she signs a sworn affidavit, the cops will try to find any little thing wrong with it and hit her with a perjury charge. That might be why he told her to go the IA route - my attorney advised me of this in my own situation a while back.
