The sidewalk is not actually public property, the sidewalk infront of your house is on private property and you own the land the sidewalk is on, but the others have a non possessory right to use the land. Where you own the land the easement is on it has been dedicated for public use by the city or town so it is a public right of way that is on private property, so where you own the land, you can not trespass people from it or build on it, block, or obstruct it. An easement is what is considered as a traditional public forum and a person's constitutional rights are only subject to Time, Place, and Manner restrictions.

Do you think escapes are not planned? This is exactly the same issue that Military sites have as well. Individuals filming “because they have the right” still cause massive security concerns. The law should change to protect sites like this. At the minute those that wish harm can conduct a recce of their target and those that are employed to secure the site are helpless to stop them.

I said of course you did, I live at the other end of the state how else would I get here! He never turned me in, Monday morning I got my car and drove to work! Some of them have a better sense of humor than others do! PS, that was 40 years ago, statute of limitations is long gone!

None of this self-defeating "Establish Authority" crap. Just firmly & respectfully explain the consequences of their actions (as you understand them) to the citizen. If there's any confusion concerning the law, don't unnecessarily escalate the situation (increasing the risk of harm to both police & citizens), but just call your Supervising Officer. Amazing these correctional officers are so poorly informed about the law. It truly shows their level of unprofessionalism and contempt for citizens rights.

Absolutely. They ought to show videos like this at the Police Academy as an example of appropriate behavior when there is confusion about the law. None of this self-defeating "Establish Authority" crap. Just firmly & respectfully explain the consequences of their actions (as you understand them) to the citizen. If there's any confusion concerning the law, don't unnecessarily escalate the situation (increasing the risk of harm to both police & citizens), but just call your Supervising Officer. Lastly, after everything gets sorted - and especially if you learn that you were wrong - learn to let it go. Seriously, everyone makes mistakes. This time, no-one got hurt or killed, and you learned something new about the law, so take the win for what it is with grace.

If being a cop & interacting with citizens is making you so stressed out that you fly into a blind rage whenever someone disagrees with you, or asserts their Rights, then perhaps you need to stop & ask yourself why? After that, maybe find yourself a far less stressful job & get yourself some psychological help (before you end up hurting someone - including yourself).
