      they tried, Judge denied it saying they were too late, statue of limitations was 4 years. And judge said they had to sue back in 2006 when their zoning was changed to residential.................Judge is in someone back pocket, thats fursure

    Glad he got his variance - If I owned it I would have spent all day pulling in and out of there with my private vehicle and would have called the township everyday to unlock it so I could do "maintenance" on the property. Got to love government - it works for itself, not the people who pay for it.

      Looking it up, apparently the couple did that for awhile. Then they were fined almost $100,000 for violating the court order forbidding them to. So moral of the story - do not disobey court orders. Ultimately they lost the case.

      smithwez1101 the fire department locks are KNOX locks. They allow the fire department to enter in an emergency. Next time you walk up to a commercial property look for a brown box about 2 inch square with a flip up door near the front door. The fire department have keys to that box which contains keys to the building so if there is a fire alarm and they need entry they don't have to resort to destructive entry methods (busting glass, busting in a door)

      Personally, I'd just knock the pins out of the hinges of the gate, then pivot the gate around the lock cables. Nothing broken, so no charges.

      there is another way, they need to install a road in the town ship zoned light industrial, Said it has to go through a ditch and would be costly. I cant see it costing that much. I would go ahead and get it done at this point.

    A property zoned for light industrial opens the literal definition of a light industrial business. Neighbors don't like it, and shut it down. Amazing.

    Key issue at hand, the township was not gaining tax revenue on the business entered via their community. So to offset the losses they'll get some income through the fees charged to seek a variance.

    Two things should be done. One he should be told he can't expand the location but he is allowed to use what he has now. Secondly he may use his drive way for commerical use, maybe with some limitations. Maybe hour limits, say 6AM to 9 PM? Also maybe encourage all the clients to use it as little as possible because of the neighbors...and I mean I would say thats faier.

    Why would you by land in two adjoining counties anyway? When the property was bought, you knew that one half the property was zoned commercial and the other zoned residential. The placement of the business tells all. It was built on the piece of property zoned commercial. The problem lies in the fact that access too the business is thru the residential portion of the property meaning there is no access from the commercial side.

    In my city in Canada, a mansion owner would share his good fortune by letting a religious group hold meetings once evening a week on weekends in a large, opulent, room in his basement.     Most states have a right to access law where even if you do not own the ground the drive is on, you cannot be denied access. Evidently this state does not.

      There was a close up shot of the locks, they were on in such a way that unlocking
      any of the locks would get the gate open. The fire department had their own lock
      and key.

    If your neighbors have a problem with you they can call the lawn dogs and they will shut you down..... take you to court cost you thousands of dollars to fight and fines. Government is always the problem because they are there to back people that want to cause you grief! Been there and done all of this for at least 20 years now. Horrible!

    Regardless of the fact that someone at the county was originally mistaken, this guy knowingly decided to run commercial business traffic through a private driveway in a residential zone in one county to a commercial zone in a different county. He was trying to defeat the entire purpose of the zoning. He can still use the commercial property for business, but needs an entrance from the county where it is zoned as commercial. It's very likely that's the reason he was able to afford the odd properties to begin with, and now he's mad that his original scheme has fallen apart.
    Also, the one neighbor who is currently _renting_ nearby doesn't matter in this situation. That's not the point about what the property owner in question is trying to do.

      A conditional variance was granted, but the court found that the conditional variance was impermissible. The zoning board denied an unconditional use variance.

      ChristophProbst The mistake might have been suing them in a County Court, they should have sued in a Federal Court. The good Ole boy system, doesn't work in federal court, because you have a judge who is going to look at the facts, and be unbiased to the situation. Not saying they are not biased when it comes to checks on the president, but they are unbiased since this will be the first they hear of this story.

    I wonder who, in the zoning departments have a vendetta against this family. Sounds like a complete abuse of power with certain people in their municipality. If I had property stored in there, nothing besides a bullet would prevent me from accessing my stuff, simple as that.

    Having the traffic for a commercial facility enter through a residential neighborhood is just like having the commercial business in the residential neighborhood. It's a valid complaint and he should have seen it coming. The only option is to have an entrance from the commercially zoned area. Tough break but hardly difficult to predict.

    This must be in America because where I live. if you live in a condustrial zoned area and complain the township tells you that you live in a condustrial zoned area and to expect things like that to be there. But I guess legitimate businesses being allowed to stay open as legitimate businesses when make too much sense "for the land of the free"
