    They are also immune to investigation regarding anything the accused may tell police , crown or testify to*.

    They get free stuff including money from "victims services". Travel expenses paid'. Wined and dined , you're lucky if they don't have their name on your lease cuz you'll be paying their rent

    In my case, the complainants (2) were caught in lie after lie. One of them flat out perjured herself and then when confronted with the perjury, perjured herself again. THEN, in her last hour of testimony, she blurted out it was HER EX HUSBAND that committed the allegations they made against me and guess what.... NO-ONE CARED. #CanadianInJusticeSystem, #NoManIsSafe

    Interesting topic. Just yesterday I was to start a 10-day sex assault jury trial in Vancouver. Charge sworn 18-months ago and client on restrictive bail. In an effort to resolve the matter, I tried for months convincing Crown that the complainant has lied to police and also to Crown in their pretrial meetings... no one listened nor ever questioned the complainant's nonsensical story. After picking our jury last week (where 117 ppl were summoned), we started the trial yesterday. Judge made her opening instructions. Crown did its opening then called the complainant to the stand. She refused to enter courtroom and get on the stand. Client acquitted. Huge waste of resources that could have been prevented if we had a Prelim and/or if cops/crown asked some tough questions to the complainant in advance of trial but they didn't, and likely didn't want to appear as 'not believing her' and branded accordingly. And of course, no consequences to the complainant.

    i'm sure there was a case in Scotland a few years ago where the accuser got 6 years for false accusation

      If I recall, she was a serial accuser. It was something like 5 or 6 men she had accused over a short period. That's what it took for the police & courts to actually take it seriously. I'd also be surprised if she served more that 2.5yrs of that sentence. The system is a complete joke.

    Could you clarify something please? Naively I presumed all criminal trials have juries but this obviously isn't the case. Under what circumstances can defendants be denied a jury trial? (Out of interest I just looked this up on Google and discovered some change to the law in England in 2003 (I think) that allows non-jury trials if there is a likelihood of jury tampering.)

    Your discussions have always been great, but your production values just keep getting better. Your "A" camera framing is beautifully symmetrical. The lamp and Macallan whiskey are very strong as a central focal point. I'm a little disappointed that the focus on Jeseph on the "B" camera was off at times and the lighting on Michael's face was too contrasty, but such super production values. If I was falsely accused you would be my guys....except I am in New Zealand..... Might be a bit challenging? Keep up the wonderful work.

    Over here the Police have flat out said they're not interested in chasing false accusers in order to "not scare away genuine allegations".
    The only way you can actually get caught is if you openly admit it -- then they _have to_ investigate it.

      My story is absolutely unbelievable ; and is never ending
      My defense cousel costs are 13,000 so far. But the complaint ant in my case continued to cause property damage, defame me and continue historic allegation. It's like an open would that I'm not allowed to but a bandage on

    PART of why they won't punish false accusers is the government, but it's also the very real fear of the very vocal, vicious, and "true believer" feminist groups that will play dirty and mischaracterize what is being done.
    Totally my opinion, and it may be controversial, but to my mind feminist women don't want false accusers punished because it is often that very tool used by that same group.
    What does someone have to fear if false accusers are punished - think this through? They fear having what they are doing being **mischaracterized** - IOW - having what they are doing being LIED about. What tool or weapon is used against those who stand up to feminist ideology? Smear campaigns based on distortions and outright lies - ie false allegations.

    As soon you lie in court, you should get an automatic X number of time, in prison.
    First: You lied after swearing to tell the truth
    Second: You purposely waisted time and money, away from serious cases.
    Third: You tried to pull a fast one to a judge !

      In a certain sense, since the criminal justice system itself is the weapon that's used to commit these horrific crimes of sending innocent men to prison, these crimes are generally only detected when the crime is unsuccessful in it's entirety, that is, when an innocent man is not ultimately sent to prison (like attempted murder versus actual murder). But in cases where the crime is fully successful and an innocent man actually spends time in prison, then, assuming the falsification of the accusations can (sometime later) be proved beyond a reasonable doubt, it does seem like the false accuser should be sentenced to at least as many years in prison as the falsely accused was subjected to.

    In the U.S., the 14th Amendment to the Constitution has been affirmed over the centuries (of the US Supreme Court decisions) and regardless of which political party leaning that there are no positive rights to be protected from private actors' (people or organizations) harmful actions.
