This comes after the party's letter of demand to the Secretary to Parliament, and Chief Justice Raymond Zondo, asking them not to convene the first sitting, did not yield results.
The party seeks a hearing in the apex court before Friday.

I believe that 46 (1) applies much on the establishment of a parliament (for the first time after elections). It argues that without more than 350 parliament cannnot be constituted and cannot begin its business. However, 53(1) applies on cases where the parliament has already been constituted and has begun its work. In this light, the Mk party has a valid reason to challenge the opening of the parliament without the required number of more than 350 MPs. If the parliament had already been opened and Mps sworn in, evoking section 46(1) will be futile.

A quorum (134) comes after the composition of the National Assembly (min350 & max400), not the other way around. This is as simple as differentiating between a night and a day. Sometimes people turn to be fools at all cost, just to push a certain narrative and propaganda. It would the interesting to see how the apex court will seek to misinterpret the same constitution it claim to safeguard, just to favor the sitting of the NA, as JC Zondo alluded to media.

350-400 talk about the total number of Members that must be in parliament. It doesn’t address the quorum. The 1/3 is the one that does and says the sitting may go ahead with the business of parliament and that is voting for the Speaker and President.
When Zuma was being imprisoned without a trial. The SABC never showed the public section 35 of the Constitution, they never read out the Bill of Rights which showed how the ConCourt undermine Zuma's Constitutional Rights.

This is what the Constitutional Court has to clarify. In MP on election, this would imply the President who is on the list is an MP.
On the righing, MK has not put a case in the Electoral Court. The Court can deal with that, has to dismiss it.
