  • The constitution of the seventh administration has encountered delays as the signatories of the Statement of Intent struggle to find each other.
    These consultations are guided by the State of Intent (SOI), which IS BINDING the 10 political parties who signed it.
    Since his inauguration, all the Executive power has rested with President Cyril Ramaphosa. ANC NEC Member Ronald Lamola says the recent demands cabinet positions by the DA are outrageous
    And MK party is now officially in parliament under the leadership of Dr John Hlophe. MK Party MP Andile Mngxitama says they will never work with the ANC of Ramaphosa.

    Lamola doesnt understand that this arrangement is subject to both the Constitution and Statement of Intent of the GNU, which requires compromises from the President. The dynamics of this GNU mean parties can make policy and representative demands which must be managed by accomodating them approriateltly. Its just a mess

    My understanding of the President's prerogative is, we remove the face, in this case that of Ramaphosa, ANC's President. Then the Constitution covers him/her, whoever is President at the time.

    Regardless of if the President did or didn’t reason the majority of the vote. Cabinet positions are under the leadership of the President and should follow the policies of the President. Of course there should be discussion and negotiations, but at the end of the day, the final decision must come from the President.
    I like what the guest said, you must separate parliament and cabinet positions.

    there's nothing wrong the ANC is doing, the issue is the constitution doesn't cater for a GNU type of government. The president is not mandated to appointment ministers based on proportionality, which is a bit unfair in light of GNU.

    The ANC is delusional. While the president has the role of selecting the cabinet, his mandate is limited. His election was not solely based on the votes of his party; therefore, the ANC should accept that his power is politically constrained, not constitutionally absolute. The implementation of his functions is not solely constitutionally driven in practicality.
