    Myself and a small group of car guys fought hard for years to get local tracks and events opened up to drifting. We founded the drift scene where I live and gave people a place to do it safely and legally. Our motto was "Save it for a track day"... We didn't want anyone, a bystander, innocent family driving home, or anyone else getting hurt or killed.

    Back in the 90s I got off work on Brokaw, drove home to downtown. At the last second the police forced me back onto the freeway because they didn't want gangs cruising the neighborhoods. I damn near ran out of gas when they tried to force me back on the freeway the second time around. Took me 90 minutes to get home that night. They were out of their minds.

      likely by viewing the social media, and phone video. If I was stuck in traffic, and the cops gave me a ticket by mistake, I'd take the hit ( in the moment) just to get the little freaks off the road, then give proof I wasn't a spectator to a judge.

      I got a ticket like this once about 10 years ago. I fought it and got it dismissed cus there’s no way they can prove you were spectating.

      Many who show up in court will probably be able to get it dismissed. But you still had the inconvenience of having to show up in court. Also, if you end up getting another spectator ticket down the road, chances are less likely it will get dismissed. Courts don't find people innocent, they find them not guilty!

    I'm hoping they start doing mandatory 30-day impounds. Most wouldn't be able to afford to get it out.
    They don't come do it during the day. It's after midnight sometimes, and they have no regard for the residents who have to go to work. They block off intersections, and if you happen to pull up to the light right before they start, you're stuck until they're done spinning.

      Knowing they are inconveniencing other traffic, disrupting the night rest of nearby residences, blatantly disregarding laws and authority, that's what makes it fun for them.

      They have helicopters that monitor traffic, since this has been going on a while they probably know the particular cars that are likely to gather.
      A majority of tickets will get tossed out but recovering a gun and a couple of stolen cars seems worth it.

      It shouldn't go to the department, it should go back out to the public. Police should not be out there working for cash, as it allows corruption one of many ways to work its way into the departments. When you police for profit, you have incentive to make up fake crimes. It should be outlawed.

      Many who show up in court will probably be able to get it dismissed. But they still had the inconvenience of having to show up in court. Also, if they end up getting another spectator ticket down the road, chances are less likely it will get dismissed. Courts don't find people innocent, they find them not guilty!

    These laws, when challenged, will get slapped down. Will the news crews that filmed it be cited also? The obvious answer is no, you can't criminalize what someone sees in public. You can regulate a spectacle, not a spectator.

      The media outlets are there to report and broadcast news for LEGIT business outlets. They can't be cited because they are protected under constitutional law. The reporters are not partaking in or perpetuating any illegal activities, unlike the vast majority of the degenerates given tickets. And yes, what someone witnesses can be criminalized. Especially, if it's a criminal activity they are actively partaking in and not reporting. The severity of the offense can range from a misdemeanor to a felony, depending on the severity of the crime that took place and the perpetrators role in it. Members of the public are not legally required to report a crime, persay. However, thaf doesn't mean a witness can't be legally held responsible for not telling the truth or not reporting a crime when identified as a witness. Federal law (18 U.S.C. section 4) prohibits the concealing of information about specific crimes. In California, you can be charged with a crime that was committed if you "aided or abetted" in it's commission, but not actually commit the crime yourself.
      I don't know what fantasy world you live in, but how you feel about and what you think you know about the law, doesn't mean squat in the court of law.

      Every citizen in the United States is protected by the First Amendment, every instance where a news network would be protected, so too would a citizen. EVERY Citizen is MEDIA.
      Spectating an illegal act is not aiding and abetting the perpetrators of that act.
      If you don't understand or see the problem with these laws, I suggest you set aside your internet law degree and visit North Korea. There, when you commit a crime, your family is executed simply by being associated with you.

    Stay safe out there Dah Lin. Big thanks to SJPD for the huge crack down. I hope this didn't take too much time away from serious crimes like assaults or attempted homicides. While Oakland needs to work on getting a spectator law in place. They have a good deal with having outside agencies assisting with chasing away sideshow vehicles. San Jose also needs to have the same cooperation with it's neighboring law enforcement agencies. Yesterday was a success and yeah hopefully things stay quiet at least for the next few weeks. Maybe not for me there's still some fool doing burnouts near my house every weekend.

    The key is not only that the drivers received a ticket, but that the fine is high enough that it hurts. $1,000 fine is no small change. If the fine is only $100, some of them wouldn't care.

      In addition, their insurance will spike. If they decide to fight it there’s attorney fee and court cost. Those who participated (donuting) get $3K-$5K to get their car.

    Most of these "spectator tickets" will be easily thrown out if those that received them show up to their court date with reasonable legal arguments. It's not a crime to park on a public street. If you're not participating in criminality that's taking place (racing, burnouts, drifting) you've violated no law and were illegally detained. You may in fact have a counter suit.

Ever hear "innocent until proven guilty", the burden of proof is on the prosecutor and being present isn't proof of involvement. Any lawyer worth his salt could get these "spectating" charges thrown out so fast your head would spin.
      If you witness a bank robbery, do you need to explain why you were in the vicinity of the bank to not be associated with said robbery?
      That's not to say they couldn't pull texts and social media records of those ticketed and prove involvement. That said, it would take a lot of resources to prosecute people involved in watching street races. All while actual violent crime is through the roof and officer enrollment is dwindling. Not a good look to say the least.
