The plaintiff put a deposit on a condo the defendant owned. She claims her lungs started hurting soon after she moved in, so she brought an air specialist in who allegedly found mold. She has asthma, so she found it unlivable. She’s suing for the return of a rent and a mold test. The defendant argues his condo never had mold problems in the condo. He hired his own air specialist, who didn’t find any mold.
