WHY DO PEOPLE GET DENIED FOR VAWA ABUSE PETITIONS

  • The I-360 VAWA Petition helps to legalize, get a work permit and a green card for men and women who are still undocumented and suffering in a bad marriage to a U.S. citizen or even a Green Card Holder. But we have people calling us who already were denied daily. We sometimes take on these cases to overcome the denials, but I think it's a great idea to compile a list of common reasons for VAWA Denial.
    VAWA FAILS:
    1. NOT hiring a lawyer. Letting a paralegal, notario or a family member submit your VAWA Case is a big mistake that will cause you to get denied.
    2. Incorrect forms.
    3. Mailing your correct forms to the WRONG place.
    4. Incorrect fees for accompanying I485 Green Card Application and Work Permit forms.
    5. Incorrect or false information in the forms. Missing important information is also very problematic. Addresses, dates of birth, name spelling, dates and etc. must match - especially when you filed USCIS documents or Visa applications forms before and now the information contradicts what you said to the Government before.
    6. Missing a deadline for Request for Evidence. Right now, due to Covid, USCIS is giving extra 60 days grace period extension to almost any replies to their deadlines.
    7. Not sending in proof of the US Citizen Spouse's US citizenship (passport, Naturalization Certificate, or US birth certificate), or green card holder status proof.
    8. Not submitting enough proofs of marriage (JOINT documents) such as joint tax returns with the abusive spouse, joint bank statements, joint lease agreements, joint bills, proofs of joint travel and savings and expenditures together as a couple, NON-X-rated joint photos.
    9. Not sending in witness letters from people who can confirm you had a real marriage and that the spouse abused you verbally, emotionally, financially and sometimes physically.
    10. NOT going to a psychologist for an evaluation to be submitted with your case as proof of abuse and of the real marriage relationship.
    11. Not submitting any proof of abuse by the Citizen or GC holder spouse.
    12. Filing VAWA after 2 years from the date of divorce.
    13. Not submitting proof of good moral character (no criminal history, good moral behavior such as attending church or volunteering for some community organizations).
    14. NOT PREPARING FOR INTERVIEW.

    This are useless.only hearing from one party and destroy the other partners without the consent of the defendants.Proofing when the men document were already given for the purpose of marriage and Also immigration filing.Anyone can use that just to destroy the partner

      With Vawa the abusive spouse doesn’t have to know about what are you doing, the person who is filing for vawa doesn’t destroy anything because uscis never contact the abusive citizen or GC holder.

      @@MarinaShepelsky am in that situation, I was wrongfully arrested and charged but trying to get the case dismissed with a criminal defense lawyer that I've not been able to find yet, I know you don't do probono immigration and I respect you for your choices but I don't have work permit yet so I managed to find a probono immigration lawyer helping me with VAWA ..
      hoping one day I'll find a criminal defense lawyer probono as well, my chances are slim. The problem allegedly happened in Connecticut.

      because everything is delayed after COVID and they never recovered fully

      Will they allow an expedited situation if the person is in the UK, got married in riverside, CA and been separated for 3 yrs, he took all she had and abused her, left her homeless and in a womens refuge for 2 yrs now in the UK when she got back there due to a friend's help getting back to UK before I met her, and now she can't stay past the time where she lives as they only allow 2 yrs and doesn't make enough to move. She had trauma years she couldn't even be outside or anything, I helped mentor her through it for years and she spends all her time volunteering and I feel I found this for a reason, but then wondering Does she have to live in usa now to be considered? Is there a time frame she had to have lived in the usa before he stole everything and took off? He never helped her with a dime and continues to have his family stalk her on social media. He also has been with another woman since he left her and she hasn't with a man.
      Could she come up and stay for visiting or temp status through vawa prior to 30 months wait through ministry she has been with for 3 yrs or a sponsor that is not a family member?

      Mam I live in India, and never been to USA. Will still be eligible for the VAWA case? We haven't done divorce yet, my wife is keep on asking me to file divorce mutual otherwise will not come back to India nor she wants to live with me anymore.
