    I'm so glad my husband and took care of this 10 yrs ago, but it was hard then... we been married for 20yrs but we didn't file till we was married 10 yrs...

    When some of the criteria say that you can show bonafide marriage through having children, and/or joint ownership of assets, those are actually things that go against the constitution, freedom of expression They cannot force you to share assets, have joint names on the lease/mortgage/cars or force you to have children, this is just plain wrong. If this were true, then that throws prenuptial decrees out the window, I mean those are meant to let spouses maintain sole ownership of their properties. Why are legal immigrants being given second-class treatment? Since you are an immigration lawyer, you have my permission in bringing this up with the USCIS. I say permission because you might need my consent, I don't know.

    Wait, how is the couple’s fault not filed enough evidence when they hired that attorney to file their documents if the couple didn’t give enough evidence why did the attorney sent the file to the USCIS from the beginning 😮

      Some additional evidence can be presented at the interview, but they seem to be doing this even for cases with what can be considered strong evidence.

    Hi and thanks a lot for your very informative videos
    As a fact you have a lot of immigration answer shows but people can not watch all of them because they do not know which one is related to their case and which will give them useful information necessary for their case.
    Isn't it better to classify, sort and rename these videos based on the topics discussed in them so that the people would know which videos include discussions related and about their cases?

    Family based case Us citizen
    My husband was refused his green card wrongly. Counselor has stated 212(a)(6)(E)
    My husband was never involved in such a violation... This is crazy!

    That should be illegal, what if they just married a month ago and filed, right away, USCIS is just gonna pocket all the fees without having to do the work.

    I got the same request for evidence and NOID Letter in the same envelope. Am beyond scared of these people. The RFE is to submit the medical and the NOID I don’t understand it.

    Hi Jim! It is tax season, I am an American citizen, my husband is currently in AOS, we filed I-130 12/22 and AOS 01/23 we are waitingto receive his EAD card that was approved 10 days ago. :) How should I/we file taxes? Married jointly? Married separate? He does not have an SSN, nor an ITIN... Im posoitive that by the time we have the interview, having declared taxes will be a necessary evidence and we would like to have everything up to date, can you please let me know what should be the best thing to do?

    Hi Jim! Thanks for your video, it was really helpful. My husband and I filed I-130 and I-485 about a year ago and I’m afraid we didn’t submit any evidence other then what was asked in the forms we filed… how does sending more evidence works!? Should we just send more evidence with a letter containing our case number? Or refill the forms…

    They denied my wife i485 because they didn’t receive her medical but we send it we have the proof the copy and trucking number that show it’s been delivered at the address of it.thank you

      It's really concerning how they're pushing back against legal immigrants, but encouraging illegal immigrants.
      That puts all illegal immigrants in a very precarious situation. Whenever the government mandates anything, they'll have to comply with it for fear of getting into trouble with the law, being found out and getting deported.
      Somebody needs to talk about this.

    I have been waiting since July 2021 , they sent a notice of intent to deny his fiancé visa because we sent in a paper saying we are married in Islam,, which is not binding in the US. This is before his interview, and we have heard nothing back since 95 days since the request for evidence,, I have flown 5000 Miles 3 times … my intention to deny and RFE was basically the same letter. What should I do

    Hey Jim, I received my RFE on December only for my medical examination and the letter says that they will get back to my with a final decision, but I didn’t receive an interview or anything.

    I recently received REF for I-693 for AOS case. I have not received an interview date but the REF for my I-693 has a due date. I have not received my EAD or AP. Is this normal for USCIS to request I-693 before scheduling interviews?

      You cannot. There is a minimum of 15 years of waiting for a visa to become available as a sibling of a US citizen. If you're in the US and want to wait, you must maintain lawful status in the US for the entire time (again, 15 years, _minimum_), which is not possible on a visitor (B-1/B-2) status.

      @@amrreda794 You can apply for a change of status to a variety of other non-immigrant statuses, such as F-1 student, H-1B worker, etc. It depends on what you want to do and what you're qualified for.
